                                         ORDER

1. The   applicant  is seeking his enlargement  on bail in  Crime


No.571/2018, registered by Pant Nagar Police Station, Mumbai for
the offence punishable u/s. 302, 363, 364, 365, 396, 201, 120(B)
r/w. 34 of Indian Penal Code.

2. It is the case of prosecution that the first informant namely
Raunak   Rajeshwar   Udani   reported   to   Pant   Nagar   Police   station
that on 28.11.2018 at about 8.30 pm. his father namely Rajeshwar
Udani left the office with driver namely Vijay Misal in his car I­20
bearing number MH 03­CM­ 9789. However, his father till 08.00
am. of 29.11.2018 did not return to home therefore, he was trying
to call his father. But he was unable to contact with his father.
Therefore, he went to inquire with driver Vijay about his father.
The driver Vijay informed that on 28.11.2018 at about 8.40 pm he
has dropped his father in front of corner of Vikroli Traffic Square,
near to Easter freeway, Ghatkopar (E), Mumbai. The driver further
informed that on 28.11.2018, when they reached on the aforesaid
spot, his father was talking on phone about 30 to 35 minutes with
somebody. Thereafter, his father boarded into one white colour I­
10 car and went towards the direction of Thane.

3. The   father   of   first   informant   could   not   return   home


therefore, on 29.11.2018 at about 4.00 pm, he has made missing
complaint with Pant Nagar Police Station. Thereafter, he has taken
search   of   his   father   at   every   place,   but   he   could   not   find   him.
Therefore, on 03.12.2018 he made report that his father has been
kidnapped by unknown accused person. The officer incharge has
registered the crime no. 571/18 , for the offence punishable u/s
363   of   IPC,   against   unknown   accused   person   and   thereby   set
criminal law in motion.

4. The   learned   advocate   Shri   Phonda,   by   filling   his   written
notes have argued that the only circumstances against the accused
are   Last   seen   together,   recovery   of   gloves   &   Mask   and   the
applicant was in Panvel in early hours of 29.11.2018. It is argued
by   him   that   the   prosecution   in   order   to   complete   the   chain   of
circumstantial evidence has no scientific evidence in the form of
electronic data like mobile tower location, CCTV etc, there are no
witnesses   claiming   that   applicant   was   seen   at   Panvel   on
28.11.2018, no single witness is examined till 16.01.2019, except
statement   of   driver,   who   claimed   he   has   dropped   the   applicant
from Panvel to Vikroli. The taxi driver is the got up witness. There
is unexplained delay in recording of his statement. 

5. It   is   further   argued   that   as   per   prosecution   case,   the


statement   of   Sohel   and   Linos   shows   that   they   have   seen   the
applicant together with other accused at Rabale, Navi Mumbai. But
the dead body was found at Panvel on 04.12.2018. Thus, even if
their   statement   are   taken   as   it   is,   but   there   is   long   time   gap
between   the   accused   seen   together   and   recovery   of   body.
Therefore, it is submitted that at present there is very weak kind of
circumstantial evidence brought on record by the prosecution. In
support   of   his   arguments,  the  learned  advocate   relied  upon  the
following judgments:­

6. Per   contra   learned   Chief   PP  and   Investigating  officer   Mrs.


Sutar opposed the application by filling their say below Exh.2. It is
vehemently   argued   by   prosecution   that   the   accused   no.1   in
collusion   with   accused   no.2   decided   to   eliminate   the   deceased.
Accordingly, they hatched conspiracy and included accused no. 6
& 7 in the conspiracy, as deceased was having attraction towards
girls. Accordingly, the accused no.2 with the help of accused no.3
to 5 made preparation to commit crime, they have kidnapped the
deceased in vehicle I­10 by putting false number plate and took
him near Alkali Bus stop, Rabale station, Navi Mumbai, accused
no. 2 to 4 boarded the car and committed murder of deceased by
putting   birthday   cake   into   his   nose   and   mouth   and   while
committing the murder, they have robbed the valuables and cash
from the person of deceased. Likewise, the accused persons with
intention to screen the evidence, has destroyed the mobile phone
of deceased, cloths stained with cake and the mobile phone used
in the commission of offence.  Thus, it is submitted by prosecution
that   the   offence   is   very   serious,   there   is   evey   possibility   of
tampering with the prosecution witnesses as most of the important
witnesses   are   know   to   the   accused   persons.   Hence,   prosecution
prayed for rejection of the application.

