Expert Witness

A Quantity Surveyor, with chartered status within the construction industry, a Masters degree in business
administration and a law degree. Experienced in commercial management, the preparation and defence of
claims and the preparation and adoption of commercial control systems for commercial organisations. Has
prepared expert witness reports and acted as expert in a number of construction disputes. Started Centra
Consult LLP in September 2007, previously director of Driver Consults Scottish Office, having joined them
from Trett Consulting, where after seven years, he was Regional Director running their Scottish office.
RELEVANT EXPERIENCE
Expert Reports Includes:
Mechanical Installation

Expert report for an ongoing Arbitration arising from a Contract completed


some 15 years ago. Original Arbiter retired and Claimant has substantially
revised the case

Tunnelling Contract

Expert role on quantum issues arising from a major tunnelling project for an
employer. The claimant is indicating the need for matters to be settled by
arbitration.

PFI School, Works Contract

Expert report on quantum issues for a contractor building a single secondary


school. The dispute having gone through initial procedure within the Scottish
Commercial Court, settled before I was required to give evidence on my
report.

George St, Edinburgh

Expert report on behalf of a contractor on the analysis of the Sectional


Completion requirements within the contract.

Demolition Contract

Expert report for a demolition contractor covering quantum issues in


arbitration; gave evidence at the arbitration hearing.

Civil Engineering

Expert report for a civil engineering contractor (design and build sewage
treatment works) covering quantum issues in arbitration. The issue settled
before evidence was due to be given.

Water Treatment Works

Assistance with an expert report on delay and cost issues for professional
indemnity insurers in a court action by a design and build contractor against
the designer. The issue settled during the court action just before evidence
was due to be given.

Streetworks

Expert report for a streetworks contractor covering quantum issues in a court


action. Evidence was given in the Sheriffs Court.

Royal Opera House

Assistance with an expert report on delay and cost issues for the mechanical
and electrical installation aspects.

Adjudication Experience Includes:
Marine Civil Engineering
Works, West of Scotland

Assistance in the preparation of an adjudication submission.

Forth Rail Bridge

Assistance in the preparation of the claim and the subsequent adjudication for
a painting contractor.

Waverleygate, Edinburgh

Prepared an adjudication against a demolition sub-contractor involved in


demolition, faade retention and piled foundation for faade retention.

Former Sheriff Court


Building, Glasgow

Defended an adjudication against a concrete frame sub-contractor on behalf of


the same main contractor as Waverleygate

Various

Numerous small adjudication submissions for smaller trade contractors.

Claim Preparation Experience Includes:


UKAEA Dounreay

Preparation of a claim for a mechanical contractor on a materials handling


contract.

BNFL Sellafield

Contractual advice in lieu of claims preparation for the same contractor.

Pharmaceutical Plant

Prepared a major claim for a mechanical and process engineering contractor,


including both extensions of time and quantum.

Refurbishment/
Development Edinburgh

Prepared claim submission for local Contractor, then assisted in settlement via
Mediation, sums in excess of 2M

Contractual Advice Includes:


MFL, Leeds

Gave contractual advice to a main contractor in connection with a multi-storey


flatted development. The employer was seeking to recover 1million in L&A
damages.

Forth Rail Bridge

Prepared sub-contract documents for a contractor who took over the contract
after the completion of the earlier adjudication detailed above.

PFI Hospital

Gave contractual advice and commercial assistance to a contractor who had


serious issues with a hospital development.

PFI Schools

Gave contractual advice to a contractor who was suffering deductions from a


complete PFI Schools project.

Student Accommodation
Dundee

Gave contractual advice to a contractor engaged in the construction of student


accommodation in Dundee.

Housing Development
Dundee

Gave contractual advice to a contractor engaged in the construction of a


housing development for a developer in Dundee.

further quantum experts. Ran the commercial arm of a multi million pound
PFI Hospital Development on behalf of a client for six months.

for the RAF.
