    NOTIFICATION

    NOTICE IS HEREBY GIVEN, that the undersigned, husband of MARICEL F.


    MONDEJAR-ARPA,has pronounced divorce by Talaq against the latter pursuant to Article 161
    of P.D. 1083 or the code of Muslim Personal Law.

    In support of said pronouncement, that hereby alleges the facts and circumstances as
    follows:

    1. That they got married on April 10, 2000 pursuant to P.D. 1083 as evidenced by a
    Certificate of Marriage hereto attached as Annex A;

    2. That prior to said marriage, they entered into a Prenuptial Agreement where they both
    substantially agree, among others. That they shall establish separate property; That
    they shall manage, control and dispose their separate properties; that in the event of
    termination of marriage, their respective properties shall remain separate; and that
    they agree to be responsible for their own support upon termination thereof, a copy of
    the pre-nuptial Agreement is hereto attached as Annex B;

    3. That from May, 2000, he was away from home having spent the same outside of the
    Philippines. However he consistently supported his wife giving her SIXTEEN
    THOUSAND (16,000.00) PESOS monthly exclusively for her personal use only as
    all utilities and expenses are already covered by the housekeeper who manages his
    house budget;

    4. That upon his return to the Philippines in the latter part of November, 2000 and after
    living with her for the last three years, he discovered that:
    4.a His wife mishandled the money given to her as she could not
    account for it. Neither did she buy valuable personal properties
    like furnitures and appliances for the family use;

    4.b His wife is engaged in nocturnal activities going out with


    friends and barkadas regularly for an evening of drinking,
    strolling or discoing;

    4.c Every time he confronts her about her regular outings with
    friends, she would throw out moody attitude instead of giving
    logical or justified reasons. She would even drink alone in her
    room show her resentment;

    4.d She does not fulfill her house duties as wife such as cleaning,
    washing, cooking and doing other household chores including
    budgeting;

    4.e She indulges in lustful activities in his absences like watching


    pornographic videos.

    5. That despite the problems and trouble that she has caused, he consistently remained
    patient to her, gave her all the moral and financial support as follow:

    5.a. He has provided luxury needs to her and her family,


    occasionally goes out with them in discos and restaurant and even
    paid for their birthday celebrations;

    5.b. He further supported his wifes relatives giving expenses for


    hospitalization and burial of an uncle and paying the credit of his
    in-laws with a sari-sari store and distributed about THIRTY
    THOUSAND (30,000.00) PESOS worth of financial aide to the
    relatives;

    5.c. He encouraged his wife to pursue her high school education


    and even obtained a private tutor for her;

    5.d. He still regularly delivers and even increase the financial


    support to his mother-in-law including 2 (two) sacks of rice
    monthly;

    6. That all aforestated facts are corroborated by MARCELINO F. MONDEJAR, brother
    of his wife, as evidenced by an affidavit hereto attached as Annex C;

    7. That all the action of his wife is not the doing of a responsible housewife for which
    he has pronounced Divorce by Talaq.

    RESPECTFULLY SUBMITTED. This day _____ September, 2008 at Zamboanga City,


    Philippines.
