I.

MISSION
1.To improve and enhance maritime safety activities and communication in every
districts as well as an endeavor to establish effective, systematic, and harmonized
maritime safety activities

2. To ensure that procedures in the conduct of VSEI, PDI, ERE and reporting
system are properly carried out in accordance with PCG existing policies

3. To disseminate updates and guidelines, air concerns and classification


regarding maritime safety enforcement.

II. PARTICIPANTS
Representative from MSSC and 12 PCG DISTRICTS

III. CHRONOLOGY OF EVENTS:


A. Through the collaborating efforts of the office of the Deputy Chief of Coast
Guard Staff for Maritime Safety Services (CG-8), a Maritime Safety
Conference was held at the New World Manila, Roxas BLVD, Malate,
Manila last 10 August 2017.

B. The event was a great avenue to disseminate new policies and programs,
to propound newly draft policies from HPCG and HMSSC and more
importantly to partake inputs from the representatives of each 12 CG District
as the implementers and beneficiaries of all the Maritime Safety policies and
programs.

C. The event has the following agenda:

1. Presentation of updates re MARSAF activities, Issues and Concerns


from all the 12 CG Districts;

2. Review and evaluation some of the previously approved Maritime


Safety Circulars which includes the following:

a. MC 01-14 Navigational Clearance for Road Bridges and Other


Structures over Navigable Inland Waters;
b. MC 02-14 Guidelines for the Operations of Recreational Watercrafts
for the Promotion of Life at Sea;
c. MC 03-14 Guidelines for Safety and Security Requirements of
Coastal and Beach Resorts and Vessels with Pool facilities including
Qualifications and Requirements of Lifeguards for the Promotion of
Safety of life at Sea;
d. MC 04– 14 Guidelines on Conducting Marine Parades, Regattas
and other Maritime related Activity for the Promotion of Life at Sea;
e. MC 01 -17 Consolidation and Overall Management and Delivery of
Maritime Safety Services as a Mandate of PCG.

3. Review and evaluation of the proposed MC Guidelines on the Operation


of Pleasure Yacht for the Promotion of Safety of Life at Sea;

4. Current updates on Maritime Safety Concerns from HMSSC;

5. Launching of Vessel Safety Enforcement Inspection (VSEI) Database.

D. During the Presentation of all the representative from CG Districts


hereunder were the frequent and noticeable issues and concerns:

 Spareparts of Lightstations are being vandalize or stolen


 Availabilty of ATON Supplies, Materials and Equipment for the
Existing LS
 Rehabilitations/Restorations of LS which remarked as NOT
OPERATING
 Issuance of New Video Cameras for Inspections
 Fund Allocation for the conduct of Info drive re: Marginalized
Fisherman
 Implementation of SSEN SYTEM
 Approval of the Draft MC Harbor Speed Limit Mactan-Cebu
Channel
 Delayed Issuance of Pertinent Ship Certificates From MARINA
 Lack of Well Trained VSEI Inspectors
 Availability of Portable GPS, ECDIS
 Regular ATON/MCI Courses and other Seminars

E. Salient inputs from all the participants with its respective agenda:

a. MC 01-14 Navigational Clearance for Road Bridges and Other


Structures over Navigable Inland Waters

 Accordingly, This Memorandum Circular will be implemented


prospectively in respect to all the existing structure but some of the
provisions of this MC such as the Installation of all Navigational lights
and markings may implement retroactively.
 Office of the DCS for MSS (CG-8) will coordinate with the CGIDS to
find out what Government agency concern will be involved in the
dissemination and inclusion of the said Navigational Clearance as
part of the requirement for the construction Road Bridges and Other
Structures over Navigable Inland Waters

 Office of the DCS for MSS (CG-8) suggested that in the district level,
Concerned CG District through its Stations and Sub Stations may
conduct parallel coordination between concerned agencies in their
AOR re aforementioned circular.

b. For MC 02-14 Guidelines for the Operations of Recreational


Watercrafts for the Promotion of Life at Sea

 As per review by all the participants, Creation of “Designated Area’


for recreational watercraft might be a problem in the implementation
of this MC.

 Some of the participants suggested a creation of SOP for the


“Designated Area’ from the HPCG.

 DCS for MSS (CG-8) stressed out that creation of SOP from HPCG
is not in need for the aforementioned MC because only the CG
Districts through its Stations and Sub Station identifies what
appropriate SOP shall implemented in their respective area specially
in the formulation of “Designated Area’.

