WHEREAS, Republic Act 7160 otherwise knovn as the Local Government Code
of 1991 etnpowers the Sangguniang Panlungsod as the legislative body of the city to
enact ordinances and appropriate funds for the general welfare of ~he city.
WJIEREAS, Section 458, (a) (5) (ii) and (v) of the l.ocal (Jovcnunent (~'ode
en1po\vers the Sangguniang Panlungsod lo approve ordinances which shall ensure the
efficient and effective delivery of basic services and Jaci!lties as provided for under
Section 17 thereof and to establish markets, slaughterhouse, pllblic ter1ninals and
authorize the operation thereof by the local governn1ent unit;

ILOJLO CITY LOCAL ECONOMIC ENTlCRPRISE OFFICE
Section 6. Creation of the l/oilo City Local Economic Enterprise Office. - There is
hereby created a I.ocal Economic Enterprise Office which shall exercise direct,

enterprises and the personnel thereof, including those conreming the n1aintenance,
upkeep, and peace and order of and within the pren1ises of et:ono1nic enterprises in

CHAPTF,RJ
SUPERVISION OF MARKET~, SLAUGHTERHOUSE AND TERMINALS
Section 8. City Market Administrator. - There shall be a City Market Adrninistrator
under the Local Economic Enterprise Office and who shall be designated by the City
Mayor. The Market Administrator shall exercise the following powers, namely: monitor
and enforce all laws and regulations dealing with the lloilo City public markets,
slaughterhoi1se nnd public terminals; ndn1inister the l~ase of all co1nn1erciol 'ltall.s and
preparation of such documents; recommend to the City ,V.ayor such 1natters as may be
necessary for the development of the City puhlic markets, slaughterl1ouse and public
terminals; and exercise full control of the administrative direct~on of all market and
slaughterhouse personnel. The City Market Admini.<>trator s;1all have the following duties
and responsibilities:

Section 10. Otlter Market Personnel. - Other n1arke-t personnel as n1ay be deemed
necessary may be appointed in accordance with the i:xisting Civil Service I~.ules and
Regulations.
Section 11. Exhibition of Cash Ticket and O[!icinl Receipt. - It shall be the duty of tho
market stallholders, occupants of spaces or tables or kiosk. to exhibit in public yiew the
cash ticket or official receipt to facilitate inspection by the City Market Administrator or
his authorized representative.
Section 12. Aut/tority to Sell in Public Markets. - No person shall sell or of_:_"er for sale
any article or merchandise in the public markets or in any market stall/space/table or
kiosk without having been previously authorized by the City Market Administrator or his
r.uthorized representative.
CHAPTER4
AWARD/ADJUDICATION OF STALLS, CONDITION OF LEASE
Section 13. Applicability. - This chapter shall apply only to new stall vacancies
occurring after the enactment ofthis Code and shall not in anyway affect the existing stall
assignments in all Public Markets in the City of Iloi'.o.
Sectio11 14. Market Committee. - There is ht:reby created a perrnanent Market
Cominittee to be composed of the City May0r as Chairrnan or l1is duly authorized
representative, with the following as members: (a) the City Treasurer; (b) the Chairman
of the Committee on Markets and Slaughterhouse of the Sangguniang Panlungsod; (c) the
City Market Administrator~ (d) the City Legal Qf;"1cer; and (e) a representative of tl1e
Market Vendors Association to be appointed by the City Mayor. rhe members of the
!l'farket Committee may desigrlate a permanent alternate to act in their behalf. The Market
Committee shall decide 0:.1 :he award/adjudication of vacant or newly-constructed stalls
in all City-owned public markets to qualified apolicants and shall perform tl1e following
functions:
a) Conduct the drawing of lots aud opening fOr the adjudication of vacant
or newly~constructed stalls or booths in the public markets and certify
the result thereof to the City Mayor, based on the rules anri regulations
to be adopted;
b) Designate a Market Secretariat;
c) Adjudicate the transfer of stallholders fron1 one section tn another, or
from one stall to another, and;
d)

