Maintaining a valid visa

Online (VEVO), a free web-based service available 24 hours a day, seven (7) days a week.

Polio vaccinations
On 5 May 2014, the World Health Organization (WHO) Director General declared the recent
international spread of wild type polio virus to be a Public Health Emergency of International
Concern under the International Health Regulations (IHR). Nine countries, listed below, have
been identified as having suffered recent outbreaks of polio.

If you are from one of the countries listed below, or have spent 28 days or longer in these
countries on or after 5 May 2014 we encourage you to have a polio vaccination prior to
departing for Australia. Having the vaccination will also assist in eradicating the spread of
polio.

To obtain maximum benefit in assisting with the eradication of the spread of polio, it is
advisable to have the vaccination at least 4 weeks prior to your travel.

Overseas workers – know your workplace rights


Pay rates and workplace conditions are set by Australian law. All people working in
Australia, including those from overseas, have rights and protections at work. These cannot be
taken away by contracts or agreements.

If you have questions about your pay and conditions while in Australia, you can contact the
Fair Work Ombudsman for free help.

What are my minimum rights and conditions at work?


Pay
Your minimum pay rate can come from an award, enterprise agreement or other registered
agreement, or the national minimum wage. Employees have to be paid the right pay rate for
all hours they work, including time spent:
● training
● in team meetings
● opening and closing the business
● doing a trial shift.

You have rights when you work in Australia


The Fair Work Ombudsman and the Department of Immigration and Border Protection work
together to help you understand your legal rights when working in Australia.

Your employer must comply with both Australian workplace laws and immigration laws.

If you are a primary sponsored person, your sponsor is required to meet a number of
sponsorship obligations under Migration legislation to ensure that you are provided with
appropriate terms and conditions of employment. These sponsorship obligations include but
are not limited to your sponsor ensuring that:
● the terms and conditions of your employment are equal to the terms and conditions an
Australian employee receives who performs equivalent work at your workplace
● you only work in your approved occupation and only as an employee of the sponsor or
an associated entity of the sponsor
● your sponsor pays your or your family member’s reasonable and necessary travel costs,
if the costs have not already been paid and have been requested in writing by:
✃ the department on your or your family member’s behalf;
✃ you (including on behalf of your family member); or
✃ your family member (including on behalf of you)
● your sponsor does not take or seek to take any action that would result in you paying for
costs relating to your recruitment, including migration agent costs, or costs associated
with your sponsor becoming an approved sponsor.

Payslips
Employers must issue payslips to you within one (1) working day of your pay day. It is best
practice for these to be written in plain and simple English.

Payslips need to include the following information:


● both your name and your employer’s name;
● your employer’s Australian Business Number (ABN)
● pay period
● date of payment
● gross and net pay
● if you are paid an hourly rate
✃ the ordinary hourly rate
✃ the number of hours worked at that rate
✃ the total dollar amount of pay at that rate
● any loadings, allowances, bonuses, incentive-based payments, penalty rates or other paid
entitlement that can be separated out of your normal hourly rate

● the pay rate that applied on the last day of employment


● any deductions from you pay, including
✃ the amount and details of each deductions
✃ the name or name and number of the fund/account the deduction was paid into
● any superannuation contributions paid on your behalf including:
✃ the amount of contributions made during the pay period
✃ the name and/or number of the superannuation fund your contributions were made to

At the end of each financial year, employers have to give you a summary of their income
for the past year. This is called a “Pay As You Go (PAYG) payment summary” or a “Group
Certificate”.

National minimum wage


Certain employees may have different pay entitlements depending on whether they have a
reduced work capacity because of disability, if they are under the age of 21 or if they are an
apprentice or trainee. You can calculate your correct pay and entitlements using the Pay and
Conditions Tool at: www.fairwork.gov.au/pay

Employees that are employed on a casual basis will also receive a “casual loading” on top of
their hourly rate in lieu of any annual or sick leave entitlements.

The national minimum wage is reviewed every year and may change.

What is not okay at work?


Every employee has protections at work:
● you should not be bullied or harassed
● you should not be discriminated against
● it is okay to ask your boss, the Fair Work Ombudsman or someone else about your pay
and conditions.

No. Your employer cannot treat you differently, terminate you or take away your entitlements
for talking to the Fair Work Ombudsman.

Can my employer cancel my visa?


No. Employers cannot cancel visas. Only the Department of Immigration and Border
Protection can grant, refuse or cancel visas.

Health insurance
Your visa has been granted with condition 8501 which means that you must maintain fully
comprehensive health insurance while you are in Australia.

You may be requested to provide evidence of health insurance at the time of entry to
Australia, or when applying for another visa.

Employment contract disclaimer


If you provided an employment contract with your application, then the department only
considers this employment contract in relation to determining whether the obligation
to ensure equivalent terms and conditions of employment in regulation 2.79 of the
Migration Regulations 1994 is satisfied. The department makes no comment on whether the
employment contract complies with the relevant laws relating to workplace relations. It is the
employer’s responsibility to ensure they comply with such laws.

About your visa


This visa allows you to change employers as long as they are approved as a standard business
