CRIMINAL COMPLAINT

The undersigned Chief Police of the Philippine National Police (PNP) stationed in
Cauayan City Police Station, Cauayan City, Isabela, after having been duly sworn in
accordance with law, hereby accuses PEDRO SANTOS, 38 years old, account
supervisor, married and resident of Brgy. San Fermin, Cauayan City, Isabela, RONNIE
DAYAN, 38 years old, salesman , married and a resident of Brgy. San Fermin, Cauayan
City, Isabela, MANNY PUKYAW, 37 years old,technician , married and resident of Brgy.
Cabaruan , Cauayan City, Isabela and JOHN DOE for the crime of FRUSTRATED
MURDER, committed as follows:

That at around 1 am of December 1, 2016 at Brgy. Marabulig 2, Cauayan City,

Province of Isabela, Philippines and within the jurisdiction of this honorable court, the
above named respondents, conspiring, confederating and mutually helping one another
with intent to take life of JUAN DELA CRUZ, 38 years old, businessman, married and
resident of Brgy. San Fermin, Cauayan City, Isabela, did then and there willfully,
unlawfully, feloniously and criminally with treachery and known premeditation, kicked
victims stomach ,tied the complainants hands on his back with a rope, covered his mouth
with face towel, forced him inside the car of Pedro Santos then brought him to Bry.
Marabulig Bridge, Cauayan City and then threw him to the creek, but the complainant
managed to save his life, seek help and report the incident to this office. Thus, performing
all the acts of execution, which should have produced the crime of murder as a
consequence, but did not for some reason independent of the respondents will and
alertness of said victim by removing the towel in his mouth and swimming using just his
feet for paddling to avoid being killed.

SUBJECT: SPOT REPORT ON FRUSTRATED MURDER CASE

DATE: December 1, 2016

1. Case Number CCPSIDMU 1201-03 Report on Frustrated Murder.

2. Please be informed that a frustrated murder murder incident transpired at about
12:30 am of December 1, 2016 particularly at Marabulig Bridge, Brgy. Marabulig
2, Cauayan City, Isabela, wherein the victim JUAN DELA CRUZ, 38 years old,
businessman, married and a resident of Brgy. San Fermin, Cauayan City, Isabela,
kicked his stomach tied his hand and feet with a rope and his mouth covered by
face towel and was thrown into the Marabulig Creek. Fortunately, he was able to
save his life and report the incident to this office.
3. Initial investigation conducted disclosed that prior to the incident, victim and
suspects namely PEDRO SANTOS, 38 years old,account supervisor, married and
resident of Brgy. Cabaruan, Cauayan City, Isabela , RONNIE DAYAN, 38 years
old, salesman, married and resident of Brgy. San Fermin, Cauayan City, Isabela
and MANNY PUKYAW, 37 years old, technician, married and resident of
Cabaruan, Cauayan City, Isabela were having drinking session at Centro,
Cauayan City. After consuming 5 bucket of red horse beer the victim told the
suspects that he will head home because of emergency but suspects insisted that
Juan should stay for a while. After Juan paid all the bills and told to the suspects
 that he will head home first. When the victim went to the parking area, he noticed
that suspects are following him then victim was kicked his stomach, tied his hands
on his back, covered his mouth with a towel and forced him inside the car. He was
later brought to Marabulig Bridge and was thrown to the creek. The suspects left
the bridge thereafter. The victim somehow managed to remove the towel in his
mouth and paddle his feet so he will not drown, hid in the bushes, walk and seek
help from JOSE PANALO, 30 years old, single, customer service assistant and
resident of Brgy. Marabulig 2, Cauayan City, Isabela, who helped him to get to this
Police Station and file a formal complaint against the suspects.
4. Personnel from Cauayan City Police Station led by PCI OSCAR VALERO and
personnel from Isabela Crime Laboratory Office led by PCI BENIGNO DUTERTE
responded at the place of incident to conduct investigation and crime scene
processing and were able to recover two 1 meter rope and one pair of shoes owned
by the victim at the scene of the crime.

3. TANONG-Bakit ka naparito sa himpilan ng Pulisya ng Cauayan City, Isabela?

SAGOT- Naparito ako para magsampa ng demanda laban kay Pedro Santos,
Manny Pukyaw, Ronnie Dayan at sa isang lalaking hindi ko kilala, sir.

4. TANONG- Bakit ka magsasampa ng demanda laban sa taong ito?

SAGOT-Dahil po sa paghulog nila sa akin sa Marabulig Bridge ng nkagapos ang

kamay at paa.

5. TANONG- Kailan at saan ito nangyari?

SAGOT- Noon pong ika-1 ng Disyembre2016 sa oras ng ala una ng umaga, sir.

