Summons With CDO
A verified Complaint with Prayer for the Issuance of a Cease and Desist
Order (CDO) having been filed with this Office on 21 February 2017,
respondents are hereby summoned and required to file a written Answer or
Counter-Affidavit to the Complaint, together with all the documents in
support thereof, copy hereto attached and served upon you, within a non-
extendible period of Ten days (10 days) from receipt hereof, copy
furnished the complainant within the same period. No Motion to Dismiss
shall be allowed, except for lack of jurisdiction, but any ground proper to
said motion, as well as a Counterclaim or a Cross-claim and a Third-Party
Complaint must be pleaded in the Answer, otherwise it/they shall be
considered barred.
Your failure to answer within the above-prescribed period will cause you,
upon motion of the other party, to be declared in default, and cause
judgment to be rendered on the basis of the evidence presented by the
other party in accordance with Section 33 Rule 9 of the 2011 HLURB Rules
of Procedure
Further, the parties are directed to appear before the undersigned Arbiter
on 1 March 2017 (Wednesday) at two o’clock in the afternoon
(2PM) at the 3rd Floor Du Point Building, Velez-Akut Streets,
Cagayan de Oro City for the hearing of the application for issuance of a
CDO.
