Monchito Ampeloquio, et al., vs. Atty. Potenciano A. Flores, Jr.

Notice

The complaint alleged that Atty. Flores, who was then the
counsel of the Monchito et al., was negligent in providing legal services
in a labor case they filed against their employer. Atty. Flores claims he
rendered continuous, straight and dedicated legal services to the
Monchito et al. up to the time that the case reached the Court of
Appeals and thereafter, the Supreme Court.

The Investigating Commissioner found that the allegations in the


complaint are unsubstantiated but recommended that Atty. Flores be
admonished.

The IBP Board of Governors reversed the recommendation and


dismissed the case firstly because Atty. Flores did not encroach upon
the professional employment of Atty. Mahinay who was Monchito et
al.s' new counsel in the labor case considering that there was no proof
that Atty. Flores directly or indirectly participated in the court
proceedings. Secondly, the allegation that Atty. Flores met and
discussed the possible settlement of the case with the opposing
counsel is also not substantiated.

Should Atty. Flores be disbarred for the alleged violations of


Canons 15, 17 and 18 of the CPR?
SC resolves to dismiss the case and consider the same as closed
and terminated.
