    RESOLUTION NO. _____- 2019

    TERMINATING THE SERVICES OF MS. GRACE G. PEŃALES, DULY APPOINTED BARANGAY


    TREASURER, PURSUANT TO SECTION 395 OF REPUBLIC ACT NO. 7160, OTHERWISE KNOWN AS THE
    “LOCAL GOVERNMENT CODE OF 1991”

    WHEREAS, Section 395 (a) of Republic Act No. 7160, otherwise known as the “Local Government Code” provides
    that, “The barangay treasurer shall be appointed by the punong barangay with the concurrence of the majority of
    all the sangguniang barangay members. The appointment of the barangay treasurer shall not be subject to
    attestation by the Civil Service Commission”;

    WHEREAS, Section 389 of RA 7160 explicitly vests on the Punong Barangay upon approval by a majority of all
    members of the Sangguniang Barangay, the power to appoint or replace the Barangay Treasurer,
    Barangay Secretary and other Barangay officials.

    WHEREAS, Ms. Grace G. Penales was the duly appointed Barnagy Treasurer of Brgy. Cawayan Exterior;

    WHEREAS, Ms. Penales left the office for unknown reasons resulting to Absence without Leave (AWOL);

    WHEREAS, on April 9, 2019 the Punong Barangay issued a “Return to Duty” memorandum but to no avail;

    WHEREAS, in the exigency of public service, the Council deemed it proper and logical to seek for the immediate
    replacement of the said Barangay Treasurer.

    RESOLVED, as it is hereby resolved, to authorize Honorable Rowena R. Tuason, City Mayor for and in behalf of the
    City Government of Masbate to enter into a Memorandum of Agreement with the Department of Public
    Works and Highways, 2nd Engineering District for the implementation of the project “Concreting of
    Access Road to Bayombon High School” under the Local Infrastructure Program funded under Fiscal
    Year 2017;

    RESOLVED FINALLY, to furnish copy of this resolution to the DPWH, 2 nd Engineering District, Masbate Provincial
    Office, Office of the City Mayor and all concerned for their information and appropriate action.
