AND WHEREAS the VENDOR aforesaid is desirous to sell the said property to the
VENDEE
for
the
total
sale
consideration
of

The Total to be paid to vendor (Paid to Authority + Premium) is of
Rs________________(Rupees____________________________ Only) including service Tax.
The Amount of TDS @1% i.e._____________ will be deducted from the amount paid to
Vendor and the same will be deposited in Income tax Department. The original TDS
certificate will be given to the Vendor on the date of Registry.
Out of which the VENDOR has received an advance payment of Rs. ________________

1. That the total sale consideration of the said property has been settled at
as

service tax in between VENDOR and the VENDEE.
2. Any outstanding dues of the property on or before date of Registry i.e.
any interest charge etc. to be paid by VENDOR to the concern authority
upto the date of Registry.
3. If a good and marketable title is not made out or the Property is found to
be subject to any encumbrances / attachments / charges / other claims /
demands, the VENDEE shall be at liberty to rescind this agreement and
the VENDOR shall in that event and on demand by the VENDEE, refund
double the amount of the advance money Rs. ____________ (Rupees
________________________only)
4. Final payment will be made on the day of Registry _______________.
5. The vendor shall ensure to provide all relevant documents required by
bankers.
6. If the Vendor does not full fill his/her obligation as regarding the
Registry of the said property by ______________then the vendee has the
right to demand double of the Advance amount & Vendee can go to
court for specific performance of contract and get the deal transfered.
7. The VENDEE is empowered to get the property registered/transferred or
get the sale completed through execution of attorney document etc.
either in his/her own name or in the name of his her nominee/s or in
name of any other person for which the first party shall have no
objection.
8. If vendee fails to make the balance payment by the specified period in,
vendor has rights to CANCEL the agreement and forfeit the advance
payment.
9. A copy of all below mentioned documents to be given at the time of
signing this agreement to sale to the vendee to process bank loan. This
is a bank requirement. Incase bank needs any additional document then
vendor has to provide that.
- Allotment letter
- All payment receipts
- Builder buyer agreement
- Demand letter ( if any)
- Statement of accounts
10. All original documents to be handed over to the vendee at the time of
Registry.
