Stages of the procurement process:

1. Preparation of the Annual Procurement Plan by the end-users (USER/OWNER)

2. Preparation of Bidding Documents by the BAC Secretariat

3. Pre-procurement conference – usually not required for the procurement of goods costing PhP2M
and below; and infrastructure projects costing PhP5M and below. (BAC PERSONNEL/END-
USER/HIRED CONSULTANT)

-Source of Funding

-Approved Budget for the Contract (ABC)

-Invitation to bid draft

-The contract duration or delivery schedule;

- The name, address, telephone number, facsimile number, e-mail and website addresses of the
concerned procuring entity, as well as its designated contact person

4. Pre-bid conference – are conducted with an approved budget of PhP1M or more. For contract to
be bid with an approved budget of less than PhP1M, pre-bid conferences shall be at the discretion of
the BAC. (CONTRACTORS ARE INVITED FOR CLARIFICATION

-For 1M+ project, or upon


written request of any prospective bidder

-discuss the eligibility requirements and the technical and financial components of the contract to be
bid. Attendance of the bidders shall not be mandatory. However, at the option of the Procuring
Entity, only those who have purchased the Bidding Documents shall be allowed to participate in the
pre-bid conference and raise or submit written queries or clarifications.

-The minutes of the pre-bid conference shall be recorded and made available to all participants not
later than three (3) calendar days after the pre-bid conference. Any statement made at the pre-bid
conference shall not modify the terms of the Bidding Documents, unless such statement is
specifically identified in writing as an amendment thereto and issued as a Supplemental/Bid Bulletin

-Supplemental/Bid Bulletins

22.5.1. Requests for clarification(s) on any part of the Bidding Documents or for an interpretation
must be in writing and submitted to the BAC of the procuring entity concerned at least ten (10)
calendar days before the deadline set for the submission and receipt of bids. The BAC shall respond
to the said request by issuing a Supplemental/Bid Bulletin, duly signed by the BAC chairman, to be
made available to all those who have properly secured the Bidding Documents, at least seven (7)
calendar days before the deadline for the submission and receipt of bids.(a)

22.5.2. Supplemental/Bid Bulletins may be issued upon the procuring entity’s initiative for purposes
of clarifying or modifying any provision of the Bidding Documents at least seven (7) calendar days
before the deadline for the submission and receipt of bids. Any modification to the Bidding
Documents shall be identified as an amendment

-For purposes of determining the eligibility of bidders using the criteria stated in Section 23.5 of this
IRR, only the following documents shall be required by the BAC, using the forms prescribed in the
Bidding Documents:

a) Class “A” Documents

Legal Documents

i) Registration certificate from SEC, Department of Trade and Industry (DTI) for sole proprietorship,
or CDA for cooperatives, or any proof of such registration as stated in the Bidding Documents.

ii) Mayor’s permit issued by the city or municipality where the principal place of business of the
prospective bidder is located.

iii) Tax clearance per Executive Order 398, Series of 2005, as finally reviewed and approved by the
BIR.

Technical Documents

v) In the case of procurement of infrastructure projects, a valid Philippine Contractors Accreditation


Board (PCAB) license and registration for the type and cost of the contract to be bid.

Financial Documents

vi) The prospective bidder’s audited financial statements, showing, among others, the prospective
bidder’s total and current assets and liabilities, stamped “received” by the BIR or its duly accredited
and authorized institutions, for the preceding calendar year which should not be earlier than two (2)
years from the date of bid submission.

vii) The prospective bidder’s computation for its Net Financial Contracting Capacity (NFCC).12

b) Class “B” Document

Valid joint venture agreement (JVA), in case the joint venture is already in existence. In the absence
of a JVA, duly notarized statements from all the potential joint venture partners stating that they will
enter into and abide by the provisions of the JVA in the instance that the bid is successful shall be
included in the bid. Failure to enter into a joint venture in the event of a contract award shall be
ground for the forfeiture of the bid security. Each partner of the joint venture shall submit the legal
eligibility documents. The submission of technical and financial eligibility documents by any of the
joint venture partners constitutes compliance.

5. Advertisement and Posting of the Invitation to Bid – to newspapers of general circulation shall not
be required for contracts to be bid with an approved budget of PhP2M and below for the
procurement of goods; and PhP5M and below for infrastructure projects.

6. Issuance of Bidding Documents upon submission of Letter of Intent (LOI) by interested bidders and
upon payment of non-refundable fee

-Submission and Receipt of Bids

-Bidders shall submit their bids through their duly authorized representative using the forms
specified in the Bidding Documents in two (2) separate sealed bid envelopes, and which shall be
submitted simultaneously. The first shall contain the technical component of the bid, including the
eligibility requirements under Section 23.1 of this IRR, and the second shall contain the financial
component of the bid

-For the procurement of infrastructure projects:

FIRST FOLDER

i) Eligibility requirements under Section 23.127 of this IRR;

ii) Bid security in the prescribed form, amount and validity period;

iii) Project Requirements, which shall include the following:

(1) Organizational chart for the contract to be bid;

(2) List of contractor’s personnel (viz, Project Manager, Project Engineers, Materials Engineers, and
Foremen), to be assigned to the contract to be bid, with their complete qualification and experience
data;

SECOND FOLDER

-The second envelope shall contain the financial information/documents as specified in the PBDs

7. Preliminary Evaluation of Bids

8. Post qualification of Bids to determine whether the bid submitted by the bidder with the Lowest
Calculated is responsive

9. Issuance of BAC Resolution Recommending the Award of the Contract with the bidder with the
Lowest Calculated and Responsive Bid (LCRB)

10. Issuance of Notice of Post-Qualification

11. Issuance of Notice of Award

12. Signing of Contract

13. Issuance of Notice to Proceed