7. Heard both the side at length, perused application, say and
charge   sheet,   it   appears   to   me   that   on   29.11.2018   the   son   of
deceased lodged missing report. The deceased was lastly seen and
dropped by his driver Vijay on 28.11.2018 at about 8.40 pm in
front of corner of Vikroli Traffic Square, near to Easter freeway,
Ghatkopar (E), Mumbai. He has seen the deceased entering into
white colour I­10 car, which is used in the commission of crime. 

8. It   appears   from   the   record   that   on   04.12.2018   the   first


informant   made   supplementary   statement   that   cashier   of   their
company namely Archana Thakur informed that on 28.11.2018 in
afternoon his father has made what's up message to Sachin Pawar
and demanded money. His father received message from Sachin
Pawar that  "before 3rd December will close this"  Likewise, she also
gave  Rs.40,000/­  cash to his father. Therefore, on the aforesaid
statement, the offence punishable u/s 365 of IPC was added.

9. It appears that during investigation, on 04.12.2018 one dead
body   was   found   in   Panvel   Taluka,   District:­   Raigad,   which   was
identified   by   the   first   informant.   The   dead   body   was   sent   to
autopsy at KEM hospital. The opinion in respect of cause of death
was received as "  Evidence of nasal bone fracture with fracture of
hyoid   bone   suggestive   of   death   due   to   asphyxia   by   smothering
with   manual   strangulation   (unantual)"   As   the   dead   body   was
found at secluded place and belonging of the deceased was not
found on his person, therefore, on 07.12.2018, the investigation
officer added offences punishable u/s 302, 364, 394, 201, 120(B)

10. It   appears   that   on   06.12.2018   investigation   officer
interrogated   Ashish   Sharma   and   Durgesh   Nagar,   who   are   the
partners of Sachin Pawar (Accused No.1). In the aforesaid inquiry
it   reveled   that   Sachin   Pawar(Accused   No.1)   was   indebted   to
deceased   and   deceased   was   persistently   demanding   the   said
amount.   The   aforesaid   statement   is   corroborated   with   the
statement of Archana Thakur, the cashier of deceased. 

11. On 07.12.2018 the investigation officer inquired with Rajesh
Yedre,   who   is   the   office   boy   of   accused   no.1   and   recorded   his
statement. The witness Rajesh stated that, he know accused no.2
Dinesh   Pawar   ,   Siddhesh   Patil   (Accused   No.3),   Mahesh   Bhoir
(Accused   No.   4)   and   deceased.   He   has   further   stated   that   on
20.11.2018, on the say of accused no.1, he has collected mobile
phone of Samsumg make, from Siddesh Patil, accused no.3, which
he   has   purchased   from   Croford   Market.   The   aforesaid   phone   is
recovered at the instance of accused no.2, in half burn condition. 

12. On   01.12.2018,   at   about   8.30   pm.   the   accused   no.   1


demanded his sim card having number 9323231010. Therefore, he
has given his Sim Card to accused no.1. On 03.12.2018 accused
no.1 made phone call to him asking him to prepare two number
plates immediately and asked him to give the same at Panvel to
the   person   as   directed   by   the   accused   no.1.   Therefore,   he   has
prepared two number plate MH­02­DW­0628 from Sahil Shaikh .

Accordingly, he went to Panvel, meet with accused no.4 Mahesh
Bhoir and handed over the number plats to Arvind Patil. 

