INSTRUCTION TO TENDERERS
1.0

These Instructions to Tenderers, in so far as they may affect the execution of the
Contract, shall be deemed to form part of the Conditions of Contract.

2.0

The quotation documents can be obtained from JABATAN KERJA RAYA


SARAWAK (Buildings and Works).

3.0

Each quotation and all accompanying documents and letters must be in English
and must be submitted in a sealed cover, bearing no indication of the identity of
the sender. The cover shall be clearly marked.

4.0

Government of Malaysia (hereinafter called 'the Employer') will not defray


expenses incurred in Quotation and will not be bound to accept the lowest or any
Quotation. No reason will be assigned for the rejection of any quotation.

5.0

6.0

The work or service, for which this quotation will be received shall be carried out
in according with Drawing Numbers as specified together with the General
Conditions of Contract, Bills of Quantities, Specification and such detailed
drawings and instructions as may be necessary during the performance of this
work or service.

7.0

(i)

The Contractor shall state in his quotation ONE SUM for the thorough
completion of works as shown and described in the drawings inclusive of
all contingencies and liabilities to which he is or may become liable
under the said Drawings, Bills of Quantities, General Conditions of
Contract and Specification.

(ii)

The tenderer for works is not allowed on any account to insert any items
or conditions of his own. The ONE SUM above should account for all
terms and conditions as laid down in the Drawings, General Conditions
of Contract, Bills of Quantities and Specification. Any clarifications
must be stipulated in a covering letter and not at the back of the
Quotation Form or elsewhere.

8.0

Tenderers shall visit the Site and shall make, or cause to be made on their behalf,
local enquiries the availability and cost of any plant required, accommodation,
labour, temporary supplies of power, water supply, access, conditions at site, etc.,
and obtain for themselves on their own responsibility all other informations and
must examine the Quotation Document in order to ascertain the matters as to
which they will be deemed to have satisfied themselves and the risks and
obligations which they are to undertake.

9.0

If any tenderer is in doubt as to the true meaning of any part of the Quotation
Document, he should at once notify and request clarification from the Engineer
who shall issue formal addenda, if necessary, to clarify the Quotation Document
or to effect modification in the Document. Receipt of each addendum must be
acknowledged on the Form issued with the addendum. Failure to acknowledge
any addendum may result in the Quotation being rejected. Interpretation of the
Quotation Document will be valid only if made by formal addenda.

10.0

Quotation must be made out on the Form of Quotation included in the Bound
Complete Document containing also these Instructions, Specification, Bills of
Quantities, Summary of Bills of Quantities and Schedules of Particulars.

11.0

The Form of Quotation and the Documents attached to it shall not be detached
one from the other, and no alteration or mutilation (other than filling in all the
blank spaces) shall be made in any of the Documents attached hereto.

12.0

The printed Bills of Quantities shall be used for pricing the Quotation and the
Quotation shall be made on the basis of the rates named in the Bills of Quantities
being firm and not subject to adjustment with variations in wage rates, prices and
materials or any other costs. Every item must be legibly filled in, in ink, by the
Tenderer and with the columns added up, to the exact total amount of the
Quotation.

13.0

The appropriate sections of various Schedule of Particulars following the Bills of


Quantities shall be completed. The tenderers attention is drawn to Schedule B
of the Schedule of Particulars. Tenderers must supply the correct type of
equipment meeting the requirements of the Specification. Failure in supplying
the specified equipment could lead to the rejection of Quotation.

14.0

Workmanship, materials and components throughout shall comply with the


relevant British Standards, or in the absence of an appropriate British Standard,
the relevant American Society of Testing and Materials Standard or Code of
Practice current on the date of closing Quotation.

15.0

The tenderer (whether or not he submits a quotation) shall treat the details of the
documents as private and confidential.

16.0

The Quotation of any tendererer who has not conformed to the foregoing
instructions may not be considered.

