BAIL BOND
Whereas a an information has been filed on the 15th day of August,
2019 in the above-mentioned Court, charging the above-mentioned accused with the offense of Simple Theft and he has been admitted to bail in the sum of Forty Thousand Pesos (Php 40,000).
NOW, THEREFORE, LORNA JANE CONSUELO B. EMBUDO hereby
undertake that the above-mentioned accused will appear and answer the charge above-mentioned in whatever Court it may be tried, and will at all times hold herself amenable to the orders and processes of the Court, and if convicted, will appear for judgment, and render herself to the execution thereof; or that if she fails to perform any of these conditions she will pay to the Republic of the Philippines the sum of Forty Thousand Pesos (Php 40,000), for the payment whereof I encumber and constitute a first lien in favor of the said Republic of the Philippines upon the real estate respectively owned by me and hereinafter described, to wit:
A parcel of agricultural land consisting of fruit bearing trees situated
at Barrio of Mulig, City of Davao, Island of Mindanao, Philippines, bounded on the N., along line 5-1 by Lot 4, Cad. 174; on the E., along line 1-2 by Lot 9; on the S., along line 2-3 by Lot 7; on the W., along line 3-4 by lot 3; along line 4-5 by lot 6, all of the cons.-subd. Plan. Beginning at a point marked “1” on plan being N. 62 deg. 44 ‘W., 1080.83 m. from MBM No. 8, Cad. 174, of approximately TEN THOUSAND FIFTY SEVEN (10,057) square meters in area; to which I, have a clear and absolute title and which is at present free from encumbrance.
I further declare under oath that the property described have not heretofore been encumbered, mortgaged, or pledged as security for the provisional release of any accused person or the performance of any obligation of any kind.
I HEREBY FURTHER bind myself to give the Court at least ten days notice of any transfer or other disposition to be made of the property above described, in order that the Court may take such action as may be necessary to protect the interest of the Republic of the Philippine and for us to avoid liability under Article 316 of the Revised Penal Code.