13. On the basis of aforesaid material, the accused no. 1 came to
be arrested on 08.12.2018. On 09.12.2018 the investigating officer
recorded statement of Mrs. Swati Arvind Patil. She has informed
that on 04.12.2018 her sister in law namely Samiksha came to her
house along with accused no. 2 Dinesh Pawar. They have taken
two   number   plates   with   them.   The   prosecution   subsequently
obtained the CCTV footages showing the accused persons changed
the number plates of I­10 car. 

14. On   09.12.2018   the   investigating   officer   recorded   the


statement of Samiksha Chauhan. She has stated that since August
2008 she has acquaintance with accused no.2 Dinesh Pawar. On
27.11.2018 she has received phone call of Dinesh Pawar. He asked
her about pain killer and sedative. She agreed to hand over the
same to him. Accordingly, on 28.11.2018 at about 1.00 pm, she
has handed over the painkiller, to friend of Dinesh, Sohil Golandaj,
at Jain Hotel, Kandiwali. She has further stated that on 29.11.2018
at   about   1.30   am   she   has   received   phone   call   of   accused   no.2
Dinesh Pawar, he was asking for room to stay at Murud Janjira.
She   told   her   to   visit   her   native   place   Ekdara,   Murud   Janjira,
District­ Raigad. Accordingly, she has informed her father to make
arrangement for accused no. 2 Dinesh for his stay. On 29.11.2018
Accused  Dinesh  reached at  her  native   place  along with  accused

No.6 Nikhat Khan. The accused Dinesh used the mobile phone of
witness Sohel. The CDR location as well as statement of witness
Samiksha corroborated with the aforesaid fact.  

15. It is further stated by her that accused no.2 and 6 stayed for
entire day on 29.11.2018 at her house and in the evening at about
7.30 pm. they started from Ekdara to proceed towards Mumbai.
The   accused   no.2   had   stated   that   his   car   was   having   some
problem,   therefore,   she   has   arranged   another   car   of   Mubin
Aadmane  on  hire.  The  prosecution in order to corroborated the
aforesaid   fact,   recorded   the   statement   of   father   of   Samiksha   as
well   as   other   witnesses,   which   corroborates   with   the   fact   that
accused Dinesh after commission of the crime came to the house of
Samiksha   at   Ekdara.   During   investigation,   the   blood   stained
sample were recovered from the aforesaid car, which is match with
the DNA of deceased.  

16. It   has   further   stated   by   her   that   on   01.12.2018   at   about


11.15   am.   she   has  received  phone   call   of  accused  no.2,  he   has
informed that he would be going to her native place to pick up his
car. As she was also about to go to her native place therefore, she
also   accompanied   accused   no.   2.   They   reached   Ekdara   on
02.12.2018 at about 1.30 am. They stayed there upto 03.12.2018.
The accused no.2 showed her silver colour chain with pendent of
golden   key,   some   diamonds,   wrist   watch.   The   accused   further
asked her about anyone know to her at Panvel, as he wanted to

bring new number plate  of his vehicle. She informed about  her
brother namely Arvind. The accused no.2 told her that his man
will visit to her brothers house and will drop the number plats and
told her to keep that number plates with him. Accordingly, she has
informed   to   her   brother   Arvind.   The   aforesaid   wrist   watch   and
ornaments were subsequently recovered at the instance of accused
no.2. 

17. It has further stated by her that on 04.12.2018 they started
to   proceed   at   Panvel   in   vehicle   I­10   of   accused   no.2   and   they
reached at Panvel by 7.45 am.     The accused no.2 changed the
number plate of his vehicle, which was already kept in the house
of her brother. Thereafter, they started towards Vikroli (E). The
accused   no.   2   drop   her   at   Vikroli   Bridge   and   she   came   to   her
home.   

