FACTS OF THE CASE:

On or about 1:30 A.M of September 14. 2019 vehicular accident that transpired along
Lanang, Davao City wherein involved vehicle were a motorcycle (XRM 125, Plate number
1101-115245), driven by Kyle L. Alejan, 25 years old, married, resident of R. Castillo, Davao
City. Vehicle two (Honda Civic, Plate number LMX 9596, private) driven by John K. Richard,
26 years old, resident of Lanang, Davao City.

Initial investigation conducted by the responding Police Officers Police Master


Seargent Francis Virgil J. Morales, Patrolman Matsalam S. Grad and Police Corporal Luisito
Dimagiba N. Baguio disclosed that V-1 and V-2 were traversing on the opposite direction
heading to Lanang, Davao City near the gas station. V-2 swerved near the gas station and V-
2 accidentally bumped/hit the V-1 head on. V-1 rested at the outer side of the road measuring
more or less fifteen (15) meters at its final position as the consequence thereof the driver of V-
1 pinned his driven vehicle because of the strong impact of the collision thus sustaining
serious physical injury. The driver of V-1 Kyle L. Alejan was rushed to the hospital, while the
driver of V-2 John K. Richard was interviewed by the Police at the Police station. 2:00 of
September 14, 2019 was declared serious physical injury by the attending physician.

REMARKS/DISPOSITION
Thus going ahead has the last clear change to see other vehicle from window/
left fender. That the driver from behind sees a situation of danger exist or is immenent driver
is bound to up with reasonable caution to avoid another vehicle even it involve in actual
stopping of his driver vehicle which in the scene of incident no skid mark and tire mark found.
RECOMMENDATION

After careful perusal of circumstances surrounding this particular incident, prima


facie exist that the driver of Toyota Innova displayed lack of foresight,precaution indeed not
exercise the proper degree of care while there to cercumbent the impending collison that
resulted to the damaged to property and immediate/ serious physical injury/ victim.
Wherefore in view of the foregoing this office hereby recommend that a case for
serious physical injury and to damage to property and be file against the driver of V-1 Kyle
Wroxer, 29 y/o, married, driver, of number block 25 lot 8 brgy, Trading boulevard Davao City.
