ORGANIZING THE CITY/MUNICIPAL TRICYCLE TASK FORCE AND SECRETARIAT,


AND DEFINING THEIR RESPONSIBILITIES

WHEREAS, the Local Government Code has devolved to city and municipal governments, through
Sanggunians, the power to regulate the operations of tricycles/ pedicabs and to grant for the operation
thereof within their territorial jurisdiction;

WHEREAS, President Rodrigo Roa Duterte, during his 4th State of the Nation Address (SONA),
issued a directive to all local chief executives to clear roads of illegal structures and obstruction, to
reclaim public roads that are being used for private purposes, and to revoke permits that give authority
to private entities to occupy public roads, alleys, and other thoroughfares and to ensure the safety of
the general public;

WHEREAS, DILG Memorandum Circulars No. 2020-004 and 2020-036 further reiterate the
guidelines on franchising of tricycles issued in 1992 by the Department of Transportation which, among
others, prohibit the operations of tricycles along national highways, mandates Local Government Units to
ensure the roadworthiness of tricycles, pedicabs, and motorized pedicabs, and set the minimum
operating conditions necessary to the issuance of motorized tricycle operators permit;

SECTION 1. The City/Municipal Tricycle Task Force is hereby reorganized with the following
composition:

SECTION 2. The Tricycle Task Force Secretariat


The Head of the City/Municipal Legal Office shall provide secretariat support to the committee

SECTION 3. The Tricycle Task Force shall have the following responsibilities:

1. Conduct meetings, public consultations and hearings with stakeholders, and survey/ocular
inspection of the zone / area of tricycle operations with special focus on:
 rationalizing the authorized routes of tricycle, and pedicabs to ensure that they are
banned from national highways;
 identification of national roads within the area of Jurisdiction of the LGU;
 determination of the portions of the national highway presently used or proposed to be
traversed by tricycles only if there are no alternative routes available;
2. Draft or update the Tricycle Route Plan (TRP) within 30 days from the issuance of
DILG MC 2020-036 which shall be the basis of a subsequent local ordinance;

SECTION 4. This Executive Order shall take effect immediately.
