MEMORANDUM
2. In connection with the incident transpired last February 28, 2019, wherein
allegedly, the accused Person Deprived of Liberty (PDL) Mark Ruben Taguba was
brought to court and remained in court without handcuffs and why the said PDL was
brought to court not wearing the official detainee color yellow shirt with print “BJMP
Detainee”, we, the undersigned, JO1 Jeremy L Argonza and JO1 Rushty M Maming
would like to respectfully manifest:
a. That there was no intention to violate any rules and the undersigned regret
that this incident happened;
b. That the accused, PDL Taguba was brought before the court wearing
handcuffs since this is the Standard Operating Procedures (SOP) in
escorting PDL;
c. That when the undersigned together with PDL Taguba arrived in the court,
PDL Taguba asked permission to remove the handcuff to be able to take
down notes on what the witness has to say;
d. That for humanitarian consideration and since there was sufficient strength
wherein a number of Jail Officers were also present inside the court which
added to the security, the undersigned permitted and temporarily removed
the handcuffs of PDL Taguba;
f. That the undersigned humbly ask for apologies and consideration for this
lapse;
g. That, regarding PDL Taguba’s not wearing of official detainee yellow shirt,
the undersigned respectfully explain that PDL Taguba has no available
clean official BJMP detainee shirt;
h. That, in order to comply with the order to bring the accused before the
court, PDL Taguba was allowed to wear a neat yellow collared shirt
instead;
i. That the undersigned sincerely apologizes for any inconvenience this may
have caused, and is humbly asking for consideration;
j. That on March 25, 2019, the explanation of the undersigned was submitted
before the court;
k. That since the incident happened, Escort personnel strictly check PDLs’
attire before proceeding to their respective courts for hearing.
3. The undersigned sincerely regrets this incident and ask for consideration.
Rest assured that this will serve as a lesson to always ask for wisdom of the Honorable
Court and that the undersigned will strictly follow all SOPs in escorting PDL to ensure that
this incident will never happen again.