Section 15. Adjudication of Stalls. - (Notice of \1ai:.:anry). 'l'hc City Mayo: or his
representative shall cause a notice of vacancy of vacant or newly co;1structed stalls in the
public n1arket to be posted at the following places for a period uf not less than ten (10)
days imm..'!di:ttely preceding the date -D.xed for their award to qualified <.lpp!icants to
apprise the public of the fact that such stalls or booths are unoccupied and available for
lease: (a) at the vacant stall; (b) at the bulletin boa;d of the l'ity I-fall; and (c) a

Section 16. Applicf!tion to Lease Market Stall. - All applicants for vacant o~ newly
constructed market stalls shall have the following minimun1 qualification: (e.) Filipino
citizen; (b) eighteen (18) years of age; (c) not legally in.::apacitated and; (d) resident uf
lloilo City for at least six (6) months prior to his/her application as shown by the requisite
barangay certification and voter's ID.
An application fee shall be collected fro1n r:ach '1pplicanl to cover the necessary
expenses rt~lative to the award and leased of the stall. An upplication shall be furni.>hed to
the applicant who shall accomplished under oath and submit the same to the Market
Administrator together with his/her barangay certification, voters ID and two (2) piec~s
of JD pictures. It shall be the duty of the Markel Ad1ninistrdtor to keep a registry of books
showing the names and addresses of all applicants for vacant stall/booth/table, the
numbers and descriptions of the stall/booth/table applieJ for by them, and the date and
hour of the receipt by the officer to acknowledge receipt of the application, setting forth
therein the time and date of receipt thert'of.

Section 19. Authority to Modify the Form oj the Lease Contract. 'fhe Market Conunittce is
hereby authorized to modify the form of and add terrns and conditions to the l,ease c:ontract
which may beneficial and advantageous for the C:ity Government withou1 the necessity of
amending this ()rdinancc.
Section 20. Authority to Sign the I.ease Contruct. l'he ('ity Mayor is hereby authorized to enter,
sign and execute the Lease Contract without the necessity of securing another authority ffom the
Sangguniang Panlungsod, however, the signed [,ease Contract shall be subject to the latter's
confirn1ation.

STALL OCCUPANCY

Section 24. Requisite After Grant oj Stalls. -- rrhe success ft ii applicant shall furnish the
City Market Administrator two (2) pieces of his/her picture immediately after the award
of lca.<>e. It shall be the duty of the City Market Administrator to affix copy of the picture
to the application and another copy to the record card for the purpose.

Section 25. J?orjeiture of Rig/1/s. - Failure lo oc1.:upy the award.:d stall within ~ixty (60)
days after the drawingJots shall n1ean automatic furfeittire of the right and privilege ~o
the said stall.
Section 26. Transfer. - Stalls may be transferred from the original owner only after the
lapse of six (6) months from the effectivity of the contract provided, a transf~r fee and
Good.will Money are paid by the transferee. Transfe1 in violation of this Section shall be
considered null and void.
Section 27. Vacancy of Stall Before Expiratio11 of the lease. - Should for any reason a
lessee discontinue or be required to discontinue his/her ~)USiPcss hetOre l1is/her lease of
the stall expires such shall b~ considered vacant <tnd its occupancy therc.1fter shall be
dispensed of in the manner prescribed in this Code.
Section 28. Partnership with Stal/holder. - A n1arkct stallholder \.vhv enters into
business with any party after he had acqL.ired the right to lease such stall 11ave no
authority to transfer to his partner (s) the right to occupy the stall aftd shall be st;bjcct to
the provision of Section 24 of this Code. Provided, however, that in ..:ase oi'death or any
legal disability of such stallholder to continue j,1 his business occupying the stall for a
period of not exceeding sixty (60) days within which to wind up the busin::ss of the
partnership. If the surviving partner is otherwise qualified to 1)cct:py a market stall u:ider
the provision hereof and the''spo~1se, parent, children and re!.itives wilhin the sixth degree
of consanguinity or affinity of the deceased is 11ot applying for the stall he shall be given
the prefcrencL:to continue oc~upying the stall/table concerned if he applies th<."!ref;)re.
Section 29. Death, Disability or /11capacity of 5tal/lto/,1'(r. - lJpon the death, disability
or incapacity of the lawful holder of the stall/booth in <he public n1arkets or the City of
lloilo, all his rights and privileg.:s previously acquin.-d shall be transniitted to the
tOllowing order: (a) surviving spouse; (b) legitin1ate children; (c) ~he father or niot:1er of
the occupant of the stall and; (d) relative within the sixth degree of consanguinity in the
order nearest to the s;allholder.
Section 30. Lessee to Personally Ad1ninister Stall. - Any pers0n who has been av,rarded
the right to lease a market stall/booth in accordance with the prt)visions hereof, shall
occupy, administer and be present personally at his/h<.:r staJl/l)'Joth. t>rovided, however
that he1she may employ helpers including but not lin1it<.:d to the spouse, children and
parents of the stall holders who are actually living with hin1 and who are :lot disqualified
under the provisions hereof; Provided further, that the per<;ons to be en1ployed as helpers
shall, under any circumstances, be persons with who1n the stall holder has any
co1nmercial relations or transaction. The stallholder siiall be responsible for the actions of
his helpers.
Section 31. Number of Stal/ leased to Eac/1 Ft1111ily. - Nun1ber of stalls leased to each
family shall not exceed one. No fatnily shall be allowi.:d to have 111orc than one stall. For
purposes of this Section, family relations shall in~lude ti1ose betvel'n husband and wife,
parents and children (legitimate or illegitim1te), and brothers and sisters (half or full
blood).

Section 32. Dummies/ Sith-Lease of Stalls. - ~Jo lessee of any n1arkct stall/booth shall
sublease the whole or part thereof. In any case where the person, required to be the ho!d~r
or lessee of a stall/booth, in the public n1arket is found tn be in reality nut the persons
who is actually occupying said stall/table, :he lease sha~l t:Jnce\led and the stallholder
eJected If upon investigation such stallholder shall be found to !,a Ve sub-li.:aset~ his/her
stall/table, to another person or to have connived with such person so that the latter may
for any reason not be able to occupy the said stall/table said lease :;hull also be cancelled
and the stallholder ejected. 1'he stall shall be declared vacant and adjudicated
accordingly.
Section 33. Disqualification by reason of con11n1111icable tfisenSt'. - No person sufl'ering
i'rom any conmunicable dis~ase shall b-e pern1iued to engage in business in ar.y public
n1arkct or n1ay be cn1ployed therein in any capacit)'.
Section 34. Forward Movement. - When a stall or s~rics of stall bccon1c vacant, the
adjoining stall holders shall have the preference to the le:1se or occupation of the vacant
stall/table in which case the OCl:Upant of stall located in the line ~'tall(s) concerned, n1ay
move forward toward the comer stall; provided, however, that this section shall not apply
to stallholder who arc not citizens of the Jlhilippines. Provided, furthcrn1orc. that the total

Section 35. Occupation of .Stall\. - Stallholders shall nn! be allowed to occupy stalls or

Section 36. Losses or Damages of Stallholders. - 'l'he l'ity shall not be respon:--ible to
stallholders for any losses or dan1ages which said stallholders may incur in the public
1narkets by reason of fire, theft, and other causes, for any n1erchandise or property left in
the public markets during the hours the public n1arkets a:-.: closed and it shall be the duty
of the City Market AJministrator and his subordinates 10 exercise reasonable diligence
and care to prevent such loss of private and public propcity therein, .tnd for these purpose
apprehend and tum over to the police any person or per:>ons con11nitting uny offense in
th!.! City Public Markets.
Section 37. Risk of ~Stull Occupants. - 'fhc C'ity of lloilo shall not bi.: held responsible
for any dan1age or J(lSS of articles or n1crchandisc in th.: public 111arkct~. that n1ay be
occa:::;ioned by fire, theft, or other causes, and at! such anicles nnd nlerchandise deposited
tl1erein during the time the markets are closed, shall be at ~he risk of the n1arket occupant;
provided, however, that it shall be the duty of the policen1an detailed thereat as guard to
take such precautions ,1s may be necessary to prevent any da1nage or loss to property.

Section 38. General Mai11tena11ce of Public flrlarkets.
a. Every public market shall be adeq11ately lightLd and ventilated, the ground
surface shall be properly drained and paved, .ind at! stands, stalls, tables and
market fixture and building shall be constrt1cted in accordani.:c with the
necessary plans and specification rccon1111ended by the City Market
Administrator approv~d by the City Engineer nn<l the City Mayor.
b. All electrical connection for 111arkct u!!cys, passag(~\uys and City ()ffices
sh:11J be scr,arate connection and llleh:r \Vhich shall hl' \hL' resputlsihi]i!y of the
City (Jovcrnn1cnt.
c. Any vendor or occupant of n1arkct stall/tab IL' \vno desires to have electric light
or co11nection installed for his/her stall/booth shall furnish the n1aterial and
labor and that the instnllation be under the direct supervision and aprroval of
the Market Electrician. Any electrical connection not duly approved by the
Market Electrician shail be considered an illegal connection and shall be
removed and confiscated by mJ.rket personnel. Violation of this provision
shall be considered as a ground for ca1,ce[[a',ion or revoca~ion of the I~ease
C0ntract.
d. It shall be proh"~ite<l for a stallholder to use or tap the electrical connection of
another stall/booth of consent to be used or tapped for use of his/her own
electrical connection for the use or another stall/booth without the approval of
the Market Adn1inistrator and Market Electrician. Any electr1cal connection in
violation of this provision shall be considered an illegal c;onnection unC shall
be removed and confiscated by n1arket pcrsci:ncl. Violation of this provision
shall also be considered as a ground for cancellation or revocation of the
Lease Contract.
e. It shall be absolutely prohibited, except in the :ase when the electric light fails
for any vendor, or occupant of the stall/table or n1arket space to use any kind
of light except that which is furnished by the ('ily Govern1nent.

Theft of electricity shall be dealt with in accn<dance with Republic Act No.
7838 otherwise known as the Anti-f:Jcctrici!y and Electric 'frat1sn1ission
Lines/Materials Pilferage Act of 1994.
Section 39. Sanitary Maintenance. - The sanitar) regulations provided in this section
and those which may be promulgated by the City l-Jealth Officer for the sanitary

Section 40. Water. -1'he water consun1ption of each stall holder s:1all be their exclusive
responsibility and directly connected tp the niain v.rater pipeline of Metro lloi!o Water
District (MIWD). In no case shall the City Governn1cnt be held liable fOr any disruption
of water supply, nor unpaid water bill of any stallholder. Provided, howi.:vcr, th<'! tile City
shall provide water frJr the necessary 111aintenance, sanitation and cleaning of public
niark:;ts and other public enterprises.

Every market shall be conveniently divided intt1 section according tc the kinds
of nlerchandise offered for sale, and the sale r,f n1erchandise pertaining to one
section shall not be allowed in other section; provided, that the City Mayor for
the good of the public n1ay grant temporary pcr1nit not t~ excel.!d thirty (30)
days, to sell merchandise pertaining to one Sl.!ction into another secti0n until
after said public goods shall be been satisfier:, but the power to be exercised
must be done with utmost prudence. Every stallholder shall have at his O\'ID
expense a sign board which must be uniforn1 in size and style, '>ubject to the
approval of the City Market Administrator.
b. No person sh:ill alter, dis:Eg ure, and/or change the structure of any stall or
n1arket fixture witl1out the written pern1ission from the Cit) Market
Administrator and a pennit fee to renovate shall be paid at the Oflice of the
Market In-Charge.
CHAPTER 7
RESTRICTION ON MARKET l'IU:MISES
Section 42. Prohibition to Tlrrow Garbage. - It is prohibited to thro\V garbage, refuse or
waisc materials other than in the garbage can providc.d for the purpose by each
stallholder. In case responsibility cannot be ascertuinc<l for unlawfully throv.:ing such
garbage, the occupant of the nearest stall/space/tJ.bl~ or kiosk sh:lll be required to deposit
the same in the garbage disposal area. Violators ~viii be punished in accordance with
Regulation Ordinance No. 2004-149 otherwise kno\vn as th..: "!/oi/o ('i(\I Er:viron111ent
Code of 2004."

Section 53. Disqualification to Lease. - Should a stallholder be ejected fron1 his stall for
cause, as provided for in this Code, he/she shall be disqc1alitied fron1 the leased Jf said
stall or any other stall in any public market of the (:ity for et period of two (2) years.
Section 54. Nuisance. - No person shall con11Y1it any nuisance, con1n1it disorderly
conduct, obstruct public market passageways and sidev..-a~~.;:s or do any other ac~ which is
calculated to result in breach of peace. All articles displayed in any public market in
violation of any provision of thi'i Code or any rules and regulation related to the
111anagen1ent oftl1e Cily Public Markets shall be decn1cd a nuisnncc. It shnll l)e the duty
of the ('ity Market Adn1i11istrator or f1i:' rcprcsenlativt:s lu take custoJy, and confiscate
said goods/articles and/or remove all obstruction:, of rnissa~eways and sidewalks, in
addition to the penalty imposed in this Code.
Sectio11 55. Loafing, Loitering a11d Begging not Pernritted. - No person not having
lawful business in or about any public market shall idly sit, lounge, walk or lie in or nbout
the pren1ises of the same nor shall any person beg or solicit aln1s in or about any public
111arkets.
Section 56. Sig11hoards for Meat VendorJ. - All 11eat vendors shall hang signboards
showing the kind of meat they are selling or offering for ~ale. No other kind of nleat .>hall
be placed under the sign board 'other than shown thereon. l'he City Veterinarian or his
authorized representative shall sec to it that lhc provisions or this ('ode relative to the
rules and regulation of the National Meat lnspec1ion ('on1n1ission arc Ctln1plicd \Vith
strictly.
Section 57. Obstruction. No person shall an!'oy or obstruct niarket e1nplOyees in the
discharge oftl1eir duties; nor shall any person sit or lie on any 111arket stall or table or play
in the nlarket premises.
Section 58. Stray Animals. - No dogs or ani1nals shall be left stray in any public
markets and the City Veterinarian thru his subordinates are hereby e1npovvered to catch
such stray animals and to impound them in the C'ity pound for disposition as in the case
of other animals in1pounded therein.
Section 59. Littering, Urinating a11d Defecating. - It ~h: 1 ll be prohibi!ed to litter, urinate
and defecate in any parts of the public 11'.).arkets e::cept in duly <lc~ignated pl1blic toilets in

Section 60. Ganibling a11d Other Illegal Acts. - Gambling, in any form. or any other

Sectio11 61. Adequate Attire in P11b/ic Markets. - All vendors in all public n1arkets a::e
required to wear proper work clothes/attire, preferably t ~;hirts/sando and pant'' or short,

skirts/pants/short, or any other dre~s, for won1cn~ and a1iron; in the canteen, vegetables,

public 1narkets shall be charge with ren1als for stall occupancy in accordance with the
rates/schedules prescribed in this- Chapter.
Section 65. Market Fees. - The City of Iloi~o 1nay collect fees or rentals for the
occupancy or use of public 111arkcts and prl!n1 ises in i.~l!curJance \Vilh this C:hapter,
provided, however, that the mai ket fee must be paid in <1dvance before any person can
seil, or offer to sell, co1nn1odity or '!lerchandisc within the public inarket and its
prem1s~s.
a. In lieu of the regular Market Fees based on the space qc~upie<l, a Market
Entrance Fee shall be imposed on all vendors rOr :1ny com1nodity or
n1erchandise being brought into the pubic market for sale on t'ne basis of
weight, bundle, sack, can, cartload, or any other ('.onvenient unit or measures.
b. C2sh ticket shall be issued to the vendor buying the sun1i: and his nan1c shall
be written on the back thereof. 'l'he eash tick.:t shall pertain only to the person
buying the same and shall be good for the '>pace or spaces of the market
premises tu which they are assign while in the hands or the original purchaser.

Section 68. Automatic Increase of Rental Rates. The r.ite of rentals under Section 67 of

Section 70. Permit Fee to Renovate. - Ar1y person who shall alter, disfigure. and /or
change the structure of any stall or market shall secure a \.Vritten permission from the City
M1rket Administrator before paying the Permit fee to llenr,vate of Two llundred Pesos
(P200.00).
Section 71. Transfer Fee. - Any person who applies fer th'! transfer of the award of a
stall shall pay a Transfer Fee of Five Thousand Pesos (P 5,000.00)
Section 72. Goodwill Mt-ney. - Any person awarded n stall/table in the City Public
Markets shall pay a Goodwill Money based on the rates provided under Book IV,
Chapter III of Tax Ordinance No. 2007-016 otherwise !cnown as the "Revised Local
Revenue Code of the City oflloilo" as follows:

CHAPTER9
SLAJJGHTERHOllSE FEES AND CHARGES
Section 75. Slaughterl1ouse-/11-Charge. - There shall bl! a Slaughter-In-Charge for each
Public Slaughterhouse who is under the direct supervision C'f the City Market
Administrator. He shall be in-charge of the slaughterhouse to which he is assigned. He
shall be the custodian of the slaughterhouse and shall have immediate adn-1inistrative
supervision and control over all subordinate slaughterhouse en1ployces who are assigned
to the slaughterhouse where he is In-Cl1arge.
Section 76. Slaughterl1ouse Fee~. -The City ofl!oilo shall collect fees for the slaughter
of ai'1imals and poultry cir the use of corrals in accordan1;e \,rith the rates provided under
Book IV, Chapter VllofTax Ordinance No. 2007-016 other\.vise known as the "Revised

consumption of the public shall be done only at the City Slaughtehouse. The slaughter of
animals intended for home consumption may be done elsewhere except large cattle,
provided, that the animal slaughtered should not be sold or offe;ed for sale.
Section 80. Post Mor~em Fee. -There shall be collected for each kilogrrn.n of animal or
poultry meat, includ~ng tongue, heart, and liver of any ani1nal or poultry a Post Mortem
fee of:

Section 81. Requirements/or the Issuance of Per1nitfor th4! Slaughter of Large Cattle.
- Upon the issuance of the permit to slaughter, ~he large cattle sl1all be slaughtered at the
City Slaugbterhouse. Before issuing permit for the slaughter of large cattle, lhe meat
inspector shall require for branded cattle the production of the certificate of ownership if
the owner is the applicant, or the original certificate of ownership and the e;ertificate of
transfer showing title in the name of the person applying f0r the permit if he is not the
original owner.
If the applicant is not the original owner and ,Lere is no certificate of transfer
made in his favor, orte such certificate shall be issu1:d and the corresponding fee
collectible therefore. For Wlbranded cattle that have not yet reached the required age for
branding,
the n1eat inspector shall require evidence satisfactory to liin1 regarding the ownership of
the animal for which pennit to slaughter has been request.:d. Fr)f unbranded cattle of the
required age, the necessary owner's certificate a11d transfer certificate shall be issued the
corresponding fees collected therefore before the pennit is grarited. The following rate
shall apply:

prevented from being slaughtered if found with a disease or in an abnormal condition:

BUS TERMINAL
Section 87. This Chapter shall govetn the in1position and \.'.ollection of taxes, fees a;1d
other charges in public bus tenninal. The taxes, fees and rates as provided under Book
IV, Chapter VIII of Tax Ordinance No. 2007-016 otherwise known as the "H.cvised I. . ocal
Revenue Code of the City of Iloilo" arc re-adopted in this C'.hap1er.
Section 88. Termin11l-In-Cliarge. - l'he City Markel J\dn1inistrutor shall designate the
Terminal In-Charge and suci1 personnel necessarJ' for the operati~in of the public ter1ninal
and the latter shall be under the direct supervision of the <_'ity Market Adn1inistrator. 'f'1e
Tenninal In-Charge shall be in-charge ofthi: puhlic tern1ir.a! to which he is assigned. He
shall be the custodian of the market and shall have in1n1cdiate adn1ir1istrative supervision
and control over all subordinate tcrminul en1ployees wht arc assigned In tile tern1inal
where he is In-Charge. A market-in-charge may be designated as conLurrent terminal-incharge taking into consideration the size of the public n1arkct and tcnninal und nun1ber of

in1n1ediately preceding Section, the Sangguniang 1>r:.nlungsod shall fix the rates of taxes,
fees and charges after calling for a public hearing on any rroposal under this Chapter.

CHAPTER14
MISCELLANEOUS PROVISIONS
Section 99. Business Hours. The stall holder shall conduct his business in the leased
stall/booth during hours fixed by the Market Administrator. Should there be any change
in schedule, the stall holder shall be duly notified prior to its effectivity. Posting of the
notice at the entrance of the public market and.bulletin board shall be deen1ed sufficient
compliar1ce of this Section.
Section 100. Collection. - Collection of rentals, fees, and other charges shall be
undertaken by the City Treasurer or his representative, to be evidenced by tl1e .:iecessary
Official Receipt. All collection shall be remitted daily to the (~ity Treasurer's Office.
CHAPTER IS
PENAL PROVISIONS
Sccti9n 101 Surcharge and Interest. -There shali he impvsed a surcharge of not more
than twenty five percent (25o/o} for the late payment of rental, light and other fees and dl1
interest of not exceeding t~o percent (2o/o} per month of the unpaid amount including
surcharges until such amot1.nt is fully paid but in no case 'ihall the total interest on the
unpaid amount or portion thereof exceed thirty~six (36) months.
Section 102. Non payment of reniats and othe:,. fees. Any stalll1older who fails to pay
any market rental including inte~ests and surcharges for al Jea::.t three (3) months shall he
automatically ejected from the leased premises in accorda.:1ce with the lease contract. A.i1y
stallholder who fails to pay any light and/or vater fees including interests and surcharges
for at least one (1) month shall authorize the market rersonnel to disconnect his electric
and/or water connection in accordance with the lease contract. Nonpayment.of market
rentals and electric and/or .water fees shall likewise be grolu1ds for revocation of the lease
contract.
Section 103. Cancellation of Lease and Ejectme11t. - Any stallholder, his/her helpers
who v;olates any provisions of this Code shall be sufticient cause for the revocation of
his/her lease ~ontract and shall be ejec.:ed from the stall/table or space so occ.upied in
accordance with tl1e Lease Contract. The revocation or cancellation of such lease contract
may be er"'fected by the City Mayor upon recom1rendation of the City Market
Administrator after observance of due process.
Section 104. Penalty. - Any pe:son found guilly of violating any nrovisions of this Code
shall immediately be apprehended and be meted a fine of not less than One Thousand
Pesos (Pl ,000.00) or imprisonment of one (I) month but not niorc than six (6) months or
both, at the discretion of the Court.
Section 105. Administrative Penalty. - Any person caught in t:1e act of violating any
provision of this Code shall be subjected to the confiscatiPn and forfeiture of his
con1mercial goods or articles and the same. shall constitute a ground for closure and
cancellation of his business permit.
Section 106. Con1promise Penalty.- Before a case :s fih:d in court for any viPlation of
this Code. the City Market Administrator, as authorized by the City Mayor, is ULLthorlzed
to settle an offense which does not involve fraud, t!ic offender n1ay be allowed to pay a
con1pro1nise settlement fee of One Thousand Pesos (P 1,000 .00) with the obi igati\lll on the
part of the offender to pay any and all unpaid tax, fees and charges due hitn as proYided
under this Code and other ordinances. This provision V:ilJ not apply to acts i.:un1n1itted
which are punishable under the Revised Penal Code ;:nd other ~pecial !aws.
