    OF
    MARVIE S. FERNANDEZ

    I, MARVIE S. FERNANDEZ, Filipino, married, with residence at Solid Town


    Homes, Basak, Lapu-Lapu City, after having been duly sworn in accordance
    with law, hereby depose and state:

    That I am a witness of the above-entitled case;

    That this Judicial Affidavit is executed to serve as my direct testimony


    and prove the following:

    1.To corroborate the testimony of the private complainant;


    2.Both the accused initiated a settlement after the committing the
    crime of trespass to dwelling;
    3. The private complainant refused the offer of both the accused to
    settle the said case;
    4.To identify relevant documents as proof that indeed both the
    accused committed the crime of trespass to dwelling;

    And all other allegations in the information including all annexes
    appended thereto and all other related matters, facts and circumstances
    relevant and material to this case;

    This Judicial Affidavit was taken at the office of Atty. Mario S. Rizon Jr.
    at Cortes-Rizon Law Offices located at Upper Ground Sebastien Hotel, Ibapo
    Mactan, Lapu-Lapu City 6015 Philippines;

    The questions asked by Atty. Mario S. Rizon, Jr. and the answers I
    gave are as follows, to wit:

    1. Q) Please introduce yourself and personal circumstances? ( Ipa-ila


    ilaha ang imong kauglingon og mga personal nga detalye.)

    A. I am Marvie S. Fernandez, of legal age, resided at Solid Town


    Homes, Basak, Lapu-Lapu City

    2. Q) What is your involvement in the instant case? ( Unsa imo imong


    kalmbigitan niining kasoha?)

    A) I am a witness to the instant case sir; ( usa ko ka saksi sa mga pang


    hitabo)

    3. Q) With your answer above, what actually transpired during the


    incident relevant to the instant case? (Sa imong tubag sa ikaduahang
    pangutana, unsa gayud ang nahitabo niining kasoha?)

    A) To recall, at an approximately 9am on December 9, 2018, both the


    accused Eduardo (Eduardo for brevity) and Ludivina ( Ludivina for
    brevity) all surnamed Patalinghug, went to our new place
    requesting the keys for the residential house located at Camella
    Homes Monserrat, Pajac, Lapu-Lapu City, which the Private
    Complainant currently rented and possessed by the preceding
    from Eduardo and Ludivina; ( Sa akong nahinumduman, niadto si
    Eduardo og Ludivina sa bag-ong lugar nga among padulong
    balhinan, og nangayo kini sila sa yawi sa balay didto sa Camella
    Monserrat, nga niadtong tungura, gi-abangan pa sa private
    complainant og gi posisyonan)

    4. Q) And then, what happened next? (Unya, unsay sunod nga
    nahitabo?)

    A) I decided to leave them with Claude (Private Complainant), since I


    was very busy attending for the needs of my children like
    preparing for their breakfast; (Nakahukum ko nga ako una silang
    biyaan aron pag atiman sa akong mga anak, para maka kaon og
    pamahaw)

    5. Q) After that, what’s next? (Unsa pay sunod nahitabo)

    A) At around 10am, the private complainant told me that he will go to


    the leased premised (Pajac Residence) in order to haul our things
    which were still in the premises of the aforementioned; (pag alas
    10 sa buntag, ang private complainant nag ingon nga moadto siya
    sa Pajac para mukuha sa among mga personal nga mga gamit nga
    niadtong tungura naa pa sa maong lugar (Pajac residence);

    6. Q) Thereafter, what else? ( Pagka-human, unsa man sunod?)

    A) The private complainant called me that there was a commotion in


    the leased premises and instructed me to go to the place of
    incident in order to assist him since he is alone in the said place;
    (Ang private complainant nitawag nako nga dunay kasamok nga
    nahitabo didto sa Pajac og nag ingon nako nga moadto sa maong
    lugar aron pag asister niya kay siya raman usa)

    7. Q) After a call from the private complainant, what did you do?;
    (Human sa tawag sa private complainant, unsa man imong gibuhat?)

    A-1 I decided to leave and go to Camella Monserrat, Pajac, since I am


    worried for the safety of the private complainant; (Nakadesider ko nga
    moadto sa Pajac kay nabalaka ko sa kaluwasan sa private complainant)

    A-2 At around 11:30 in the morning, I arrived at the place of incident


    ( leased premises) and I saw he private complainant incurred few
    scratches on his arms; (Pasado 11:30 sa buntag, naabot k osa Pajac
    residence og ako Nakita ang mga samad sa private complainant)

    2. Q) After your discovery, what did you do? ( human sa imong Nakita?
    Unsa imong gibuhat?)

    A) I decided to go to the barangay to blotter the incident; ( Naka-


    desider ko nga moadto sa barangay aron magpa blotter sa mga pang hitabo)

    3. Q) After you went to the Office of the Barangay Pajac, what happened
    next? (Human nimo pag adto sa Barangay Hall, unsay Nahitabo?)

