Q1. For the record, please tell the court, your name, citizenship and current address?

Ans. My name is Shivani Malhotra. At present I am a citizen of United Kingdom and currently
situated in London.

Q2. What is your education background?

Ans. I have done MBA course from London.

Q3. Do you work somewhere?

Ans. Yes, I work in a company in London.

Q4. Do you know Raj Malhotra?

Ans. Yes. He supposed to be my husband till the date we were granted a decree of divorce i.e.
January 10, 2017.

Q5. Since how long you know Mr. Raj Malhotra?

Ans. I know him since my college days when we both were doing MBA from London.

Q6. How was your married life?

Ans. It was not good. I was not happy.

Q7. What were the reasons for your unhappiness from your married life?

Ans. We were not a compatible couple with each other from the very beginning of our married life.

Q8. Do you have any children from your wedlock?

Ans. Yes we have two children, one Rohan 8 Years old and another Muskaan 6 Years old.

Q9. Who is having the custody of the children as of now?

Ans. As per the orders of London court I am entitled to the custody of children and Raj has been
allowed to take them in his taking during weekend. But right now Raj has taken them illegally in his
custody.

Q10. When Raj did took the illegal custody of children?

Ans. When he took them in his custody on January 3, 2019 as per the ordinary routine mentioned in
the decree of divorce i.e. the weekend time and then he took them to India on a false pretext of his
father’s illness who lives in New Delhi.

Q11. Did you try to get the custody of children back to you?

Ans. Yes, when I got to know that Raj had taken the children and flown to India, I immediately
applied for an arrest warrant against him in the London court.

Q12. Was he arrested?

Ans. No.

Q13. Who is Ajay?


Ans. Ajay is a friend of mine.

Q14. Did you took your children to Ajay’s house?

Ans. Yes I took them.

Q15. For what purpose did you took them to his house?

Ans. I just wanted to visit his house because he is my friend and since my children are young that is
why I took them there.

Q16. Do Ajay and the children enjoy each other’s company?

Ans. Yes, Ajay is fond of children and he takes care of them.

Q16. So now for what purpose you are seeking relief from the court?

Ans. I want to get back the custody of my children which are in unlawful taking of Raj by withdrawal
of matter from court. If he does so I will cooperate with him for the withdrawal of arrest warrant
outstanding against Raj.