17.0

Closing of Quotation - All submissions of Quotation will be closed at Pengarah


Jabatan Kerja Raya, Ibu Pejabat, Wisma Saberkas, Jalan Tun Hj. Openg, 93582

Sir,
Under and subject to the Conditions of Quotation annexed hereto, the undersigned does
hereby quote and offer to execute and perform the Works and provisions and supply all labour
and materials and everything of every kind respectively named, shown, described and alluded to
in, or to be inferred from, the Form of Quotation, Conditions of Contract, Bills of Quantities,
Summary of Bills of Quantities and/or Specification and Drawings to be executed and supplied
on the part of the Contractor, for the works above described in confirmity with the said
Conditions of Contract for the sum named herein below.

The undersigned agrees to be bound by and submit to the said Conditions of Contract and
priced Bills of Quantities, Summary of Bills of Quantities and/or Specification and agrees that the
said priced Bills of Quantities, Summary of Bills of Quantities after rectifications of any errors
herein the undersigned's prices and calculations, as by the Conditions of Contract provided, shall
form a basis for the valuation of interim certificates and any variation or extra works which may
from time to time be ordered by the Engineer.

Whereas it is understood that you reserve to yourself the right to refuse this quotation,

execute the formal Contract Agreement and to deposit with the Employer the Security Deposit
and the workmen's Compensation or SOCSO and Public Liability Policies and produce the

SPECIFICATIONS
1.0

PRELIMINARIES

1.1

The Project
The subsurface investigation, sampling and testing to be carried out is to
determine prevailing subsurface conditions of the site, the physical and
mechanical characteristics of underlying soils and to obtain sufficient data for
final detailed design of all structures, structural foundations, and temporary
works needed during construction.
The objective of the soil investigation and testing is to obtain the following
design parameters:(a)

Undrained shear strength for short term stability problems.


Effective strength parameter for long term stability problems.
Coefficient of volume change (MV) for predicting settlement.
Coefficient of consolidation (CV) for predicting time of consolidation.
Bearing capacity.

The Site
The site for soil investigation is shown on Figure 1 - Locality Plan.

1.3

Scope Of Works
The works in this Contract comprises:(a)

Setting out all test point position and taking levels using the service of
Licensed Surveyor to be approved by Engineer.

(b)

Carry out borehole drilling. ( no.)

(c)

Carry out standard penetration tests or insitu vane shear tests (in borehole),
whichever is appropriate for the soil type encountered.

(d)

Obtaining disturbed and undisturbed samples at specified interval.


Measurement of ground water level in boreholes during the period of
subsurface investigation.

(e)

Carry out field testing consisting of mackintosh probes ( no.) and hand
auger tests ( no.)
performance of specified laboratory tests on selected soil samples.

Preparation of final soil report and recommendation report for foundation


design.

Survey Datum
The datum to which all levels are referred throughout this Specification and
which shall be referred to Soil Profiles and reports prepared in the performance
of this Contract shall be either the Lands and Surveys Datum Bench Mark or
Temporary bench Mark (T.B.M.) which is based on Land and Survey Datum
located on or near the site, as the case may be indicated in the Drawing.

1.5

Inspection Of Site
The Contractor shall be deemed to have inspected and examined the Site and its
surroundings and to have informed himself before submitting his quotation as to
the general nature of the geology, the form and nature of the Site, the extent and
nature of the work and materials necessary for the completion of the
investigation, the means of communication with the access to the Site, the
accommodation he may require and in general to have obtained for himself all
necessary information as to risks contingencies and all other circumstances
influencing or affecting his quotation.

1.6

Documents Mutually Explanatory


The several documents forming the Contract are to be taken as mutually
explanatory of one another and in case of ambiguities or discrepancies the
provisions of these Specification shall prevail over those of any other document
forming part of the Contract.
Provided always that any ambiguities or discrepancies shall be referred as soon
as possible to the Engineer who shall issue to the Contractor instructions
directing in what manner the work is to be carried out in accordance with the
provisions of this Clause.

1.7

Sufficiency Of quotation
The Contractor shall be deemed to have satisfied himself before submitting his
quotation as to the correctness and sufficiency of the rates and prices stated by
him in the priced Bill of Quantities which shall (except insofar as it is otherwise
provided in the Contract) cover all his obligations under the Contract.
The Contractor shall submit with his quotation written description of the order
arrangements and methods which the Contractor proposes to adopt for the
carrying out of the Works. The programme submitted by the Contractor during
the quotation stage shall take into account the period for completion of the Works
as provided for in the Appendix to the Form of Quotation.

