    AFFIDAVIT OF ADVERSE CLAIM

    I, ENGR. ALICE S. NITURA-REDUTA, of legal age, Filipino


    and a resident of 44-D, Suazo Street, Davao City, after having
    been duly sworn to in accordance with law, depose and state:

    1. That on March 25, 2009, I have entered into an


    agreement of conditional sale between Elvirisa G. Tongco,
    Artemio S. Gutierrez, Praxedes S. Gutierrez, Ronald
    Gutierrez and Rosario G. Bangot who are the registered
    owners of a parcel of land covered by TCT No. 142-
    2017008706 situated in Island, Davao del Norte;

    2. And as per our agreement, I will buy their property in the


    amount of Php 800,000.00 pesos on installment basis and
    will pay them in full after the said title will be transferred
    to their names. Accordingly, I also helped them process
    the said transferring of the title to their names;

    3. However, when the title came out, they no longer wanted


    to continue with the said agreement. As evidence of the
    said agreement, a letter dated December 1, 2017 given
    by the above persons stating that they no longer
    interested to continue with the sale of their property.
    Again, a letter through their lawyer, Atty. Alro S.
    Paglinawan dated December 4, 2017 stating that the
    above persons are willing to refund the payment I made
    to them in the amount of Three Hundred Forty Four
    Thousand Pesos. Attached herewith as ANNEX A and
    ANNEX B copies of the said letters respectively;

    4. That in the said agreement of conditional sale, the above


    persons already made advances as part of the payment
    for the said sale of their property. Attached herewith are
    copies of the summary of payments made by the above
    persons as ANNEX C;

    5. And because the Vendors did not anymore want to


    continue with the said agreement, and since the said
    agreement of conditional sale per se could not be
    annotated on the Title with the Office of the Register of
    Deeds and unless an adverse claim is annotated on the
    aforesaid TCT No. 142-2017008706, my legal right over
    the said property is in danger of being defrauded and
    deprived of my just and valid right over the said property,
    as such, I am executing this Affidavit in support of my
    request for the annotation of an adverse claim over the
    parcel of land described therein.

    FURTHER, AFFIANT SAYETH NAUGHT.
