EXECUTIVE ORDER NO. 03

RECONSTITUTING THE BARANGAY COUNCIL FOR THE PROTECTION OF CHILDREN (BCPC)
WHEREAS, Section 17 of Republic Act 7160, also known as the Local Government Code,
mandates that the barangays shall endeavor to provide for an effective and efficient provision of
basic services and facilities which includes programs and projects for children and youth welfare;
WHEREAS, Republic Act No. 7160, otherwise known as the Special Protection of Children
Against Child Abuse, Exploitation and Discrimination Act, provides for stronger deterrence and
special protection against child abuse, exploitation and discrimination and its corresponding
penalties;
WHEREAS, Articles 359 and 360 of the Civil Code of the Philippines provides that “the
government shall establish Councils for the Protection of Children”;
WHEREAS, Article 87 of Presidential Decree (PD) 603 (Children and Youth Welfare Code) states
that “every barangay council shall encourage the organization of a Local Council for the Protection
of Children (LCPC) and shall coordinate with the Council for the Welfare of Children (CWC) in
drawing and implementing plans for the promotion of Child and Youth Welfare.” There is therefore
a need to organize LCPC not only in barangays but also in all other local government units (LGUs),
to ensure synchronization and integration of policies, programs and projects for children;
WHEREAS, Section 15 of Republic Act 9344, also known as the Juvenile Justice and Welfare
Act of 2006, mandates the LGUs to establish Local Council for the Protection of Children and
allocate one percent (1%) of their Internal Revenue Allotment for strengthening and implementation
of programs and projects of said council;
WHEREAS, DILG Memorandum Circular 2002-121 dated August 5,2002 enjoins all Local Chief
Executives to organize/re-organize their respective Local Council for the Protection of Children;
NOW, THEREFORE, I, CIRILO S. TAPALES, Punong Barangay of Barangay Basdiot, Cebu, by

virtue of the powers vested in me by the Local Government Code of 1991and other existing laws,
do hereby order:
Section 1: Reorganization of Barangay Council for the Protection of Children (BCPC), The Barangay
Council for the Protection of Children of Barangay Basdiot, Moalboal, Cebu, is hereby re-organized.
Section 2: Composition. The BCPC, otherwise referred to as the council, shall be composed of the
following:
Chairperson : CIRILO S. TAPALES - Punong Barangay
Vice-Chairperson : BERNARDITA TABABA - Brgy. Kagawad, Chair. Women & Family
Members : MARCELINA MUÑOZ - Barangay Nutrition Scholar
: JESSA MAE APOSTADERO - Daycare Worker

: NICASIO ABENIDO - Chief, Barangay Tanod
: JUVY GARES - Rural Health Midwife
: JOHNY HERNANDEZ - Rural Health Nurse
: JAYSON SABANAL - Sangguniang Kabataan Chairman

Section 3. Functions and Responsibilities

 Foster education of every child;
 Take steps to prevent juvenile delinquency and assist parents of children with behavioral
problems;
 Adopt measures for the health of children;
 Conduct capability-building projects to increase knowledge and skill in handling children’s
programs;
 Encourage the proper performance of the duties and responsibilities of parents, and provide
learning opportunities on the adequate rearing of children and positive parent-child
relationship;
 Promote wholesome entertainment in the community, especially in movie houses;
 Prepare Annual Work and Financial Plan (AWFP) for children and recommend appropriations
to the sanggunian;
 Provide coordinative linkages with other agencies and institutions in planning, monitoring and
evaluation of plans for children;
 Establish and maintain a database on children in the barangay;
 Advocate for the passage of barangay resolutions/ordinances responsive to child-related
issues and concerns and ensure the inclusion of children’s program in the executive
agenda
Section 4. Secretariat. The Secretariat shall be responsible for providing technical support,
documentation of proceedings, preparations of reports, and such other assistance as may be
required in the discharge of its functions. The Secretariat shall be composed of the following:

Section 5. Funding. Upon recommendation of the LCPC, funding shall be provided for
programs/projects/activities on children and ensure that these are implemented.
Section 6. Monitoring and Evaluation. Regular monitoring shall be conducted to determine the
functionality of the CCPC and the Barangay Councils for the Protection of Children and find out
their accomplishment, including implementation problems and issues.
Section 7. Effectivity
This Executive Order shall take effect immediately.