6. TANONG- Maari mo bang isalaysay ang buong pangyayari?

SAGOT- Noong araw po n iyon ay nag text si Pedro sa akin bandang alas otso
ng gabi at sinabi nga niyang mag-iinuman nga kami dahil na promote siya sa
trabaho.Hindi po ako nag reply sa kanya dahil abala po ako sa aking negosyo na buy and
sell. Pero laking gulat ko po nung bandang alas nuebe ay may pumarada na sasakyan
sa harapan ng aking negosyo lulan po sila Pedro, Ronnie, Manny at isang lalaki po na
hindi ko kilala na siya po ang nagmamaneho ng Toyota Vios.

7. TANONG- Ano pa ang sumunod na nangyari?

 SAGOT- Bumaba po silang tatlo at pumunta sila sa aking lamesa at kinumbinsi
nila akong sumama sa kanila. Alam kong naka inom na silang tatlo nung pinuntahan ako
sa bahay dahil amoy alak na sila. Sinabi ko na sasama ako pero di magtatagal dahil nga
marami pang aayusin sa negosyo. Yun nga, nagpunta kmi sa Seferinas, Centro,
Cauayan City, Isabela at ginamit ko na ang sarili kong sakay samantalang sila ay gamit
naman ang Vios.

8. TANONG-Ano pa ang sumunod na nagyari?

SAGOT-At nang marating namin ang Seferinas ay nag inuman nga kami.
Napansin ko na naparami na sila ng naiinom dahil naka ilang order na sila ng beer at
bago pa man nila ako inaya eh alam kong naka inom na rin silang tatlo. Nang napapansin
ko na lasing na sila dahil hindi na maganda ang lumalabas sa kanilang bibig, minabuti ko
ng magpaalam dahil lumalalim na rin ang gabi mga bandang alas onse ng gabi yun
ngunit pinipilit nila akong hintayin ko na lamang daw maubos yung huling inorder nila.
Dahil nag text ang bantay ng tindahan ko na nagkaroon ng problema sa negosyo ko,
sinabi ko sa kanila na kailangan ko ng umalis dahil may emergency nga. Hindi pumayag
si Pedro at sinabi niyang saglit na lang at hintayin lang namin yung sundo namin, nasa
may Rizal Park. Matapos kong bayaran ang bill, napansin kong sumunod na sila sa
parking area kung saan andon ang aking sasakyan na Nissan Juke. Ngunit nagulat ako
nung dinakma ni Pedro at Ronnie ang aking kamay sabay tali sa likod ng aking katawan.
Pati paa ko ay tinalian din. Sa pagpupumiglas ko sinutok ako at sinipa ang aking tyan.
Pilit kong lumaban ngunit sadya po na malakas si Pedro at Ronnie. Nagtaas na rin ako
na boses at tinanong ko bakit nila ginagawa yun. Ang sagot ni Ronnie ay simple lang
naman ang gusto namin. Nang muli akong sisigaw para humingi ng tulong ay kinuha ni
Manny ang kanyang bimpo sabay saksak sa aking bibig sabay tawa ng malakas. Ilang
saglit pa ay huminto sa aming harapan ang sasakyan ni Pedro na kulay abo na Toyota
Vios na minamaneho ng isang lalaking di ko kilalala. Sinakay ako sa kotse at napansin
ko na palabas kami ng Cauayan sa Timog na bahagi. Habang nasa daan ay
nagtatatwanan at nag uusap silang tatlo kung ano magandang gawin sa akin at ng
marating namin ang tulay ng Marabulig at bigla na lang huminto ang sasakyan. Narinig
ko mismo kay Manny na bilisan natin kumilos para wala makapansin na may itatapon
tayo. Nang maka baba silang tatlo ay kinuha nila ako sa loob ng sasakyan, si Pedro at
Manny ay hinawakan ang balikat ko at kamay at sa gawing paa naman si Ronnie at di ko
kilalang lalaki. Mabilis nila akong natapon sa tulay at narinig ko mula sa isa sa kanila na
siguradong patay nay un, ang lalim nito.

9. TANONG- Ano pa ang sumunod na nagyare pagatapos kang maihulog sa ilog?

SAGOT- Noong sapilitan nila akong ibaba sa sasakyan ay nakakalag na yung tali
ko sa paa at sa pagpupumiglas ko ay naalis ang isang pares ng aking sapatos. At nang
ako na hinulog na sa ilog ay pinilit kong lumangoy hanggang sa makarating ako sa
mababang parte ng ilog at unti unti kong naalis ang aking busal sa bibig. At nang
makarating ako sa gilid ng ilog sinikap kong humingi ng tulong ngunit walang nakakarinig
sa akin. Minabuti ko na lamang na akyatin ang daan hanggang sa makarating ako sa
highway. Nagdesisyon akong maglakad hangang sa may mahingan ako ng tulong kay
Jose Panalo na pauuwi naman siya sa kanilang bahay ng mga panahon na yun na galing
sa lamay. Pinara ko ang tricycle ni Jose at sinamahan niya ako dito sa Police Station.
Dito na po sa Police Station tinanggal ang pagkakatali ng kamay.

