Facts:
JeffreyLiangwaschargedbyfellowADBworkerJoyceCabalfortwocountsof
graveoraldefamationintheMeTCofMandaluyong.Hisbailwasfixedat
P2,400.
TheMeTCjudgedreceivedanofficeofprotocolfromtheDFAstatingthat
petitioneriscoveredbyimmunityfromlegalprocessundersection45ofthe
AgreementbetweentheADBandthePhilippineGovernmentregardingthe
HeadquartersofADB.
Consequently,theMeTCjudgedismissedthetwocriminalcaseswithout
notifyingtheprosecution.Prosecutionfiledforamotionforreconsiderationand
wasdenied.ProsecutionfiledapetitionforcertiorariandmandamuswithRTC
andtheMeTCrulingsweresetaside.
Petitionerfiledamotionforreconsiderationandwasdenied.Hencethispetition
(furtherarguingthatnopreliminaryinvestigationwasheldbeforethecriminal
caseswerefiledincourt).

14. ProperProcedureintheJeffreyLiangCase
Themunicipalcourtshouldhaveinquiredwhetherthepetitionerhad
committedthecrimeinconnectionwiththeperformanceofhisofficial
dutiesasanofficeroftheADB.
