Summary of Section X
Sec. 10. Where to Apply for a Protection Order. – Applications for BPOs shall follow
the rules on venue under Sec. 409 of the Local Government Code of 1991 and its
implementing rules and regulations. An application for a TPO or PPO may be filed
in the regional trial court, metropolitan trial court, municipal trial court, municipal
circuit trial court with territorial jurisdiction over the place of residence of the
petitioner: Provided, however, That if a family court exists in the place of residence
of the petitioner, the application shall be filed with that court.
Reaction
In my own opinion the law does not discriminate the rights of both women
and their children, for the law have no favoritism of either how rich or how
poor are being violated or the victims that are being violated. Regarding to
the law, the law specifies the violence and strongly establishes the house of
equality, rights, freedom, and to be peacefully joyful at nation. Moreover, I
optimistically believe that this law is very sensitive and can protect people
that are abused and of VAWC can capture the exact justice of the victim,
being very sensitive about this law the R.A. 9262 helps also to protect the
victims that mostly are minors, it is described in the law of where could the
abandoned child or victim can be kept or where can be sustained without the
Mother (Sec. 3) temporarily or should I say in DSWD.
The Section X of R.A. No. 9262 or the Anti Violence Against Women and
their Children is stating where to be guided to apply for a Protection Order,
the Section X of R.A. 9262 generally states the guide to have a protection
order or where to have a Protection Order in with regards by the law and of
the Section 409 of the Local Government Code of 1991 petitioning the
protection order.
For R.A. 9262 thus defining the law to protect the children and women
against those abusers, the VAWC (or the Violence Against Women and their
Children) is protecting both rights of the women and children and protecting
the dignity of women that are abused. Some says that the Government or
Politics is defined by it’s laws and of this matter the R.A. 9262 is a strong
morale and upholds equality and rights of women that are abused and
children that are abused.
In conclusion, that the Republic Act No. 9262 of 2004 Section X (10) is that
the application for a protection order is implementing the regulations of the
Local Government Code of 1991 under Section 409 to the applications for
BPO and must follow the said rules on venue. That the venue for petitioning
for a protection order must be done or filed for TPO or PPO in the said courts
as provided but if a petitioner's residency has a family court that exist in the
place of the petitioner’s residency, then it shall be filed with that court.