1.2

Should it appear to the Engineer at any time that the actual progress of the Works
does not conform with the approved programme referred to in this Clause, the
Engineer shall be entitled to require the Contractor to produce a revised
programme showing the modifications to the original programme necessary to
ensure completion of the Works within the time for completion as defined.
1.8

Location Of Subsurface Investigation Positions


The location of all investigation positions shall be as shown on the drawing(s)
and/or as listed in List of Test Location of this document. The Contractor shall
be responsible for all survey work necessary to locate these positions on the
ground. The exact locations at which the investigations are carried out shall be
marked on the plan, properly dimensioned with reference to a base line.
Reduced levels shall be taken for all locations of investigation. The temporary
bench marks used shall follow those given in the original site plan if such bench
marks are given. Otherwise they shall be based on Bench Marks established by
the Authorities. Under no circumstances shall reduced levels be assumed and
interpolated from contour lines given on the site plan. Contractors shall check all
field data to ensure that the survey is correct before the survey team leaves the
site.
The checking of any setting-out or of any line or level by the Engineer shall not
in any way relieve the Contractor of his responsibility for the correctness thereof
and the Contractor shall carefully protect and preserve all bench marks, sight
rails, pegs and other things used in the setting out.

1.9

Safety Of Site Operations


The Contractor shall take full responsibility for the adequacy, stability and safety
of all Site Operations, Laboratory Testing and methods of working.
The Contractor shall throughout the progress of the Site Operations have full
regards for the safety of all persons entitled to be upon the Site and shall keep the
Site and the Site Operations in an orderly state appropriate to the avoidance of
danger to such persons and shall inter alia in connection with the Site Operations
provide and maintain signs and watching when and where necessary or required
by the Engineer or by any competent statutory or other authority for the
protection of the Site Operations for the safety and convenience of the public or
others.
The Employer shall not be liable for or in respect of any damages or
compensation payable at law in respect or in consequence of any accident or
injury to any workman or other person in the employment of the Contractor or
any sub-contractor save and except to the extent that such accident or injury
results from or is contributed to by any act or default of the Employer, his agents
or servants and the Contractor shall indemnify and keep indemnified the
Employer against all such damages and compensation (save and except as
aforesaid) and expenses whatsoever in respect thereof or in relation thereto.

1.10

Interference With Traffic


All operations necessary for the execution of the Works and for the construction
of any Temporary Works shall so far as compliance with the requirements of the
Contract permits, be carried on so as not to interfere unnecessarily or improperly
with the public convenience or the access to use and occupation of public or
private roads, footpaths and waterways.

1.11

Temporary Access
The Contractor shall provide and maintain all temporary access required for the
execution and completion of the Works. He shall provide at all times during the
progress of the Works, proper means of access with ladders, gang-ways, boats
etc. and the necessary attendance for the inspection of the Works by the Engineer
or his representative as directed.

1.12

Access To Property
The Contractor shall at his own expense, contact and make all necessary
arrangements or agreements with the owners of private properties at the Site for
the use of such properties in the execution of the work required under the
Contract, and shall abide by the terms of such agreements. The Engineer will
offer all possible assistance to the Contractor for securing permission to enter
upon such private properties for his work. The Contractor may occupy during his
operations only those portions of public places at the boring locations for which
he has obtained the required permission, subject to the approval of the Engineer.
The Contractor will be responsible for the securing of a water supply for use in
the prescribed work and for the proper disposition of the discharge at all boring
locations. The cost of use and restoration of public or private property for any
reason whatsoever in connection with this clause herein shall be borne solely by
the Contractor.

1.13

Workmen's Accommodation
The Contractor shall be responsible for the proper housing at site or elsewhere, of
his labour force to the satisfaction of the relevant health authorities.

1.14

Water Supply
The Contractor shall provide water required in connection with the Works,
including the supply and fixing of all fittings, maintenance of the supply,
payment of all fees, removal of all fittings and making good all disturbances after
completion of the Works.

1.15

Electrical Power Supply


Should the Contractor require any electricity supply he shall make his own
arrangement with the authority concerned, comply with all safety regulations and
pay all fees in connection with the installation and supply.