    A) At around 12:30 – 1 pm on December 10, 2018, I have a


    confrontation with the accused, in fact they ( both the accused)
    called a police and suggested to take a custody of the private
    complainant, alleging therein that the forgoing committed the
    crime of trespass to dwelling, and I insisted that they are the one
    who should be held liable for the crime of trespassing since the
    private complainant is the lawful possessor of the said property,
    and they intruded into the said place without the private
    complainant’s authority; ( Sa bana bana nga oras pasado 12:30 pm
    – 1pm sa Disyembre 10, 2018, duna kami komprontasyon sa mga
    akusado, og sa tinud-aray ni kontak pa sila og police og nag mando
    sa police nga ipa dakop ang private complainant kay naka himo
    siya og krimin nga trespassing, og no rebatar ako nga dili ang
    private complainant ang naka imo sa maong krimen kun dili ang
    mga akusado kay sila nisulod sa maong lugar nga walay pagtugot
    sa private complainant nga mao ang legal nga nag okupar sa
    mgaong lugar);

    4. Q) And after you insisted with your argument, what happened next?; (
    Human sap ag insister sa imong argumento, unsay sunod nahitabo?)

    A) The police officer made a comment to resolve the said conflict and
    thereafter, the accused proposed a settlement to end the issue; (Ni
    komentar ang Police nga sulbaron namo ang maong panag bangi og
    diha diha dayon nag propose og settlement ang mga akusado)

    5. Q) After the offer of settlement by the accused, what is your reaction?


    ( Human sa offer sa settlement sa akusado, unsay imong reaction?)

    A) I refused to accept their offer since I will first consult the said offer
    to the private complainant; ( Nibalibad ko sa pag dawat kay ako pang
    gi konsulta ang private complainant)

    6. Q) After your refusal, what else did you do? (Human sa imong Pag
    balibad, usna pay imong gibuhat?)

    A) I went to the private complainant and ask him with regard to the
    offer; (Nibalk ko sa private complainant para pangutan-on og unsa
    iyang desisyon sa maong offer sa mga akusado)

    7. Q) What is the reaction of the private complainant towards the offer


    of settlement by the accused? ( Unsay reaction sa private complainant
    niadtong offer sa mga akusado?)

    A) He refused because he was very angry at that time; ( Nibalibad


    siya kay nag lagot siya niadto panahuna tungod sa pang hitabo)

    8. Q) After you knew the reaction of the private complainant, what did
    you do? ( human nimo nasuta ang reaction sa private complainant,
    unsa imo gibuhat?)

    A) I went back again to the Office of the Barangay Pajac and pay for
    the rent amounting to TWO THOUSAND FIVE HUNDRED (PHP
    2,500.00), equivalent to a daily rental amount of FOUR HUNDRED
    PESOS (PHP 400.00), for a period from December 3 – 9, 2018;
    (Nibalik ko sa Barangay Hall og nibayad og 2500 balor sa among
    abang gikan December 3- 9, 2018);

    9. Q) With your answer above, why did you pay the aforesaid amount?
    Do you owe any monetary obligation from the accused? ( Sa imong
    tubag sa taas nganong nibayad man ka niadtong kantidara? Duna kay
    obligasyon sa akusado?

    A)No, but to pay for the rental period from December 3- 9, 2018;
    (Wala, apan bayad kato sa abang namo gikan Disyembre 3 – 9, 2018);

    10. Q) do you have any proof of the said payment? (Duna ka


    pruweba sa maong bayad?

    A)Yes, we have an acknowledgment receipt; (O, Duna koy resibo);

    11. Q) I am showing you this acknowledgment receipt which is


    previously marked as Exhibit C, is this the one you are referring to?
    (Akong ipakita ang acknowledgment receipt nga gi markahan
    kaniadto as Exhibit C, mao ba kini ang imong giingon nga resibo?)

    A) Yes Sir. (O, mao na sir)

    12. Q) Are you authorized to make the said payment in favor of the
    private complainant for his rent obligation to the accused? (Duna
    bakay awtoridad sa mag himo og bayad sa maong kantidad para sa
    abang obligasyon sa private complainant adto didto sa mga akusado?)

    A)Yes sir, in fact the money belongs to him and he recognized such
    agreement in good faith; ( Oo sir, in fact ang kwarta gipanag-iya na sa
    private complainant and iyang gi-ila iyang obligasyon sa pagbayad
    ngadto sa mga akusado

    13. Q) Do you have anything to add or retract from your statements


    above? (Duna pakay ipuno or ikuha sa maong kasaysayan sa itaas?)

    A)None sir. ( Wala na sir)

    1. I was the one who conducted the examination of witness


    MARVIE S. FERNANDEZ at my aforementioned office at
    Cortes-Rizon Law Offices, Upper ground, Sebastien Hotel, Ibapo,
    Mactan, Lapu-Lapu City;

    2. I have faithfully recorded or caused to be recorded the


    questions I asked and the corresponding answer that the
    witness gave;

    3. Neither I nor any other person then present or assisting her


    coached the witness regarding her answers.
