Charge Description: That the Defendant, STANISLAW JAN KOZACZKA, did cause the death of a human
being not constituting murder or manslaughter, to-wit: Dziechchiowski Wlodzimierz, as a result of
operatingamotorvehiclewhilehavinganalcoholconcentrationof0.08ormore.

STATEMENTOFPROBABLECAUSE
TheComplainantstatesthatthefollowingfactsestablishprobablecause:
OnoraboutSeptember20,2017,atapproximately1745hours,theSt.LouisCountySheriff'sOfficewas
dispatchedtoareportofawateremergencyonLakeKabetogama,St.LouisCounty,StateofMinnesota.
Thereportwasthatamalehadfallenoutofaboatandwasunconscious.Ultimately,priortoarrivalbylaw
enforcement,theambulancecrewofInternationalFallsAmbulancepronouncedthemaledeceased.The
malewaslateridentifiedasDziechciowskiWlodzimierz,DOB:03-04-1951,hereinafterreferredtoasthe
"Victim."
Sgt.TomaoftheSt.LouisCountySheriff'sOfficeinterviewedInternationalFallsparamedicNathanMyers
whostatedthatemergencycrewshadworkedontheVictimfor45minutesbuttheVictimremainedwithout
aheartbeattheentiretimeandtheystoppedeffortstorevivehimat17:46.MyerstoldSgtTomathathehad
beentoldtheVictimhadbeenfacedowninthewaterforfiveminutesbeforehisheadwasabletobelifted
outofthewater.
DeputyKevinHagenoftheSt.LouisCountySheriff'sOfficearrivedattheParkPointResortandmade
contactwiththedriveroftheboatthattheVictimhadfallenfrom.ThedriverwasidentifiedasSTANISLAW
JANKOZACZKA,DOB:04-01-1962,hereinafterreferredtoasthe"Defendant."TheDefendantstated
thathewastheowneroftheboatandthatheandtheVictimhadbeenattheresortsinceSaturday,09-16-
2017.TheDefendantstatedthetwohadbeenfishingthatmorningforapproximately2-3hoursandthen
againthatafternoonforanother2-3hours.Defendantstatedtheyweregoingbacktoshoreagainandhe
wasdrivingtheboatandtheVictimwasseatedonhistackleboxonthefrontdeckoftheboatandnot
wearinghisseatbelt.Defendantstatedthathehadtheboatuponplainandwasattemptingtoturntheboat
towardshorewhenperhapshecrossedoveranotherboat'swake.DefendantstatedthisiswhentheVictim
felloverboardonthepassengersideoftheboat.
DefendantstatedheturnedtheboataroundandattemptedtopulltheVictimbackintotheboatbutthatthe
Victimwasalargermanandhehaddifficultypullinghiminsostartedyellingforhelp.TheDefendantstated
thattheboatbegantotakeonwateratthispoint.HelpcamebyboatandtheywereabletopulltheVictim
intotheboatandpulltheboatintoshore.TheDefendantstatedtheyattemptedCPRuntilmedicalhelp
arrived.TheDefendantfurtherstatedthathehadbeendrinking4-6twelveouncebeersthroughouttheday.
DeputyHagenobservedDefendant'seyestobered,wateryandglassy.DeputyHagenalsosmelled
alcoholontheDefendant'sbreathashespoke.TheDefendantagreedtoprovideabreathsampleforthe
PBTwhichresultedinasampleof.105BACatapproximately18:39hours.
DeputyHageninterviewedawitness,JasonAllanCooper,DOB:02-26-1970.Cooperstatedhewas
insidethelodgeandheardsomeoneyellingforhelp.Cooperstatedhelookedoutandobservedaman
tryingtopullanothermanfromthewaterintoaboat.Cooperranoutsideanddrovehisboatouttohelp.
Cooperstatedthatthemale,whohepointedoutastheDefendantwastheboatdriverandhewas
attemptingtopulltheVictimfromthewaterbuttheboatwasfillingwithwater.Cooperpulledthembackto
shore.
Anotherwitness,DavidVadnais,reportedtoSgt.Tomathathehadseenaboat,latertobeidentifiedas
theboatdrivenbytheDefendant,tobeapproximately100yardsbeyondthe"nowake"zoneandhe
observedapersonintheboatstandingnearthesternoftheboatdoingsomethingandeventhoughhewas

lookingthroughbinocularscouldn'ttellwhattheyweredoing.Vadnaisstatednoonewasyellingforhelpat
thattime.ItwasonlylaterthatVadnaisrealizedwhathehadseenwasthepersonintheboattryingtopulla
personoutofthewater.
DeputyBarrettoftheSt.LouisCountySheriff'sOfficearrivedonsceneaftertheincident.Conservation
OfficeColleenAdamcontactedhimafterconductingasearchoftheboatafterithadbeenpulledfromthe
water.COAdamfoundacanteeninasidecompartmentbehindthedriver'sseat.Thecanteencontained
anunknowntypeofalcohol.ThecustodyofthecanteenwastransferredtoDeputyBarrett.
Sgt.TarroftheSt.LouisCountySheriff'sOfficeappliedforandreceivedawarrantforDefendant'sblood.A
bloodsamplewastakenfromtheDefendantattheCookHospital.

ComplainantrequeststhatDefendant,subjecttobailorconditionsofrelease,be:
(1)arrestedorthatotherlawfulstepsbetakentoobtainDefendant'sappearanceincourtor
(2)detained,ifalreadyincustody,pendingfurtherproceedingsandthatsaidDefendantotherwise
bedealtwithaccordingtolaw.

Beingauthorizedtoprosecutetheoffensescharged,Iapprovethiscomplaint.

FINDINGOFPROBABLECAUSE
From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendants arrest
or other lawful steps be taken to obtain Defendants appearance in court, or Defendants detention, if already in custody,
pendingfurtherproceedings.Defendantisthereforechargedwiththeabove-statedoffense(s).
SUMMONS
THEREFOREYOU,THEDEFENDANT,ARESUMMONEDtoappearon___________,_____at_____AM/PM
beforetheabove-namedcourtat1810E12thAvenue,Hibbing,MN55746-1680toanswerthiscomplaint.

WARRANT
To the Sheriff of the above-named county or other person authorized to execute this warrant: I order, in the name of the State
of Minnesota, that the Defendant be apprehended and arrested without delay and brought promptly before the court (if in
session), and if not, before a Judge or Judicial Officer of such court without unnecessary delay, and in any event not later than
36hoursafterthearrestorassoonassuchJudgeorJudicialOfficerisavailabletobedealtwithaccordingtolaw.

Since the Defendant is already in custody, I order, subject to bail or conditions of release, that the Defendant continue to be