1.16

Storage Facilities
The Contractor shall provide proper facilities for the storage and protection of
soil, rock and water samples.

1.17

Removal Of Improper Plant, etc.


The Engineer shall during the course of the Works have the power to order in
writing from time to time the removal from the site any plant not conforming to
the requirements on the specification, and the replacement of such plant at the
Contractor's own cost. The Contractor's attention is drawn particularly to the
technician's or supervisor's capability to identify and described correctly soil and
rock samples in the field, and to do survey work including taking reduced levels
and setting out.

1.18

Temporary Staging
The Contractor shall supply all materials, labour, equipment and transport etc.
and construct temporary stagings to carry out the work satisfactory where deem
necessary. The stagings shall be strong enough to take anticipated working loads
and as approved by the Engineer. Nevertheless, the Contractor shall take full
responsibility for the safety of the staging.

1.19

Damage Of Overhead And Underground Mains And Services


The Contractor's attention is particularly drawn to his responsibilities in ensuring
that all utilities in and around the site are preserved in good condition. Particular
care should be taken to avoid damage to electricity mains, water mains, telephone
lines, sewage lines, sewage mains and the like.
The Contractor shall be fully responsible for ascertaining the position of all
mains or services in the vicinity of the boreholes and all other tests. He shall be
fully responsible for any damage and for all claims for consequential damages.
The Engineer shall be immediately informed if any of the original locations of
the boreholes or other tests coincide with the positions of the mains or services.
It will be the Engineer's responsibility to change the locations of the affected
boreholes or other tests.

1.20

Completion Of Work On Site


As soon as the investigation work is completed, the Contractor shall invite the
Engineer and the Consultant for a joint inspection to certify that the works have
been carried out accordingly as described. Then the Contractor may remove
from site all plants, surplus materials, temporary work materials etc., leave the
site clean and tidy to the satisfaction of the Engineer.

1.21

Laboratory Testing Facilities


The Contractor shall carry out laboratory tests at his own testing laboratories. If
the testing facilities of other laboratories are to be made use of, the prior
permission of the Engineer is required.

1.22

Method Of Measurement
Except where any description of the work in the Specification, Drawing or the
Bill of Quantities expressly shows the contrary, measurement shall be made in
accordance to the procedure set forth in the latest edition of the Standard Method
of Measurement of Civil Engineering Quantities published by the Institution of
Civil Engineers.

1.23

Work To Be Satisfaction Of Engineer


Save insofar it is legally or physically impossible the Contractor shall carry out
the Investigation in strict accordance with the Contract to the satisfaction of the
Engineer and shall comply with the adhere strictly to the Engineer's instructions
and directions on any matter connected therewith (whether mentioned in the
Contract or not). The Contractor shall take instructions and directions only from
the Engineer.

1.24

Continuation Required By Conditions


If during the execution of Site Operations the Contractor shall encounter ground
or geological conditions which in his opinion make it necessary for the
effectiveness of the Works or for the adequacy of the Report to continue the
operations of boring, drilling, excavation, sampling or insitu testing to a greater
depth than is included in the Bill of Quantities before plant is moved from the
position of the borehole drill hole or excavation and the Engineer's instructions
cannot be immediately obtained, the Contractor may continue such operations or
change the mode of operation at his own discretion provided always that the cost
of such continued operations or changed mode of operation shall not exceed such
sum as may have been agreed between the Engineer and the Contractor in writing
at the commencement of the Site Operations unless a further instruction or
specification shall have been subsequently issued by the Engineer.

Justified Continuation
Subject to any instruction of the Engineer previously given pursuant to this
Clause such continued or changed operations shall be deemed to have been
carried out as a variation, provided always that if the Engineer shall decide that
the Contractor was not justified in continuing or changing the operation in
accordance with Clause 1.23 the Engineer shall so inform the Contractor in
writing and shall issue further instructions or specification as he may think fit to
govern how any similar ground or geological conditions which may be
encountered in the future shall be dealt with.

1.26

Joint hand-Over Inspection


Prior to acceptance of test results and approval of Final Payment, a joint handover inspection of the soil investigation sites shall be carried out with the Clients
representative and the Engineer.

