4 . T er m .
This Agreem ent and license are effectiv e from the tim e Y ou ex ecute this Agreem ent until
this Agreem ent is term inated. Y ou m ay term inate this Agreem ent at any tim e by
uninstalling or destroying all copies of the O riginal Code including all binary v ersions
and rem ov ing any M odifications to the O riginal Code ex isting in any products. This
Agreem ent will term inate im m ediately and without further notice if Y ou fail to com ply
with any prov ision of this Agreem ent. All restrictions on use, and all other prov isions that
m ay reasonably be interpreted to surv iv e term ination of this Agreem ent, will surv iv e
term ination of this Agreem ent for any reason. U pon term ination, Y ou agree to uninstall
or destroy all copies of the O riginal Code, M odifications, and D ocum entation.

Y ou agree to indem nify and hold G oAhead harm less against any and all claim s, losses,
dam ages and costs ( including legal ex penses and reasonable counsel fees) arising out of
any claim of a third party with respect to the contents of the Y our products, and any
intellectual property rights or other rights or interests related thereto.

8 . H i g h -R i s k A c ti v i ti es .
The O riginal Code is not fault-tolerant and is not designed, m anufactured or intended for
use or resale as online control eq uipm ent in haz ardous env ironm ents req uiring fail-safe
perform ance, such as in the operation of nuclear facilities, aircraft nav igation or
com m unication system s, air traffic control, direct life support m achines or weapons
system s, in which the failure of the O riginal Code could lead directly to death, personal
inj ury, or sev ere physical or env ironm ental dam age. G oAhead and its suppliers
specifically disclaim any ex press or im plied warranty of fitness for any high-risk uses
listed abov e.

F or units of the D epartm ent of D efense, use, duplication, or disclosure by the
G ov ernm ent is subj ect to restrictions as set forth in subparagraph ( c)( 1)( ii) of the R ights

published software set forth in subparagraph ( c)( 3 ) of that clause.

The O riginal Code ( i) was dev eloped at priv ate ex pense, and no part of it was dev eloped
with gov ernm ental funds; ( ii) is a trade secret of G oAhead ( or its licensor( s)) for all
purposes of the F reedom of I nform ation Act; ( iii) is " restricted com puter software"
subj ect to lim ited utiliz ation as prov ided in the contract between the v endor and the

Washington, without regard to its rules gov erning the conflict of laws. Y ou hereby
consent to the ex clusiv e j urisdiction of the state and federal courts located in K ing
County, Washington ov er any disputes arising out of related to this Agreem ent. I f any
prov ision of this Agreem ent is held illegal or unenforceable by a court or tribunal of
com petent j urisdiction, the rem aining prov isions of this Agreem ent shall rem ain in effect
and the inv alid prov ision deem ed m odified to the least degree necessary to rem edy such
inv alidity.

This Agreem ent is the com plete agreem ent between G oAhead and Y ou and supersedes
all prior agreem ents, oral or written, with respect to the subj ect m atter hereof.
