This Contract of Lease between:

KIT VILLASIS, of legal age, Filipino, married and with business address at
No. 1 Florentino St., Quezon City, hereafter called the LESSOR; and

ELMER RABUYA, likewise, of legal age, Filipino, married and with postal
address at No. 2 Quezon Ave., Quezon City, hereafter called the LESSEE,

WHEREAS, the LESSOR is the registered owner of a warehouse located in


Quezon City;

WHEREAS, the LESSEE has offered to lease said property and the LESSOR
has agreed to the former’s offer;

NOW, THEREFORE, the parties agree as follows:

1. Subject. The property subject of this contract is that warehouse


built on a lot covered by TCT No. T-123456 of the Registry of Deeds of Quezon
City, which property is located at No. 3 Cordillera St., Quezon City;

2. Period of Lease. The period of this lease shall be one (1) year to
commence on 1 December 2018 and to end midnight of 1 December 2019;

3. Rental. The monthly rental shall be P25,000.00 to be paid within


the first week of each month.

4. Obligations. It shall be the obligation of the LESSOR to deliver


subject property in a tenantable state and to maintain such state during the
period of this contract. It is, likewise, the obligation of the LESSEE not to impair
the leased property;

5. Eviction. Unless mutually extended by the parties, the expiration


of the period herein stipulated shall entitle the LESSOR to repossess the leased
premises from the LESSEE without any need for judicial demand.

I, GRETCHEN FULI, of legal age, Filipino, single and a resident of No. 1


Florentino St., Quezon City, under oath, state that this Judicial Affidavit was
taken under pain of perjury at the office of Atty. Miko Alivia at No. 2 Quezon
Ave., Quezon City, on 12 September 2018.

OFFER OF TESTIMONY

This Judicial Affidavit is offered to serve as my direct testimony to


support the information for sexual harassment against the accused, specifically
to prove that:

1. The accused had moral ascendancy, influence or authority over


me;
2. He demanded, requested or required sexual favour from me;
3. I rejected his unwelcome sexual attention on me; and
4. My rejection has made my work environment hostile, offensive
and intimidating.

DIRECT TESTIMONY

The following numbered questions were propounded to me by Atty.


Miko Alivia and I answered them truthfully as follows:

1. Q: Do you swear to tell the truth and nothing but the truth?
A: I do.

2. Q: Please identify yourself and give your personal circumstances.


A: I am Gretchen Fuli. I am of legal age, Filipino, single and a
resident of No. 1 Florentino St., Quezon City.

3. Q: What prompts you to testify?


A: I have been sexually harassed.

4. Q: Could you detail the circumstances of your experience?


A: I have been a TV host of ABS-CBN since 2012. As such, I hosted
programs like VeeTee Patrol. I was then under the supervision
of Salvador Plurido.

5. Q: The accused in this case is Salvador Plurido. Are the two


connected in any way?
A: Yes, sir. My supervisor is the same Salvador Plurido who is the
accused in this case which I initiated with my complaint for sexual
harassment.

6. Q: Why did you file that complaint ?


A: It was August 1, 2018. While I was preparing for my segment,
Salvador Plurido summoned me into his office. On entering his
office, I immediately noticed photographs of Angel Aquino and
Tony Labrusca on his desk.

7. Q: What was your reaction?


A: I ignored those pictures. Instead, I asked him why he had called
for me. He explained that he needed to hear my view on the
French kissing between Angel Aquino and Tony Labrusca.

8. Q: What exactly did he want to hear from you, if you recall?


A: He asked if I also bring out my tongue when I kiss.

9. Q: How did you handle that?


A: I told him I was a Christian and my Muslim friends taught me
never to kiss that way.

10. Q: On hearing that, how did he react?


A: He was staring at my lips like a drooling Askal. He said he could
help me anchor Halalan 2019. Fortunately, his secretary entered
the room.

11. Q: In what sense was that event fortunate?


A: She remarked “ Hala Sir, bukas and zipper nyo. “ With that, he
turned red and excused me. I then hurriedly left his office.
12. Q: From the moment you entered that room to the time you left it,
how did you feel?
A: I felt uncomfortable and disrespected. I cannot forget how he
wet his lips with his tongue while staring at me.

13. Q: I presume you encountered him at ABS-CBN again. Did you?


A: Yes, but I avoided being alone with him as best as I could. I also
declined his invitation to watch Blue Eagles v. Green Archers with
him.

14. Q: How did he take your behaviour?


A: Not good. He sent me hateful messages.

15. Q: Can you cite an example or two?


A: It was my birthday and I got this message from his mobile
number: “You will regret having treated me this way. You may
be beautiful but you will age like Mommy Dionisia. By the way,
your left boob is heavier than your right boob. You’re imperfect,
woman! Happy Boobsday!!!” When I returned to my cubicle, I
saw a wreath on my desk with a card that read “At ABS-CBN, I am
forever. You are not.”

16. Q: What was his mobile number?


A: 09173177841, prepaid.

17. Q: How did his messages affect you, if at all?


A: I felt that my work environment became hostile and intimidating.
I was then forced to apply for a leave of absence.

18. Q: Where did those events lead to?


A: I filed a complaint for sexual harassment against him, sir.

19. Q: Do you wish to state more?


A: Not at this point, sir.

COMPLAINT

PLAINTIFF, unto the Honorable Court, avers:

PARTIES

Palintiff is of legal age, Filipino, single and a resident No 1 Florentino St.,


Quezon City. Defendant is of legal age, single, and a resident of No. 2 Airport
Road, Paranaque City, where he may be served summons.

CAUSE OF ACTION

1. Under a 1-year Lease Contract (Annex “A” hereof), plaintiff leased


to the defendant a vacant lot at No. 45 Banawe St., Quezon City. Said contract
expired on 12 December 2017;

2. Despite non-renewal of parties’ contract and repeated demand


to vacate, defendant has refused to surrender possession of the leased property;
and

3. The last demand to vacate, which defendant still ignored, was


served by registered mail on 2 March 2018, or four (4) months prior to the filing
of this complaint.

PRAYER

WHEREFORE, after notice and hearing, plaintiff prays that the Honorable
Court order the defendant and all persons claiming any right under him to
vacate subject property.