1.27

Submission Of Reports
The details required and the submission of the Preliminary Field Log and Final
Reports shall be in accordance to the terms specified in Section 6.0 - Reporting
Of Results of this Specification.

1.0

GENERAL

1.1

The Bills of Quantities shall be read in conjuction with all other documents.

1.2

The quantities given in the annexed Bills of Quantities for the various items are
approximate and provisional and are given to provide a common basis for
quoting. The basis of payment will be the actual quantities of work ordered and
carried out, as measured by the Engineer and valued at the rates or prices quoted
in the Bills of Quantities where applicable.

1.3

The prices and rates to be inserted in the Bills of Quantities are to be the full
inclusive value of the work described under the several items, including all costs
and expenses which may be required in and for the construction of the work
described, together with all general risks, liabilities and obligations set forth or
implied in the quotation Document.

1.4

The rate entered against each items in this Bills of Quantities shall be binding
throughout the work and shall not be subject to revision on account of any
discrepancies or inaccuracies in the estimated quantities and weights or any other
cause. The Contractor shall when quoting satisfy himself that the quantities are
reasonably correct within the scope of work. Should he notice any discrepancy,
he should at once notify the Engineer, so that the matter can be examined, and if
necessary altered before the date of closing of the quotation.

All rates and prices shall be in Malaysian Currency.

MEASUREMENTS
The quantities unless otherwise stated shall be measured generally in accordance
with the Standard Method of Measurement of Civil Engineering Quantities
issued by the Institution of Civil Engineers, U.K.

3.0

EQUIPMENT
The rates and prices in the Bills of Quantities shall include the hire, charges of
plant and equipment, which charges shall be inclusive of fuel and consumable
stores, maintenance, servicing, drivers, attendants, insurance and all other
incidental and contingent charges.
The rates for the provision and erection of boring plant, sampling, insitu testing
equipment, etc., at sites and for movement from one position to the next shall
include for:(a)

Transport.

(b)

Preparatory and clearing works at each boring site. Where shallow water
is encountered, rates should include provision of platforms or stagings,
barges and access for boring equipment.

(c)

Setting out of borehole, drill hole, probe and insitu test positions relative
to bench marks established by authorities.

(d)

Levelling as specified to relate ground level at each position to


established permanent/temporary bench marks.

(e)

Preparation and supply of the specified number of copies of drawings


showing locations of and existing ground levels at boreholes, drill holes,
probes and insitu tests.

4.0

BORING, AUGERING OR PROBE

4.1

The rates for boring and casing boreholes shall include for:(a)

All boring operations.

(b)

Casing of boreholes.

(c)

Visual and manual examination, identification, description, labelling,


storage and disposal of disturbed material from the boreholes.

(d)

Obtaining small representative disturbed samples in between sampling


position.

(e)

Recording of water table in boreholes.

(f)

Recording of penetration resistance of casing.

(g)

Keeping of accurate boring records and preparation and supply of the


specified number of copies of boring logs.

(h)

Extraction of casings and backfilling.

Payment for borings shall be according to unit prices per linear metre of hole
measured from the existing ground/bed level to the bottom of borehole.

5.0

DRILLING IN HARD FORMATION AND IN ROCK

5.1

The rate for drilling shall include:-

The supply of all drilling equipment, including core barrel and core bit in
approved working order, for successful completion of the drilling
operation.

(b)

Extraction of cores, packing, labeling, preservation, storage and delivery


of cores to laboratory.

(c)

Supply of core box.

(d)

Taking of photographs.

STANDARD PENETRATION TEST


The rates for standard penetration tests shall include:(a)

Carrying out standard penetration tests and extraction of disturbed


samples from the split spoon containing at least 300 mm of disturbed
material. No payment shall be made on standard penetration tests which
do not yield acceptance representative disturbed soil samples.

(b)

Supply of air-tight containers, packing, labelling, storage, transport and


delivery of disturbed samples to a laboratory to be specified by the
Engineer.

(c)

Retention of containers in the said laboratory for a reasonable period.

(d)

Visual and manual examination, identification and detail description of


soil samples.

6.2

Payment for Standard Penetration Tests shall be made only on each acceptable
test.

