MEMORANDUM
1.On May 08, 2019 at about 10:00o’clock in the morning a fire incident
transpired at Tabogon, Brgy. Daantabogon, Tabogon, Cebu wherein victim
one Jesus Levy Dacera, 23 years old, single, criminology student, and a
resident of Brgy. Daantabogon, Tabogon, Cebu, was dead through setting of
fire maliciously by the suspect known as Alyas Peter, 32 years old, married,
bystander, and a resident of the same place. As a result thereof, the victim
sustained third degree burned and fatal injuries and was rushed to Chong
Hua Hospital for medical treatment but was pronounced dead on arrival
(DOA) by the attending physician thereat. The suspect was arrested at his
house during warrant of arrest conducted, and the things used in the
commission of the crime was recovered and he is now under the custody of
this station for investigation and proper disposition. The cadaver of thevictim
was moved to Regional Crime Laboratory Office, PNP-Cebu City for autopsy
examination.
2. The cause of fire and estimated cost of damages are still under
investigation.

OF OCCURENCE : The suspect Peter Samiaw Atil was last seen at Brgy. Maslog
OF SUSPECT Tabogon about 4:50pm in the afternoon of May 10,2019 wearing blue
shirt who was charged consummated second-degree arson and murder
for the May 08, 2019 incident, and faces up 20 years in prison if
convicted. The judge ordered that he be held without bail at Medellin
District Jail if arrested.

5. The Defendant set fire to a couch on the fifth floor of Jesus Levy
Dacera’s house. Firemen attempted to put out the blaze, but decided
to give up when they saw they were having no effect. In retreating from
the house, they encountered another fire on the second floor of the
building and one of the fireman received severe injuries from this
blaze. The second fire was also determined to be caused by arson, but
there was no evidence that it had been committed by Defendant. He
was charged by murder of killing Jesus Levy Dacera while he was not
abole to go out at their house because of the large fire.
IV INVESTIGATION/FINDINGS
6. The fire was investigated by Police Colonel Dionio, who later began
investigating the case, found that most of the evidence linking Atil to
the crime was circumstantial. There were witnesses to the event and
the shed was bulldozed after the fire, destroying the crime scene -- an
investigator from the Tabogon Fire office had to examine the debris
from the edge of a dump. Members of the community testified at trial
that the suspect were known for blowhard person for threating some
residents to burn their houses. To Tuason, the only pieces of evidence
tying Atil to the crime were the expert testimonies on the forensic
evidence. Tuason hired Fire officer Jomel Codilla to analyze the
findings of the fire investigation report.Codilla concluded that in light of
more recent developments of arson science, the physical evidence
used to convict Atil was flawed. He notes:
The fire had gone into flashover, which had left burn patterns
that were previously believed to be indicators of a liquid
accelerant.
V CONCLUSION
It was foreseeable that firemen would have responded to the
situation, thus exposing them to a life-threatening danger. The fire set by
defendant was an indispensable link in the chain of events that resulted in
the death. The court determined that it was hardly credible that
defendant's action was not of such a magnitude as to demonstrate a
wanton and depraved indifference to human life. Defendant was aware
that the house of Dacera was occupied by transients and that it was
located in the middle of a crowded neighborhood.
