PETITIONERS, thru the undersigned counsel, to this Honorable Court
respectfully state:
1. That petitioners are spouses, of legal age, Filipinos with full civil capacity and legal rights and residents of San Jose Gusu, Zamboanga City;
Certified copy of the Marriage Contract of petitioners is hereto attached
as Annex “A”;
2. That petitioners desire to adopt the minor JACOB NAZARENE DE
CASTRO, eight (8) years of age, born on January 9, 2010, Filipino, without property and likewise residing at San Jose Gusu, Zamboanga City with the petitioners;
Duplicate copy of the Certificate of Foundling of the minor is hereto
attached as Annex“B” ;
3. That as shown by the Certificate of Foundling the child has no known
parents;
4. That since said minor was about three (3) years old when found, he has lived under the care and custody of petitioners who acted as his parents;
5. That petitioners are of good moral character, more than 16 years older than the child, have not been convicted of any crime involving moral turpitude, are emotionally and psychologically caring for children and are properties owner in addition to the fact that they have visible means of support, which are more than sufficient to enable said minor to live decently and with a promising future; 1 6. That petitioners have the legal requirements and do not suffer from any legal disqualifications as adopter; whereas said minor is not disqualified by law but is legally qualified to be adopted by petitioners;
7. That this adoption will serve the best interest and well-being of the child;
8. That all the other children of petitioners, who are all of age, namely, CARLO ALVAN D.R. URIAN, GIA ANGELICA D.R. URIAN and LOUANNA ERIKA D.R. URIAN have freely given their consent to the adoption of the minor as shown by their Affidavit of Undertaking and Consent hereto attached as ANNEX “C”;
9. That petitioner has undergone/shall undergo the pre-adoption services
as provided under Section 4 of R.A. No. 8552;
10 That the minor was matched to the petitioners during the local matching conference by the Child Welfare Specialist Group of the DSWD, as shown by the Certificate of Matching hereto attached as Annex “D”;
11. That the minor was declared available for adoption with control no. 2017-6383 issued on December 23, 2017by the DSWD Secretary per RA 9523; That the placement of the minor with the petitioners was approved by the DSWD on December 19, 2017 which has also issued its consent to this adoption as shown by the Pre-Adoption Placement Authority and Certificate of Consent to Adoption hereto attached as ANNEXES “E” and “F”;
12. That the Child Case Study (June 2, 2017) of the DSWD is hereto attached as Annex “G”;
13. That petitioner seeks under the herein petition for adoption, that the minor be known and registered in the Civil Registry as “JACOB NAZARENE DEL ROSARIO URIAN”.
WHEREFORE, petitioners respectfully pray that, after due notice,
publication and hearing, a judgment be rendered to the effect that thenceforth, the child JACOB NAZARENE DE CASTRO, to all legal intents and purposes, be decreed as the legitimate child of petitioners, and that he be known and registered in the Civil Registry as “JACOB NAZARENE DEL ROSARIO URIAN”, a legitimate child of petitioners.
Such other reliefs just and equitable.
