This document is a notice of entry of appearance and motion to reset a hearing submitted by the defense counsel for an accused in People vs. Accused, a criminal case. COMES NOW, ACCUSED, through the undersigned counsel, to
this Honorable Court, most respectfully states that:
1. The xxxxxxxxxxxxxxxxxxxxxxxxxxxx most respectfully enter its
appearance in the above entitled case. It is respectfully requested that all pleadings, motions, court orders, notices, processes, judgments and/or resolutions be sent to the address which is below indicated;
2. The above captioned case was set for hearing on February 19, 2018 at 1:30 o’clock in the afternoon. The services of the undersigned, however, was just engaged only today, February 19, 2018;
3. The undersigned, therefore, could not possibly attend the
scheduled hearing because the undersigned counsel has a prior duty to attend to an equally important case which was earlier set prior to the setting of the above-entitled case. The case is entitled “xxxxxxxxxxxxxxxxxxxxxxxxxxxx” docketed as Criminal Case No. xxxxxxxxxxxxxxxxx in the Regional Trial Court Branch -- – xxxxxxxxxxxxxxxxxxxxxx;
4. The hearing of the aforementioned case was set in the morning
and afternoon of February 19, 2018 with the advent of the implementation of the continuous trial rule;
5. With the foregoing reasons, the undersigned counsel
respectfully begs for the kind indulgence of the Honorable Court that the case be reset to ________________ at 1:30 o’clock in the afternoon; and,
6. This Motion is filed in good faith and not to interpose delay but solely due to the reasons above-stated.
PRAYER
WHEREFORE, premises considered, it is most respectfully
prayed of this Honorable Court to take notice of the entry of appearance of the undersigned Law Firm and to reset the hearing to ____________________ at 1:30 o’clock in the afternoon.