C. MC 01 -17 Consolidation and Overall Management and Delivery


of Maritime Safety Services as a Mandate of PCG.

 CGSPP clarified the term “ASSIST’ in the said MC to the


Representative of H, MSSC, which later on affirmed that the word
“ASSIST’ includes the joining of assigned MSSU personnel in every
boarding formalities occurred in the Stations and Sub-Stations. But
since this MC is in the initial stage of implementation, MSSC will only
assign 4 MSSC personnel in every Districts and accordingly the
completion of the initial stage will be in the later part of this year.

 MSSC also clarified that the acceptance of the PCG Budgeted


Lighthouses will be signed by the C, MSSC.

 Acting CS, CGDSWN questioned the MARSAR Group as indicated


in the abovementioned MC. He said that creation of MARSAR Group
will dissect the Administrative and Operational Function of SOG,
which will be the start of disintegration of the 12 year culture and
tradition of the SOG. He also pointed out, that it is better to transfer
the whole SOG organization from CG Fleet rather that dissecting its
known functions.

D. Proposed MC Guidelines on the Operation of Pleasure Yacht for


the Promotion of Safety of Life at Sea

 DCS for MSS (CG-8) clarified that the term PDI as used in this Draft
is different from the MC 07-12( Pre Departure Inspection) because
according to the DCS for MSS, In statutory construction the latter
approved law will prevail, in effect the previous sections of the law
which is contradictory to latest law will be automatically rescinded in
favor of the new Law.

 Some of the participants questioned the constitutionality of the power


of the PCG to prohibit/detained Philippine-registered Pleasure
yachts.

 DCS for MSS (CG-8) explained that all of our right is absolute
including the right to travel which can be a subject to police power of
the state which is designated to the PCG. So as a result, PCG has
the authority regulate the travel of all the Philippine- Registered
Pleasure Yachts.

 DCS for MSS (CG-8) clarified that a Foreign Registered yachts only
following what her flag-state are implementing toward the safety
measure of their yachts hence PCG has no right to enforce its safety
regulations to a foreign Registered Yachts. But accordingly all of our
laws can be applied to all foreign yachts transiting on our territorial
waters.

 DCS for MSS (CG-8) also mentioned foreign-registered pleasure


yachts is not included under Port State Control.

E. MC 03-14 Guidelines for Safety and Security Requirements of


Coastal and Beach Resorts and Vessels with Pool facilities
including Qualifications and Requirements of Lifeguards for the
Promotion of Safety of life at Sea

 Some of the participants observed that this MC was created in favor


of accrediting organization such the mentioning of Philippine Life
Saving, PNRC, WLC which is income generating in nature.
 Some of the provision of this is not commensurable to some beach
or resort. Such as the provision mandating a one lifeguard in every
20 meters of length of beach coastline.

F. Current updates on Maritime Safety Concerns from H,MSSC

 According to MSSC, There will be a Proposed Construction of


Lighthouse in Kalayaan Group of Island namely:

1. LH PAROLA
2. LH PAG ASA
3. LH LIKAS
4. LH PANATABA
5. LH PATAG

G. Launching of Vessel Safety Enforcement Inspection (VSEI)


Database

VSEI DATABASE WILL BE AVAILABLE ESTIMATEDLY NEXT YEAR.

IV. PROBLEMS ENCOUNTERED

V. RECOMMENDATION

In terms of Maritime Safety, PCG created numerous number of Memorandum


Circular, simultaneously collaborated by the MARINA CIRCULARS which a
would be a great boost for the promotion of Safety of Life at Sea but sometimes
due to the numbers of policies under our mantle, failure to discharge public
obligation occurred. As part of the contemplation during Maritime Safety
Conference, undersigned recommend the following:

1. PCG should create a special Board that will monitor, investigate, and
endorse for the amendment of a certain provision or even create a new MC.
In line with this, it will update the current MARSAF policy system of our
organization.

2. Coast Guard Districts thru its Concerned District Staffs and Station
Commander should formulate Standing Operating Procedure governing the
implementation of a memorandum circular suitable for the needs of their
AOR.
3. Proactively conduct Information, Education and Communication campaign
for the Introduction and Implementation of a Newly Promulgated PCG
Maritime safety policies. Hence, Proactive action will also provide positive
image to the community.

4. Mandate All Stations – Sub- Stations to conduct mandatory TI&E re


MARSAF.

5. Expedite The Reimbursement process specially in initiating MARSAF


related programs.