18. On   10.12.2018,   the   investigating   officer   has   recorded   the


statement   of   Devolina   Dilipkumar   Bhattacharya.   She   has   stated
about her intimacy with Accused No. 1 Sachin Pawar. She was also
known to deceased. They used to meet together. However, accused
no.1 did not like she getting friendly with deceased. The statement
of aforesaid witness corroborate with the motive assigned by the
prosecution. The statement of cashier of deceased as well as other
witnesses   also   point   out   that   accused   no.1   was   indebted   to
deceased and deceased was insisting for his money.

19. On 12.12.2018 the investigating officer recorded statement
of   Linos   Bodak   and   Sohil   Golandaj.   The   witness   Linos   in   his
statement has stated that on 29.11.2018 between 8.30 pm to 8.45
pm. he along with Sohil were present at Saiprakash Banquet Hall,
Vikroli (E), Mumbai. At that time accused Dinesh, Sachin, Mahesh
Bhoir   @   Babu   were   also   present.   Sachin   Pawar   asked   Sohil   to
bring   cake.   They   went   to   Neha   Bakary,   brought   the   cake   and
handed over the same to accused Dinesh. The accused Dinesh and
Sachin asked them to show way till Ghansoli to Mahesh Bhoir as
he   is   new   driver.   In   the   aforesaid   vehicle   accused   no.   6   Likhat
Khan was seating on back side. The accused asked them to reach
infront   of   Gate   of   Cashurina,   Near   BEST   bus   stop,   Ghatkopar.
Accordingly, they went there. The accused Sachin got down from
I­10   and   boarded   his   Scoda   and   went   towards   Ghatkopar(W).
Thereafter, they came near the bridge, where one red colour car
was stationed. Out of aforesaid red colour car deceased got down
and   sat   in   I­10.   Thereafter,   they   started   from   right   on   Thane­
Belapur road. They were with the I­10 car till Standard Alkali Bus
Stop, Rabale, Navi Mumbai. On the bus stop accused Dinesh and
his   two   friends   were   already   standing.   The   accused   Dinesh,
Mahesh and Siddhesh  hurriedly boarded in I­10 car. 

20. The witness Sohil Golandaj in his statement stated that on
28.11.2018 at about 12.30 pm to 1.00 pm as per say of accused
Dinesh   Pawar   (Accused   No.2)   he   has   collected   box   containing
injections from Samiksha Chavhan from Kandivali Railway station.

Thereafter,   at   about   5.00   pm   to   5.30   pm,   again   accused   no.   2
Dinesh Pawar made phone call to him and told him to escort his
two friends who are reaching at Amarmahal, Chembur and to drop
them at the house of Ajay Ambokar at Vikroli. Those two friends of
accused   Dinesh   Pawar   were   Pranit   Bhoir(Accused   No.5)   and
Mahesh Bhor(Accused No.4). The accused Dinesh gave him phone
number   of   Pranit   Bhoir   to   contact   with   them.   Accordingly,   he
picked up them, they gathered at the house of Ajay Ambokar at
about 6.30 pm. After some times accused Dinesh Pawar reach. He
again   told   him   to   bring   his   another   friend   i.e.   Siddhesh   Patil
(Accused No.3) who was reaching at Vikroli Bridge. Therefore, he
along with Pranit Bhoir (Accused No.5) went to Vikroli Bridge in
auto.   He   took   Accused   no.3   from   Vikroli   Bridge   and   they   trio
proceeded towards Sai Prakash Banquet Hall, Vikroli, as directed
by Dinesh Pawar (Accused No.2). After reaching there, he found
accused   Sachin   Pawar   (Accused   No.1),   Dinesh   Pawar(Accused
No.2)   accused   Nikhat  Khan  (Accused  No.7)   and    Mahesh  Bhoir
(Accused No.4) in I­10 car. The accused No.1 Sachin Pawar got
down from Car and put radium number place bearing no. MH­03­
AP­4811 on the number plat of I­10 car. 

