MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement (Agreement) is executed and entered into


this ____ day of ___________, 2017, by and between:

The ___________________, local government unit of the Republic


of the Philippines with principal address at ___________________,
represented herein by its Mayor, _________________, hereinafter
referred to as the City;

-and-

The PHILIPPINE NATIONAL POLICE POLICE STATION,


with office address at _______________________________, and
represented by its Acting Chief of Police___________________,
hereinafter referred to as PNP.

WITNESSETH, that:

WHEREAS, it is an operative principle of decentralization under Republic Act


7160, otherwise known as the Local Government Code of 1991, that local
autonomy shall be attained through improved coordination of national
government policies and programs;

WHEREAS, the general welfare clause of Republic Act 7160 provides that every
local government unit shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or
incidental for its efficient and effective governance, and those which are
essential to the promotion of the general welfare;

WHEREAS, local government units are duty bound to maintain peace and
order, and preserve the comfort and convenience of their inhabitants, among
other mandates;

WHEREAS, PNP is mandated by law to enforce the law, prevent and control
crimes, maintain peace and order, and ensure public safety and internal
security with the active support of the community;

WHEREAS, the PNP, through its Police Community Relations program, aims
to operate in and with the various sectors of the community and impel their
continuing collaboration and support to police programs and activities; educate
and inform the public on the Criminal Justice System, and undertake such other
community-oriented activities essential for an effective and efficient police
service;

WHEREAS, as of 31 December 2016, the total strength of the PNP is 768
personnel, or a police-to-population ratio of 1:2,000 which is below the ideal of
ratio of 1:500;

WHEREAS, the low police-to-population ratio in __________ coupled with its


large land area pose a serious challenge to the;

WHEREAS, to address the shortage in manpower and personnel, the City


intends to supplement the present complement of the PNP by enlisting civilian
volunteers or a civilian peace-keeping action force(the Police Auxiliary) who
will act as police force multipliers to aid and assist the PNP in providing
adequate security to the City;

WHEREAS, the PNP is willing and ready to provide the necessary orientation
and training to enlisted Police Auxiliary to make them able, competent and
ready partners to the PNP;

NOW THEREFORE, for and in consideration of the foregoing premises and by


mutual covenants herein, the parties hereby bind themselves and agree to the
following:

I. PURPOSE OF THIS AGREEMENT

This Agreement is entered into to strengthen the close cooperation and


partnership of the City and the PNP towards the attainment of their common
goal of achieving efficient and effective law enforcement, improved peace and
order, public safety and internal security. Specifically, this Agreement outlines
the undertaking of the parties to jointly cooperate with each other in
augmenting the manpower complement of the PNP through the recruitment,
training and integration an able, responsible and competent corp of Police
Auxiliary that shall act as police force multipliers in police-related activities.

II. RESPONSIBILITIES OF THE PARTIES. The duties and responsibilities of


the parties are as follows:

1.1 The CITY shall:

a. Provide the PNP the amount of Ten Million Pesos (Php


10,000,000) as appropriated by the Sangunian Panlungsod
through Sangunian Ordinance __________ to finance and support
the recruitment, training, and deployment of the Police Auxiliary
who shall act as police multipliers;

b. Provide information to the PNP on the areas in the city that are
in need of increased police presence;

c. Support the PNP in the formulation of guidelines and policies


in the recruitment, training, and deployment of the Police
Auxiliary.

1.2 The PNP shall:

a. With coordination with the City, to determine the qualification


standards for the Police Auxiliary, their selection and
recruitment;

b. Have control and supervision over the recruited civilian


volunteers. With coordination with the City, it shall determine
the deployment and assignments of the Police Auxiliary in the
implementation of Police Community Relations Programs,
among others;

c. Coordinate with the barangay officials for barangay-level


activities and programs initiated by the PNP

d. Submit to the City a monthly accomplishment report on the


activities and performance of duties of the Police Auxiliary. The
report shall indicate, among others, the total number of the Police
Auxiliary, their respective area of assignment and their respective
functions and duties;

e. Require the Police Auxiliary, through their respective team


leaders, to submit monthly accomplishment reports. The monthly
accomplishment report shall indicate, among others, the date,
time and area deployment schedule of each member of the Police
Auxiliary;

f. Issue identification cards to the Police Auxiliary which shall bear


the signatures of competent authorities of the parties herein;

g. Provide the Standard Operating Procedures to be observed by the


Police Auxiliary relative to their participation in activities
involving peace and order, disaster and emergency response,
socio-civic/community assistance and community relations
programs, initiated by the CITY and/or the PNP;

h. Train and develop the Police Auxiliary prior to deployment.

III. OTHER PROVISIONS

1. The disbursement of funds herein provided by the City shall be made strictly
in accordance with law, rules and regulations and COA accounting and
auditing rules.

2. The PNP may grant allowances to members of the Police Auxiliary in the
amount and extent that it may determine proper and as may be allowed under
the relevant law, rules and regulation.

3. The PNP shall hold the City free and harmless from any liability, risk or cost
which may arise as a result of, from, or in connection with an injury or death
of any person, or damage or loss of any property in the course of the

performance of the PNP and the Police Auxiliary of their obligations and
duties.

4. This Agreement may be modified and/or amended in writing upon mutual


consent of both parties.

IV. EFFECTIVITY

The provisions of this Agreement shall take effect on 01 January 2017 and shall
remain in full force and effect until 31 December 2017 unless sooner terminated
by the parties.

IN WITNESS WHEREOF, the parties hereunto affix their signatures on the

ACKNOWLEDGMENT

BEFORE ME, a Notary Public for and in ______________, this ________ day of
__________ 2017, personally appeared the following:

all known to me and to me known to be the same persons who executed the
foregoing Memorandum of Agreement and who acknowledged to me that the
same are their free and voluntary act as well as that of the entities they
represent.

This instrument which consists of FIVE (5) pages, including this page where
this acknowledgment is written, and which is signed by the parties and their
instrumental witnesses in the presence of one another.
