INTRODUCTION

The Occupational Safety and Health Act 1994 covers a wide range of basic safety, health and
welfare issues and apply to most workplaces (with the exception of those workplaces on board
ships or armed forces). As we find an article about an accident happen in workplace at Malaysia
we find an article that interested to be our case study. We agree to choose an accident that happen
at Jalan Raja Chulan, Kuala Lumpur which is a woman killed after crane hook falls onto her car.
From the news it is understood that the incident occurred at 7.20pm. The hook, which was
attached to a crane at a nearby construction site, is believed to have detached and fell onto her
Perodua Kelisa. The accident believes to happen on 25 August 2016, The victim is identified as
Chin Khoon Sing, 24, from George Town, Penang. Chin, whose car was stationary in the traffic
jam, was killed instantly. The construction site is believed to be part of the Pavilion shopping
mall. It is learnt that the hook weighs about a ton. We believe this accident occurs because of less
awareness about safety procedure that state in The Occupational Safety and Health Act 1994.

SUMMARY OF CASE STUDY RELATE TO ACT 514,139,127.

As we study this case we found that the act 514 is an Occupational Safety and Health Act 1994.
Which is the main objective of this act was:
1.

For securing the safety, health and welfare of persons at work.

2.

Protect persons at a place of work other than employees.

3.

Promote a suitable environment for persons at work.

4.

Enable previous legislation to be replaced by regulations and approved industry codes of


practice operating in combination with the OSH Act 1994.

While act 139 was Factories and Machinery Act 1967 and act 127 was Environmental Quality
act 1974. Our case study was related to the act 514, act 139 and act 127 which is we believe this
accident occur because of failed and no procedure been apply to protect persons at a place of
work other than employees. We also believe that this accident occur lack of following the act 139
to make sure the crane hook was strong enough to lift the load. Besides that, it is not possible
that act 127 was failed to follow by employees which is the work been done during rush hour
evening that may causes sound pollution that can causes a misunderstanding between employees
because of minima of sound hearing that finally can causes the accident and kill people.

CONCLUSION

From the accident we identify that it is important to follow safety procedure as state in the act in
a way to protect and prevent accident from happen. The obligation to ensure the safety and health
at work is on those who create the risks and those who work with these risks. It is important for
us to analyze hazard in our workplace at take action to prevent accident according to those
hazard. As the accident that happen from the article we choose, it is believe to happen because of
carelessness of the employees to identify the hazard. The work should not have been done on
rush hour of evening because it is increases the risk of accident that may kill someone. The
employees should also to make sure the hook, which was attached to a crane can afford the load
and strong enough. The important to follow the act that already been guide in act 514,139 and
127 because it is clearly already guide us how to prevent those accidents from happening. We
should also have applied it in our working life in Malaysia in order to create safety culture in our
country by year of 2020.