7.0

UNDISTURBED SAMPLES AND DISTURBED SAMPLES

7.1

The rate for extraction of undisturbed samples from boreholes shall include for:(a)

Extraction of undisturbed samples containing at least 230 mm of


undisturbed material from boring.

(b)

Used of sampling tubes and their retention for a reasonable period in the
laboratory.

(c)

Packing, labeling, storage, transport and delivery of undisturbed soil


samples to a laboratory to be approved by the Engineer.

(d)

Visual and manual examination, identification and detailed description of


soil sample.

7.2

The unit rate for extraction of undisturbed samples from boreholes shall include
for supply of containers, packing, labelling, storage, transport and delivery to a
laboratory to be specified, visual description of the sample.

8.0

INSITU VANE SHEAR TEST

8.1

Payment for determination of shear strength in the field by the vane shear test
shall be made only on each acceptable test. The unit rate shall be for
determination of the undisturbed and remoulded shear strength at specific depth.

8.2

The rates for insitu vane shear tests shall include:(a)

Levelling to establish existing ground levels at test positions.

(b)

Calibration of torque measuring instrument before commencing and on


completion of tests.

(c)

If vane apparatus of the borehole type is used, the supply of boring


equipment, drilling, casing and advancing boreholes.

(d)

Determination of insitu undisturbed and remoulded shear strength.

(e)

Keeping accurate records of vane shear test data and making calculations
of undisturbed and remoulded shear strength.

(f)

The supply of the specified number of copies of test data and


calculations.

9.0

LABORATORY TESTS

9.1

General
The rates for laboratory tests on soil samples shall include:(a)

Preparation of soil specimens for testing.

(b)

Supply of testing equipment and materials,

(c)

Testing and specimens.

(d)

Recording test data and making relevant calculations.

Supply of the specified number of certified copies of test data and


calculations.

Moisture Content Test


The unit rate of moisture content determination shall be for two separate
determinations of moisture content of each soil specimen.

9.3

Liquid Limit Tests


The unit rate for liquid limit determination shall be for tests at not less than
FOUR separate moisture contents and plotting of a flow curve to determine the
liquid limit of each specimen.

9.4

Plastic Limit Tests


The unit rate for plastic limit determination shall be for TWO separate
determinations for plastic limit of each specimen.

9.5

Bulk Density Tests


The unit rate for bulk density determination shall be for the determination of bulk
density of TWO separate specimens extracted from each selected soil sample.

9.6

Unconfined Compression Tests


The unit rate for unconfined compression test shall be for the determination of
unconfined compression strengths of THREE separate specimens obtained from
each selected soil sample and shall include the determination of strain at failure,
stress-strain curves and density of specimens.

9.7

Unconsolidated Undrained Triaxial Compression Tests


The unit rate for unconsolidated undrained triaxial compression tests shall be for
the determination of confined compressive strength of three specimens, each at a
different lateral pressure, one of which shall be its overburden pressure, the
construction of Mohr's circles and determination of apparent cohesion, angle of
shearing resistance and the determination of bulk density and moisture content of
each test specimen.

9.8

Consolidated Undrained Triaxial Compression Tests


The unit rate for consolidated undrained triaxial compression tests shall include
for the consolidation of three specimens each at different specified consolidation
pressure, determination of confined compressive strength of the specimens at the
respective specified consolidated pressure, recording of pore-water pressures, the
construction of Mhr's Circles, determination of initial and final bulk densities and
moisture contents of all the specimens.

9.9

Drianed Triaxial Tests


The unit rate for drained triaxial test shall be for the consolidation of three
specimens each at different specified consolidation pressure, applying with
minimum back pressure of 20 psi, determination of confined compressive
strength of the specimens at the respective specified consolidation pressure,
recording of pore-water pressures, the construction of Mohr's Circles,
determination of soil strength parameters and determination of initial and final
bulk densities and moisture contents of all the specimens.

9.10

One Dimensional Consolidation Tests


The unit rate for one dimensional consolidation test shall include the plotting of
compression, expansion and consolidation curves and the determination of
specific gravity of the soil particles, the coefficient of compressibility,
compression ratio, coefficient of consolidation, swelling index and time factor.

9.11

CBR Tests
The unit rate for CBR tests shall include for the determination and plotting of
force penetration curves as well as the calculation of California Bearing Ratio.
