Employment Contract

This AGREEMENT is entered into this ____ of _________ in the year of ____, at the City

(Employee) and GEMARIE BUILDERS (employer). This document constitutes an employment
agreement between these two parties WHEREAS the Employer desires to retain the services of the
Employee, and the Employee desires to render such services these terms and conditions are set
forth.
IN CONSIDERATION of this mutual understanding, the parties agree the following terms and
conditions”
1. PERIOD AND PROBATIONARY EMPLOYMENT
The probationary period of the PROBITIONARY EMPLOYEE shall be for a period not longer
than Three (3) months starting from the first day of the PROBATIONARY EMPLOYEE.
2. EMPLOYMENT
The employer agrees that he or she will faithfully and to the best of his/her ability carry out
duties and responsibilities communicated to them by the Employer. The employee shall
comply with all the company policies, rules and procedures at all time.
3. DUTIES AND RESPONSIBILITIES
As a ____________________ it is the duty of Employee to perform all essential job, duties
and responsibilities from time to time, the Employer may also add other duties within the
reasonable scope of the Employee’s work.
4. EVALUATION
The PROBITIONARY EMPLOYEE acknowledges and understands that regularization of
employment with the EMPLOYER is conditioned on satisfactorily meeting the standards set
forth as follows:
The Standards upon which the EMPLOYEE will be evaluated on has likewise been explained
to the EMPLOYEE by the EMPLOYER at the time of engagement.
The PROBATIONARY EMPLOYEE shall be evaluated by the ______________________ of the
Company.
5. REGULARIZATION
By or before the end of three (3) month period, the PROBATIONARY EMPLOYEE shall acquire
regular status upon evaluation and recommendation of the HR-Head of the company.
Upon regularization, the PROBATIONARY EMPLOYEE shall be entitled to all company benefits
and privileges enjoyed by all regular employees of similar rank and tenure.
6. COMPENSATION
The PROBITIONARY EMPLOYEE shall be paid a gross amount of ______ (P_______) per day,
subject to government-mandated deduction to be borne every last day of the month.
The EMPLOYER may, at its discretion, grant bonuses, allowances, or benefits not defined in
this contract. Such exercise discretion shall not be considered as established practice or
precedent and shall not demandable under Employment Agreement or any written and
unwritten agreement.
7. THIRTEEN MONTH PAY
The EMPLOYER will pay the mandatory Thirteenth (13th) month pay before 24 December of
each Calendar Year.
8. MANDATORY BENEFITS
Benefits are mandated by the law or the following document which has been provided to
the PROBATIONARY EMPLOYEE at the signing of this AGREEMENT: ________ shall be paid or
provided by the EMPLOYER only when mandated and applicable to the PROBATIONARY
EMPLOYEE, according to the law or the above- mentioned document, such as but not limited
to the following:
a. Holiday pay
b. Premium Pay
c. Overtime Pay
d. Night Shift Differential
e. Maternity leave/ Paternity Leave
f. Service Incentive leave/Sick leave
9. LEAVE
The EMPLOYEE is entitled to five (5) VACATION LEAVE and five (5) SICK LEAVE/ five after
probation period and five (5) SERVICE INCENTIVE LEAVE provided he/she has rendered
service for at least one year.
If the stated leaves above are not used at the end of the year, the employee may convert it
into cash basis.
10. WORK HOURS
The PROBATIONARY EMPLOYEE shall work in the following schedule:

The Work schedule may be changed by the EMPLOYER or its Management as it may deem
necessary to meet its operational requirements.

11. PLACE OF WORK


The Primary Place of work of the PROBATIONARY EMPLOYEE shall be in

The PROBATIOANRY EMPLOYEE may be transferred or assigned to other locations as may be
required by the needs of the EMPLOYER
The PROBATIONARY EMPLOYEE may be required to travel from time to time.
12. COMPANY RULES AND REGULATIONS
The PROBATIONARY EMPLOYEE shall follow all company rules and regulations, written and
otherwise. All existing and future company rules and regulations shall be deemed
incorporated in this AGREEMENT.
It shall be the duty and responsibility of the PROBATIONARY EMPLOYEE to be aware of and
comply with the EMPLOYER’s Rules and Regulations.
The PROBATIONARY EMPLOYEE has been provided with a copy of the following document
which includes rules and regulations of the EMPLOYER at the signing of this AGREEMENT:
The EMPLOYER undertakes to provide an updated version of said document every time it is
updated.
13. TERMINATION OF PROBITIONARY EMPLOYMENT
The EMPLOYER may terminate the probationary employment prior to the expiration of the
probationary period upon failure of the PROBATIONARY EMPLOYEE to satisfactory to meet
the standards provided in this AGREEMENT or for any of the just or authorized causes
provided by law, including analogous causes specified in the company rules and regulations
or policy.
14. RESIGNATION OF PROBITIONARY EMPLOYMENT
The PROBATIONARY EMPLOYEE shall give a written notice of their intention to resign from
their employment at least thirty (30) days prior to the effective date of their resignation.
15. NON-DISCLOSURE
The probationary employee shall not divulge to any third party any parts of this
AGREEMENT, including salaries and other remunerations unless legally required by the law,
statute, or any competent authority.
16. CONFIDENTIALITY
The PROBATIONARY EMPLOYEE understands and acknowledges that all records, documents,
and other information, written or otherwise, are confidential and shall not be disclosed
during and after employment with the EMPLOYER.
17. ENTIRETY OF AGREEMENT
This agreement represents the entire agreement between the EMPLOYER and the
PROBATIONARY EMPLOYEE and supersedes all prior negotiations, agreement, either oral or
written.
IN WITNESS THEROF, the parties have hereunto affixed their signatures on the date and
place first stated above.