21. It is further stated by Sohel that on 28.11.2018 he and his
friend   Linos   had   plan   to   go   at   Badalapur   at   the   house   of   their
friend. Therefore, at about 8.30 pm to 9.00 pm. Linos came at Sai
Prakash Banquet Hall, Vikroli. Dinesh Pawar (Accused No.2) asked
him to brought one Birthday Cake. He also asked him to give his

phone   for   calling.   Therefore,   Sohel   gave   his   phone   to   Dinesh
Pawar. Thereafter, he brought Birthday Cake and gave the same to
accused   Mahesh   Bhoir.   At   that   time   accused   Sachin,   Dinesh,
Mahesh   and   Siddhesh   Patil   were   standing   near   I­   10   car.   After
sometimes at about 9.15 pm accused Pranit boarded car to drive
and accused Sachin also boarded in the car. The accused No. 7 was
already seating in the car. The accused Dinesh Pawar told him that
driver Pranit is new. Therefore, as he was going at Badalapur, the
accused Dinesh told him to show way to Pratin till Ghansoli. The
accused Sachin Pawar told Sohel and Linos to reach at Ghatkopar
Bus Stop, infront of gate of Cashurina Society. Accordingly, they
reach there. Thereafter, accused Pranit Bhoir came with I­10 car.
The  accused Sachin  Pawar  get  down  from the  car and he  went
towards LBS by his Scoda car, which was already parked there.
The   accused   Pranit   took   U­turn   and   proceeded   towards   Easter
Express   Highway.   As   asked   by   Dinesh,   Sohel   and   Linos   was   to
show the way to Pranit upto Ghansoli, they also followed Pranit.
While, they were on their way Pranit took turn infront of Vikroli
Traffic   Square,   on   the   way   proceeding   towards   Easter   Express
Highway and stop his car near one red colour car. Out of aforesaid
red colour car one male person, aged between 50 to 55 years, get
out of that car and hurriedly boarded Pranit Car. Thereafter, the
Car of Pranit was proceeded on Easter Express Highway towards
Airoli   Toll   Naka.   Sohel   was   driving   ahead   and   Pranit   car   was
following them. While they were on their way, Dinesh was asking
to Sohel, by making phone call on phone of Linos from the phone

of Sohel, as to how much distance they have cross. At about 10.00
pm.,   after   crossing   new  bridge   of   Rabale  Station,  all   of   sudden
Pranit applied breaks and stop his vehicle. Linos stop his vehicle to
see   what   happened.   When   they   saw   on   back   side,   they   found
Dinesh   Pawar   entering   into   car   of   Pranit   in   hurried   manner
following him accused Mahesh Bhoir & Siddesh Patil also boarded
into Pranit car.

22. It has further stated by Sohil that on 29.11.2018 at about
10.30pm, the accused Dinesh Pawar made phone call on the phone
of Linos and asked him to bring Bullet of Sachin Pawar, which was
parked at Sai Prakash Banquate Hall Vikroli. Accordingly, he along
with Linos took the Bullet of Sachin Pawar from said place and at
about   12.00             O'clock,   went   near   Vikroli   Bridge.   After   some
times, Pranit Bhoir, Dinesh Pawar and Nikhat Khan came in one
INNOVA car. He handed over the Bullet to Dinesh pawar. Dinesh
Pawar   and   Nikhat   Khan   went   with   Nikhat   Khan   on   the   bullet.
Sohel   was   asked   by   Dinesh   Pawar   to   reach   at   House   of   Ajay
Ambokar. Therefore, Sohel and Linos reach there. At about 1.30
am,   Dinesh   Pawar   reach   in   the   house   of   Ajay   Ambokar.   Sohel
claim his mobile phone from Dinesh but he did not give him. At
about 2.00 am to 2.30am, his phone was handed over to him by
the brother of Dinesh pawar by name Ganesh Pawar, at his house.
The investigating officer showed him the photographs of deceased.
He identified and stated that deceased was present in the I­10 car
on 28.11.2018 along with other accused persons.

