HAULING CONTRACT
ENGAGEMENT OF SERVICES AGREEMENT
KNOW ALL MEN THESE PRESENTS:
This Engagement of Services Agreement is made and entered into this 14th day of October 2019,
in WIZZIA HAULING TRUCKING AND SERVICES, Philippines, by between
SDR GENERAL BUILDERS duly organized, registered and existing under Philippine laws, with
offices #309 National highway Tayuman Binangonan Rizal and represented by its REPRESENTATIVES KARLEEN
CHARLA B. AUSTRIA and business partner JEROME E. FANGO with residential Address #22 Metro Clark Homes
Subdivision Mabalacat Pampanga herein reffered to as the SERVICES CONTRACTOR “FIRST PARTY”
-And-
with office and is represented in this instrument by its General Manager, Filipino, both of legal age, is
hereinafter referred to as the
WIZZIA HAULING TRUCKING AND SERVICES, with offices located in Brgy. Inhobol Masinloc, Zambales. Filipino,
of legal age, hereinafter referred to as the “SECOND PARTY”.
W I T N E S S E TH:
WHEREAS; FIRST PARTY has an existing JOB ORDER, specifically for hauling of lahar within the area of Zambales;
WHEREAS, the SECOND PARTY has expressed the intensions to join the FIRST PARTY in his/her capacity as
Dump Truck and Heavy Equipment Owner/Representative.
NOW THEREFORE, in consideration of the foregoing premises and of the conditions.
SECTION 1. GENERAL TERMS AND CONDITION

2. Truck Rate P300,000.00 per month divided
3. Trips 10
4. Operations 24hrs
5. Quarry Site San Marcelino, Zambales
6. Dump Site Cawag Subic, Zambales
7. Distance 23klms
8. Truck Qualification 12 Wheeler
9. Source Lahar Sand
10. Diesel FREE shouldered by FIRST PARTY
11. Driver FREE shouldered by FIRST PARTY (P300/TRIP)
12. Helper FREE shouldered by FIRST PARTY (P15,000./month)
13. Food Allowance Shoulder by FIRST PARTY: Driver P250.00 a day
Helper P200 a day
14. Barracks FREE
15. Parking FREE
16. Requirements
 Copy of ORCR of Truck
 Copy of Driver’s Licence
 Plate Number of Truck
ITEMS THAT ARE BE PROVIDED BY THE CONTRACTOR:
 Diesel Fuel can provide the CONTRACTOR and will be Free.
 Minor periodic maintenance such as change oil, calibration or the like during the
rental period to keep the units in good usable conditions shall not be the
responsibility of the trucker;
 Cost of Toll Fees/Pass way, Stickers and offer road assessments and clearances
shall be for the account of the Contractor.
GENERAL PROVISIONS
SCOPE OF WORK
 The services agreed upon are the supply by the SECOND PARTY to the FIRST PARTY of the A1-condition
dump trucks for the conduct of loading and hauling services;
 All drivers and Helpers of the TRUCKER/HAULER is required to undergo orientation seminar to be
conducted by the CONTRACTOR.
 TRUCKER/HAULER has manifested that upon execution of this Agreement, it is ready to submit
completed documentary requirements such as the following ---
 Clear Photocopies of the Truck, showing the Plate Number;
 Clear Photocopies of the Official Receipt and Certificate of Registration;
 Clear Photocopies of Driver’s License assigned to the respective Truck;

 Hauling from Quarry to dump site is weather dependent, and all activities within the camp shall be
governed by the rules and regulations of the Site Management and Site Operator, hence every
personnel are enjoined to strictly observed such policies and procedures imposed thereto;
 Each Truck unit is expected to maximize hauling operation making at least a minimum of 10 trips per
day.
 Dump Truck Units of the TRUCKER/HAULER shall be put into operations after appropriate safety and
performance inspection has been completed. In the event of operational stoppage due to high risk
and other contributing factors beyond control, force majeure is affecting the trips, interest of both
parties are to be protected;
 Both parties hereby mutually agrees to cooperate in good faith like business partners to effect and
execute this agreement and shall continue to be in full force and effect unless earlier revoked or
terminated for cause provided that all pending payables due the TRUCKER/HAULER has been full
settled first before effectively of said termination;
 In cases where government has interfered and imposed suspension of permits that has led to
stoppage hauling, both parties agrees to terminate the contract willingly after all pending payables
have been settled;
CONTRACT VALIDITY. This agreement shall be for (6) months, renewable to (1) year

BREACH OF CONTRACT. Both parties agreed that should any of them commit a breach of this
agreement, and that the aggrieved party has actually suffered on account of the breach an additional
compensation will be paid as a moral/compensatory damages.
The Party who fails to perform any term or condition of this agreement as a result of conditions
beyond its control such as, but not limited to war, strikes, fire, floods, acts of God, governable
restrictions, power failures or damage facilities or servers, shall not be deemed a breach of this
agreement.
NO JOINT VENTURE. Notwithstanding the terms used in this Agreement and any related
communication, the Parties herein agree that they are not entering into a legal partnership, joint
venture or other such business arrangement. Neither Part will refer to or treat the agreements under
this Agreement as a legal partnership or take any act inconsistent with such intention.
SUCCESSORS AND ASSIGNS. Except as otherwise provided herein, the provisions hereof shall inure
to the benefit of, and be binding upon, the successors and permitted assigns of the parties hereto.
No party hereto may assign its rights or delegate its obligations under this Agreement without the
prior written consent of the other parties hereto, which consent will not be unreasonably withheld,
