WHEREAS, Sec. 458, (5), (v) and (vi), of Republic Act No. 7160,
otherwise known as the Local Government Code of 1991, empowers the
Sangguniang Panlungsod to approve ordinances regulating the use of
streets and establish traffic routes to promote the general welfare;
WHEREAS, Article 19, Section 1(b) of the General Code of
Ordinances establishes the odd/even number scheme applicable to public
utility tricycles for the purpose of regulating the traffic flow within the
primary streets to prevent traffic congestion;
WHEREAS, the transfer of all Terminal and Public Market
Operations from the old market area to the Public Market/Terminal
Complex has significantly eased the traffic in the primary streets of
Cabadbaran City rendering the purpose of odd/even number scheme
moot;
WHEREAS, tricycle drivers and operators will largely benefit,
through increased sales, if the odd/even number scheme is lifted
because it allows them access to commuters within the primary streets of
Cabadbaran City;
WHEREAS, by lifting the odd/even number scheme, traffic flow in
other streets will improve due to the availability of the primary
streets as alternative routes.
NOW THEREFORE
BE IT ORDAINED, by the 2nd Sangguniang Panlungsod, in its 5 th
Regular Session assembled, that:
