For and on behalf of the President of India, Senior Divisional Commercial Manager, South
Central Railway, Vijayawada Division invites applications from eligible/interested Indian
Nationals above the age of 18 years for appointment of Jan Sadharan Ticket Booking
Sewaks (JTBS) at the following Railway Stations for issue of un-reserved Rail Tickets
through computerized Unreserved Ticketing System (UTS). The last date for receipt of
applications is 26.01.15.
The details of Reservations system, and locations / stations to apply the eligible candidates

Salient features:

1. Provision of 1(one) UTS counter per JTBS, in the location / area for dispensing
unreserved tickets.
2. JTBS will be permitted to issue all type of cash tickets (including advanced and
cluster tickets) only. They will not be permitted to issue concessional tickets, blank
paper tickets and money receipts.
3. Cancellation and special cancellation of tickets is not permitted at the JTBS.
However, cancellation is permitted at the serving station or over the cluster, as per
the rules in vogue.
4. JTBS collect Rs.1/-(Rupees One only) per passenger as commission from the
passenger.
5. Each JTBS is to be attached to a serving station, which will be responsible for
collection of Railway revenue and issue of ticket rolls to the JTBS.
6. JTBS will procure and maintain all hardware (system, telecom & electrical)
equipment at his location. In addition, the cost of hiring channels and consumable
for operations of the location will be borne by him.
7. The scheme envisages that the JTBS agent will bear the initial and recurring cost of
the equipment and channels.
Eligibility Criteria:
1. Applicant must be 18 years of age &should be at least metric pass or
equivalent. Any relaxation in educational qualification is within the purview of
divisional authorities.
2. Applicant should produce a character certificate (issued not before 06 months)
from the District Magistrate/ Additional District Magistrate/ Block Development
Officer or Tahsildar. The applicant will also have to produce a certificate from the
police station serving his/her locality that no criminal case is pending against
him/her.

3. Applicant should be residing in the municipal limits or the city/ district in which JTBS
is being appointed
4. The premises selected for issue of UTS tickets should have easy accessibility to all
citizens and near to the station .Applicant should have a telephone
connection in his office.
5. Applicant should be residing in the Municipal limits of the city/District served by the
station and should produce his residential certificate with the applicant form.
Preference will be given to the person who have their own accommodation.
6. Applicant should submit affidavit showing financial status on Rs.10/- stamp
paper with proof along with the applicant form.
7. Preference will be given to the persons who are in business field and public regularly
visit the shop.
8. Not more than application shall be accepted from any individual.
General Conditions:
1. JTBS will be required to deposit an advance deposit (with no upper limit) with the
serving stations and tickets can be issued by him till amount against this deposit is
available.
2. To make a JTBS operational, JTBS has to bear the following expenses
1) Applicant should be prepared to deposit an amount of Rs.5,000/- towards
security deposit and Rs.20,000/- Bank Guarantee to the Railway Administration
after allotment. In any case the JTBS operator express inability to operate JTBS,
after appointment as JTBS operator by the Division the Bank Guarantee as well
as the Security deposit made by him will be forfeited.
2) He has to bear the cost of BSNL/any other service provide telephone.
3) JTBS has to deposit with Railway the prorate cost of terminal server, main server
and installation/ commissioning charges of the equipment at his premises. The
approximate cost will be about Rs.20,000/- per JTBS which non refundable.
4) Initial equipment to be procured by JTBS as per specifications provided by
Railways are Dial up modems with accessories, Dumb terminal, Ticket printer,
Report printer. The initial approximate cost of the equipment will be about
Rs.42,500/- per JTBS.
On Successful completion of contract period, if any pending dues, that will be
adjusted from the security deposit.

JTBS will be responsible for implementing all the procedures and conditions that
are being prescribed by the Railway Administration from time to time
JTBS will not issue tickets from station premises.

The competent authority of an officer authorized by him shall render all necessary
assistance for inspection. A summary of transactions daily/periodical/monthly made
by the JTBS shall be given by him to the serving station.

Appointment:
a) The Railway decision in this regard to appoint JTBS for issue of UTS tickets from
amongst the applicant shall be final and Railway reserves its right to reject any
application without assigning any reason. No canvassing or correspondence in
this regard will be entertained from unsuccessful applicants.

b) Applicants of JTBS will not confer any right on the persons for employment on
Railways. The applicants of JTBS will not confer any right on the persons for
employment on Railways. The appointment is purely contractual in nature and no
facilities viz. absorption in Railway service, regularization of service, Bonus,
Railway passes facility etc. shall accrue to the JTBS.

Period of contract &Termination:
Initial period of contract will be for a period of 3 years, which can be extended yearly on
basis of satisfactory performance for next 3 years. Each side can termination the contract
without assigning any reason by giving one months Notice, fresh applications will be called
for in which the existing JTBS will also be eligible to apply.
Arbitration: Divisional Railway Manager, S.C. Railway, Vijayawada will be the final
authority for resolving any dispute between JTBS and Railway Administration.

The last date of receipt of applications is 26.01.2015 up to 15.00 hrs, if the last of receipt
of applications falls on holiday the next working day will be considered as last date of receipt
applications.
Applications received after 15.00 hrs of 26.01.2015 will not be accepted/entertained under
any circumstances and Railway will not be responsible for any delay on postal/courier
account.

MODEL A G R E E M E N T FOR JTBS
This agreement is made this _______day of __________________________
between the President of India acting through the Senior Divisional Commercial Manager,
Vijayawada Division, South Central Railway (hereinafter called the Railway Administration
which expression shall include his successors and assigns) of the one part.
Whereas
the
Railway
Administration
has
appointed
the
JTBS
at
______________________________________________________________, served from
________________Railway Station for the purpose of issuing all Unreserved Ticketing
System tickets except concessional tickets. And whereas the JTBS has agreed to serve the
Railway Administration in the capacity of the JTBS for the above purpose and to engage
honestly and faithfully to perform all duties incidental to the office of such JTBS on the
terms and conditions herein after appearing in this agreement.
i.

The JTBS shall be deemed to be the agent of the Railway Administration and shall be
subject to all the legal liabilities of agents as are laid down or defined in the law
relating to agent in India for issuing tickets to the passengers.

ii.

One terminal per JTBS will be allowed.

iii.

As in the case of normal functioning of UTS, JTBS shall also working round the
clock.

iv.

Should the JTBS fail and/or neglect at any time to arrange for uninterrupted service
in the sale of ticket as per working hours uninterrupted service in the sale of tickets
as per working hours prescribed by the Railway Administration, the later shall have
the right to engage its own staff to work at the agency and all expenses incurred in
connection with the above and any other expenditure incurred by the Railway shall
be recoverable from the JTBS.

v.

The Railway Administration shall give publicity to the service covered by this
agreement in such manner as may be decided by them and the publicity that the
JTBS desires to undertake in this behalf shall be subject to the approval of Railway
Administration.

vi.

Appointment of JTBS will not confer any right on the person for employment in
Railways. The appointment is purely contractual in nature and no facilities viz.,
absorption in Railway service, regularization of service, bonus, railway pass facilities
etc., shall accrue the JTBS.

1.0

BREACH OF THE AGREEMENT AND SERVICE OF NOTICE

1.1

In the event of breach of any of the terms and conditions of this agreement by the
JTBS, his servant or any person acting for the JTBS at any time failing to perform all
or any of the services required of him by this agreement within a time or in a
manner satisfactory to the Railway Administration without prejudice to any other
right, remedy or relief to which the Railway Administration be entitled under this
agreement or any law for the time being in force, revoke and determines this
agreement after the expiry of one months notice in writing to be sent by registered
post or delivered to the JTBS of their intention of doing so.

1.2.

The Railway Administration may also terminate the agreement forthwith by writing
under the hand of the Sr.DCM of the Railway Administration if the JTBS becomes
bankrupt or insolvent or has any execution levied upon him or his goods or property
belonging to him. The JTBS shall stand forfeited all the money belonging or due to
him from the Railway Administration.

1.3.

Except as otherwise provided for in Clause in 9.0 either party of this agreement may
determine the same upon expiry of one months notice in writing given to the other
of its intention of doing so.

1.4.

Save as otherwise provided in the contract, all notice to be given on behalf of the
President of India, Union of India and all other actions to be taken on his behalf may
be given or taken on his behalf by the Sr. DCM of the Vijayawada Division of South
Central Railways or any officer mentioned in Para 1.0 of this agreement.

1.5.

Any notice, letter or other communication, which shall be sent by the Railway
Administration by Registered post addressed to the JTBS at his head office at
Vijayawada, be deemed to have delivered to the JTBS.

2.0.

JTBS TO PAY PENALTY FOR BREACH OF AGREEMENT:

2.1

Should the JTBSs performance in respect of booking of passenger, to be rendered

by him under the agreement is considered unsatisfactory by the Railway
Administration or there is a failure on the part of the JTBS to fulfill all or any of the
terms and conditions of the agreement, the Railway Administration or any other
authorized officer by the Railway Administration shall have power to impose penalty
up to the extent of Rs.1,000/- (Rupees one thousand only) in each case, in addition
to any other liabilities to which the JTBS may be liable under the provisions of the
agreement.

2.2

In the event of the JTBS failure to pay the penalty so imposed within the time fixed
by the Railway Administration in each case, it shall be lawful for the Railway
Administration/Sr.DCM to deduct the amount of such penalty from the Security
Deposit or advance of the JTBS. JTBS shall forthwith deposit the sum equal to the
amount recovered in accordance with clause 3 of this agreement, if such amount is
recovered from the security deposit.

3.0

SECURITY DEPOSIT:

3.1.

The JTBS shall forthwith deposit with the Financial Advisor & Chief Accounts Officer,
South Central Railways, a sum of Rs.5,000/- (in the form of FDR of any Nationalized
Bank) refundable interest free security deposit and Rs.20,000/- Bank Guarantee of
the Railways for the due fulfillment of each and all the said terms and conditions to
be observed by him.

3.2.

On completion termination of the contract pending dues will be adjusted from the
Security Deposit and balance refunded to JTBS.

3.3.

The Security Deposit is liable to be adjusted or realized towards payment of any

amount due to the Railway Administration by the JTBS including the penalties and
where this is done the JTBS may, at the discretion of the Railway Administration be
allowed to commence sales only after the JTBS has provided further security equal to
the entire amount of security required and on giving suitable guarantee for the
future. The Railway Administration shall not be liable to pay interest on the security
deposit.

3.4

Tickets would be issued against the amount of advance deposited for the purpose,
which should be replenished each time before issue of ticket when the advance
deposit touches Rs.10,000/(Rupees Ten Thousand only).

3.5.

The JTBS will be penalize up to Rs.500/- in case of non-payment of Railway dues

within the prescribed period. Any failure on its part may lead to the cancellation of
agreement.

4.0

PROCEDURE FOR KEEPING A RECORD OF TICKETS USED BY JTBS:

4.1

JTBS will procure UTS terminal for which all the initial cost as well as recurring
including equipments & channels hiring would have to be borne by JTBS.

4.2

JTBS will collect Rs.1/- per ticket as commission from the passenger.

4.3.

JTBS will be responsible for the safe custody of the ticket rolls. In case of any loss
on his account necessary debits will be raised against him/her as per extant
instructions.

4.4.

Proper record of ticket rolls issued to JTBS will be kept by the Commercial
Department of the station serving the JTBS.

4.5

JTBS will submit the account of sale of tickets to serving station on daily basis along
with value of tickets sold.

4.6

Proper account of UTS ticket stationery be ensured.

4.7

JTBS will be authorized to issue cash ticket only.

4.8

JTBS will submit a daily statement to the Station Master/Manager or any other
nominated officer indicating the details of tickets sold along with the value. Station
Master/Manager or any other nominated officer will maintain proper record of daily
sale of tickets by JTBS.

4.9

A consolidated statement of ticket rolls supplied to any details of tickets sold by JTBS
will be submitted by Station Master/Manager or any other nominated officer to
DCM/Sr.DCM every month.

4.10.

JTBS will not issue tickets from Railway premises.

4.11

All computerized tickets wrongly printed or wrongly issued or otherwise are classified
as Non-Issued. In case of above problem/defects, the operator can non-issue the
ticket by pressing a single key provided in the key board i.e.(,),Non-issued
transactions should immediately follow the transactions which are being non-issued.

5.0

REFUND
Refund of tickets issued by JTBS will be done by serving station as per refund rules
in force. The genuineness of the tickets issued by JTBS will be checked by the
station staff before making refund. JTBS will not be authorized to make any refunds.

6.0

INSPECTION AND AUDIT OF THE RESULT AND ACCOUNTS OF THE AGENCY

The books and the account of the JTBS shall at all proper times and places be
opened to the inspection and internal check of the Chief Commercial Manager/Chief
Accounts Officer/Chief Auditor/Divisional Railway Manager or any other officer or
official deputed by them in the same manner as is customary in the case of books
and accounts maintained at the Railway Station on the South Central Railway.

7.0

SUBLETTING:

7.1

The JTBS will not sublet, assign or transfer the rights or obligations arising out of the
contract.

7.2

The JTBS shall not sublet, assign or in any manner transfer any other person the
whole or any part of the rights or obligations conferred or imposed upon him by this
agreement or any of the business connected with the agency hereby constituted.

7.3

The Railway Administration reserve the right of deduction of the Railway dues from
JTBS in case any fine/payment made
under an order/judgment of any
Court/Consumer forum or law enforcing agency or any person working on their
behalf.

8.0

JTBS NOT TO COMPETE WITH THE RAILWAY:

JTBS shall not compete with the Railway Administration in any way whatsoever,
whether directly or indirectly, by establishing any other agency for carrying
passenger at station during the continuance of this agreement.

9.0

SPECIAL STIPULATION TO BE OBSERVED BY THE JTBS IN CARRYING OUT

THE BUSINESS OF THE JTBS:

9.1

In the events of any question dispute of difference arising under terms & conditions
or any special condition of agreement or in connection with this agreement the same
shall be referred to the DRM if the dispute/ difference remains unsolved/undecided
the case may be referred to the sole arbitrator, a Gazetted Officer appointed to be
arbitrator by the General Manager.

9.2

The JTBS shall be responsible for all errors oversights and under charges made by
the staff engaged by him at the agency or elsewhere.

9.3

The JTBS shall not employ any person previously in the employment of the Railways
Administration without the express sanction of the Railway Administration.

9.4

The JTBS shall be responsible for all claims under Workmen Compensation Act as
well as under the Payment of Wages Act. The JTBS shall indemnify the Railway
Administration with regard to any claim arising out of these Acts.

10.0

DURATION OF THE AGREEMENT:

10.1

This agreement shall be deemed to have come into force on and from _________to
__________ and shall, subject to the provision for earlier termination as herein
provided, remain in force for a period of three years, which can be extended
another three years subject to satisfactory performance of the JTBS.

10.2

Any modification, review and extension of agreement will be made only with the
mutual consent of the parties.

11.0.

ARBITRATION:

11.1

DRM will be the final authority for resolving any dispute between the JTBS and
Railway Administration. The appeal will lie to AGM in Hqrs.

Note:
a) The applicant to be sent through register post should complete in all respect along
with relevant documents, which will be reached to the office of Sr. Divisional
Commercial Manager, South Central Railway, Vijayawada-520 001 on or before
26.01.2015.

c) Incomplete applications will be rejected summarily.
d) No documents will be accepted subsequently after the receipt of application in office.