23. Thus, from the statement of Linos and Sohel, it appears that
from   28.11.2018   after   16.00   hours,   the   accused   were   came
together. From the statement of Rajesh Yedre, that he has handed
over the phone to Siddesh Patil, the CDR of that phone number is
reflected in the crime, therefore on 12.12.2018 the applicant came
to be arrested by the investigating officer. 

24. On 13.12.2018 the investigating officer further obtained the
CCTV   footages   of   28.11.2018,   wherein   witness  Sohel,  Linos   are
seen   along   with   their   two   wheeler.   The   accused   Siddesh   Patil,
Mahesh Bhoir and Dinesh Pawar along with white colour Car also
seen in the footage. Further the CCTV footage of Neha Bakari was
also obtained, wherein witness Sohel is seen while taking Birthday
Cake. 

25. On   14.12.2018   accused   Dinesh   Pawar   in   his   confessional


memorandum,   showed   the   place   at   where   he   has   burned   the
cloths,   mobile   and  hand  glove   at   Ekdara   village   and   as  per   his
confessional memorandum, investigating officer recovered the half
burn Mobile, cloths and gloves. . 

26. On 14.12.2018 investigating officer also recorded statement
of Smt. Swati Desai. She has stated that on 28.11.2018 at about
5.00 pm. Sachin took her I­10 car on count of showing the said car
to some person, as she wanted to sold the said car.

27. The   investigating   officer   recovered   the   CDR   details   of   all
accused. The details of Whats'up communication chat.   The CDR
location   and   communication   of   present   application   with   other
accused is prima facie established by the prosecution. 

28. On the analysis of entire material it appears that the motive
behind the crime is that deceased was having bad eye on the lover
of   accused   no.1   and   also   deceased   was   demanding   his   money
which   accused   no.1   was   owned.   The   accused   Siddesh   brought
mobile phone, which was used in the commission of offence. They
gathered   together   on   28.11.2018   infront   of   Cashurina   Society,
Ghatkopar,   thereafter   at   Sai   Prakash   Banquet   Hall,   Vikroli.   The
investigating officer collected CCTV footages, wherein the accused
Siddhesh is also seen. The statement of Sohel and Linos shows that
accused   all   accused   including   Siddhesh   were   together   upto
Standard Alkali Bus Stop Rabale, Navi Mumbai. 

29. The   dead   body   of   deceased   was   found   on   04.12.2018   at


Deharang   Dam,   Panvel.The   post   morterm   report   shows   the
tentative death of deceased is before 72 hours due to "  Evidence of
nasal bone fracture with fracture of hyoid bone suggestive of death
due   to   asphyxia   by   smothering   with   manual   strangulation
(unantual)".The   ornaments   of   deceased   were   recovered   at   the
instance of accused no. 2. The wrist watch of witness Anamika,
which was given to deceased by her for repairing, also recovered at
the   instance   of   accused   no.2.   The   hand   glove   which   were

recovered at the instance of present applicant is similar to the half
burn hand gloves recovered at the instance of accused no.2. The
bunch   of   keys   of   deceased  is   recovered   from   the   vehicle   at   the
instance of accused no.1.The DNA of deceased matched with the
blood stain recovered from the vehicle. The aforesaid recovery are
prima facie believable before, the narration of all the articles were
given by the witnesses even prior to recovery of dead body and
disclosure of names of accused in the crime. Thus, from the entire
material   as   discussed   above,   in   my   view,   prima   facie,   the
involvement of accused is established by the prosecution. As most
of the prosecution witnesses are related or know to the accused
persons,   hence,   I   find   substance   in   the   apprehension   of   the
prosecution   that   accused   would   influence   the   witnesses,   if
enlarged   on   bail.   Thus,   looking   to   the   nature   of   offence   as
committed, Prima facie it appears, that the applicant is also one of
the conspirator in committing murder of the deceased. Hence, I am
not inclined to release the application on bail. Thus, I proceede to
pass the following order:­
                             ORDER 
1. Application vide Exhibit­3 stands rejected.
2. Application stands disposed off accordingly.
