    APPLICATION FOR PROBATION

    COMES NOW the accused, assisted by his undersigned counsel, to this


    Honorable Court, most respectfully alleges:

    1. That he was convicted by this Honorable Court of Unjust Vexation


    defined and penalized under Article 287 (2) of the Revised Penal Code and was
    sentenced to suffer imprisonment for 20 days and pay a fine of Php 10,000.00
    and to pay moral damages in the amount of Php 20,000.00 to the private
    complainant;

    2. That he has not been convicted of any offense prior to the instant case
    and that he is not disqualified under Sec. 9 of PD No. 968;

    3. That he received the decision in open court and thru counsel on August
    08, 2018;

    4. That he wishes to avail himself of the benefits granted by Presidential


    Decree No. 968, otherwise known as “The Probation Law of 1976,” as amended;

    5. That the accused is not among those disqualified offender as enumerated


    in Section 9 of PD 968, as amended by Presidential Decree No. 1990; and

    6. That the accused undertakes to comply with such terms and conditions as
    this Honorable Court may impose if his petition for probation will be granted.
    WHEREFORE, in view of the foregoing, it is most respectfully prayed that
    this Honorable Court suspends the execution of his sentence and that the accused
    be placed on probation.

    Other reliefs just and equitable under the premises are likewise prayed for.