10. TANONG- Ano pa ang sumunod na nagyari?

SAGOT- Matapos pong makapagreport sa pulisya ay dinala po ako sa Cauayan

District Hospital.

11. TANONG- Ano naman ang nangyare sa iyo?

SAGOT- Nagtamo po ako ng galos at sugat gawa ng pagkaka hulog ko sa tulay.

12. TANONG: Mayroon ka na bang Medico-Legal Certificate?

SAGOT- Mayroon na sir.

13. TANONG- Wala na akong tatanungin sa Iyo ngayon, meron ka bang gustong alisin o
idagdag sa sinumpaang salaysay mo?

SAGOT-Wala na sa ngayon, sir

SAGOT- Kaninang umaga po sir alas dos y medya ng madaling araw sa tulay ng

may mapansin akong isang lalaking basang-basa na tila ba wala nanghihingi ng tulong.

Habang tinatapos ko po ang ilang mga dokumento ng opisina ay dumating po ang
dalawang lalaki sa aming himpilan. Ang isa po ay basang-basa at may tali pa sa kamay
at isa lang ang sapatos niya. Kaagad ko silang pinapasok at tinulungan ko ng kalagin
ang tali sa kamay ng isang lalaki.Binigyan ko na rin ng kumot upang pansamantala ay di
siya ginawin.

JOINT AFFIDAVIT OF ARREST

We, SP04 BATO DELA ROSA, P04 ROD PIT, P03 CEZAR MONTANA, P02
ALEX GINALINGAN AND P02 LYNDON PRETTYBOY, ALL OF LEGAL AGES,
MARRIED, INCUMBENT MEMBERS OF THE Philippine National Police and presently
assigned at Cauayan City Police Station, Cauayan City, Isabela after having been duly
sworn to in accordance with law hereby depose and state;

1. That we were designated as Municipal Executive Senion Officer (MESPO) Patrol

PNCO, Investigator, Police Community Relations Officer PNCO, Operation PNCO
and Intel Operative of Cauayan City Ploice Station, Cauayan City, Isabela
respectively;
2. That at around 5 o clock in the afternoon of December 1, 2016, we responded to
the information given by COP that there was a crime of frustrated murder incident
that transpired in Marabulig 2, Cauyan City, Isabela.
3. That we immediately proceeded to the address given to us and invited PEDRO
SANTOS, 38 years old, account supervisor, married and resident of Brgy. San
Fermin, Cauayan City, Isabela, RONNIE DAYAN, 38 years old, salesman , married
and a resident of Brgy. San Fermin, Cauayan City, Isabela, MANNY PUKYAW, 37
years old,technician , married and resident of Brgy. Cabaruan , Cauayan City,
Isabela and certain JOHN DOE to the Cauyan City, Police Station.
4. That upon arrival at Brgy. San Fermin, Cauayan City Isabela, we were approached
by Juan Dela Cruz and pointed the house of Ronnie Dayan and Manny Pukyaw.
5. That upon knowing, we immediately run towards the suspects but when they
perceived us, they rushed and run to evade but we were able to chase them and
effect their arrest duly informed of their constitutional rights;
6. That we conducted hot pursuit operation together with Juan Dela Cruz at Brgy.
San Fermin-Brgy. Cabaruan Cauayan City Isabela and about 5pm of December 1,
2016, we were able to arrest (2) two male person named Manny Pukyaw and
Ronnie Dayan as being pinpointed by the victim (Juan Dela Cruz) duly appraised
of their constitutional rights;
7. That we brought the arrested suspects at Cauayan City Police Station for proper
disposition;
8. That we are executing this affidavit to attest the truthfulness of the foregoing facts
without being forced, coerced or promised of any reward;

INFORMATION

The undersigned Prosecutor III, accuses PEDRO SANTOS, RONNIE DAYAN,

MANNY PUKYAW AND JOHN DOE, of the crime of FRUSTRATED MURDER, defined
and penalized under Revised Penal Code, committed as follows:

That at around 1 am of December 1, 2016 at Brgy. Marabulig 2, Cauayan

City, Province of Isabela, Philippines and within the jurisdiction of this honorable court,
the above named respondents, conspiring, confederating and mutually helping one
another with intent to take life of JUAN DELA CRUZ, 38 years old, businessman, married
and resident of Brgy. San Fermin, Cauayan City, Isabela, did then and there willfully,
unlawfully, feloniously and criminally with treachery and known premeditation, kicked
victims stomach ,tied the complainants hands on his back with a rope, covered his mouth
with face towel, forced him inside the car of Pedro Santos then brought him to Bry.
Marabulig Bridge, Cauayan City and then threw him to the creek, but the complainant
managed to save his life, seek help and report the incident to this office. Thus, performing
all the acts of execution, which should have produced the crime of murder as a
consequence, but did not for some reason independent of the respondents will and
alertness of said victim by removing the towel in his mouth and swimming using just his
feet for paddling to avoid being killed.
