I, FRANKLIN D. LOGARTA, of legal age, Filipino, and a
resident of Basak, Lapu-lapu City, after having been duly sworn to in accordance with law, do hereby depose and say, that: 1.I own the house located at #21 2 nd St. Mountain View, Basak-Quiot, Cebu City, which has been uninhabited for quite some time now; 2.On June 30, 2016, at around 3:00 in the afternoon, I decided to go visit the aforementioned property, just to
check on things. While on my way there and just a few
meters of distance away from my house, I saw four (4) female persons enter into my house who were identified as: NOELA ANTONIA P. LOGARTA JOANNAH REY P. PREDOG MICHELLE G. ABSIN BERMUNDA A. ELVIRA 3.At this juncture, I admonished them not to do so, and when they sensed about my presence, they hastily walked outside of my house, bringing along with them two (2) of my computer monitors that were stocked inside the house; 4.This incident prompted me to call the Cebu City Police Office SWAT Team to report the matter and seek for their assistance and immediate response to the said alarm; 5.A few minutes thereafter, the CCPO SWAT Team led by SPO2 RENANTE NIODA arrived and immediately conducted an initial investigation over the alleged burglary; 6.During their investigation, it was learned that the perpetrators broke the padlock of the gate of my house allowing them to gain access unlawfully without my knowledge and consent; 7.A follow-up operation was there after immediately conducted at nearby the incident, and minutes later in the process, the suspects were eventually apprehended and recovered from their possession and direct control the said stolen items;
8.I then positively identified the apprehended suspects as
the very same persons who were conspiring with one another in the taking of my (2) two computer monitors; 9.I further affirmatively identified that the recovered items were the very same as mine; 10. I am executing this affidavit-complaint to attest the veracity and truthfulness of the foregoing statements and for the purpose of filing a criminal complaint for Robbery with Force upon Things in an Uninhabited Place against the accused. 11.To prove the allegation, attached herewith are the Judicial Affidavit of the undersigned Franklin D. Logarta and SPO2 Renante Nioda as witness.
