The testimony of the witness BOB JONES is being offered to

prove the:
1. The antecedent facts on the signing of the alleged

board resolution approving payment to Johny Walker
A.K.A Juan Lakad;
2. The validity of the said resolution;
3. The identities of the complainant in the present case.
III. JUDICIAL AFFIDAVIT PROPER.
I, BOB JONES, 50 years old, married, Filipino, and residing at

088 San Luis Ext, Dimasarakan City under oath, depose:
1. Q: Please state your name, age, residence, and

occupation of the witness.
A: I am BOB JONES, 50 years old, married,

residing at 088 San Luis Ext, Dimasarakan City , and the
Vice Chairman of the Board of Directors of Lupa Realty
Incorporated
2. Q: Why are you here now?

A: To give a sworn statement by way of a judicial
affidavit, the same to constitute as my testimony, in the
above-captioned
civil case.
3. Q: For the record, please state the name and

address of the lawyer who is now conducting your
examination and the place of your examination.
A: The legal counsel for the Defendants, Atty.
Crystaline Alfonso-Siguenza,is conducting or supervising my
examination now at their law office ACQUITAS LAW OFFICE
located at Rm 1, First Floor Aequitas Building #1 Bonifacio
St., Baguio City, Philippines
4. Q: In what language do you want your examination

to be conducted?
A: This judicial affidavit is prepared in English.

But I prefer that my cross examination be conducted in
Tagalog for my convenience and for clarity.
5. Q : Do you undertake to answer the questions to be

asked of you, fully conscious that you will do so under
oath, and that you may face criminal liability for false
testimony or perjury?
A: Yes.
6. Q: Let us now proceed to the Complaint. Do you
know the
Plaintiff Johny Walker A.K.A Juan Lakad?
A: Yes. He used to manage the business of the

corporation.
7. Q: Why are your testifying in this case?

A: I am testifying in this case as an officer and
Vice Chairman of Lupa Realty Incorporated.
8. Q: Are you familiar with the Board Resolution which
is the subject matter of this case?
A: I only came to know of the existence of the alleged

Board Resolution upon the filing of this case.
9. Q: Do you know what the board resolution

contains?
A: Yes. Upon receiving a copy of the complaint, I

learned that the Board Resolution allegedly signed by the
Board approves of monetary payments by the company to
Johny walker.
10. Q : Did you and the board made the board resolution?
A: No. I do not recall any meeting held by the Board

for such purpose nor do I remember approving any Board
Resolution for that matter.
14. Q: Is the signature above your name on the Board

Resolution genuine?
A: Yes. That is my signature.
15. Q: How come your signature is in the Board

Resolution if you did not approve of it?
A: Johny Walker had one of our employees to insert
the Board Resolution in the files on my table for signing. I
overlooked it since the file is placed in the middle of a bunch
of files waiting for my signature.
16. Q: What happened next?

A: Johny Walker was able to obtain my signature
through fraud.
17. Q: Anything else?

A: Yes.
I hereby adopt into this judicial affidavit, by incorporation

and reference, all the allegations and arguments contained
in our Answer with counterclaim and all the supporting
documents annexed thereto, the same to form part and
parcel hereof.
18. Q: Anything else?
A: Yes.
I hereby manifest that, during the trial on the
merits of this case, we intend to present additional
corroborating witnesses to prove our claims and
prayers in the Complaint.
