1) The case originated from a missing registration sticker on a license plate in 2008.
2) In 2008, a hearing by phone was offered as the only option to hear the case. During such
hearing the Hearing Officer claimed that a certified letter was received by Joseph Zernik
noticing him in the matter of the missing sticker. Joseph Zernik had no knowledge of such
certified letter. He therefore asked the Hearing Officer if she had the records in front of
her, which she was referring to as evidence in the hearing. The hearing officer then
stated that she was located in City of Commerce, while the records, which were claimed
as evidence, were located in downtown LA Courthouse. All she had was a computer
printout. Joseph Zernik asked if there was any name or signature associated with the
entries on the computer printout, such as the entry that Joseph Zernik received a certified
letter on the matter of the registration sticker. The Hearing Officer stated that there was
no name or signatures on the entries. Joseph Zernik then objected to the conduct of
hearing on the basis of such evidence, and requested to continue the hearing, so that he
might access the records and provide the hearing officers copies of the records as well.
The hearing officer denied the request to continue. Joseph Zernik then objected to the
admission of unverified, unauthenticated evidence. The hearing officer overruled the
objection.
Later Joseph Zernik was notice that the hearing officer ruled to suspended Joseph
Zernik’s driving license.
3) On Thursday, February 4, 2010, Joseph Zernik visited the office of AAA in La Verne
California. He was told that his suspension was over by November 2008, and that he was
eligible for renewal of his driver’s license.. On that date, Joseph Zernik issued renewal of
registration, issued a new insurance policy.
4) On Friday, February 5, 2010, Joseph Zernik went to DMV Pomona, to issue the renewed
driver’s license but DMV was closed.
5) On Saturday February 6, 2010 Joseph Zernik was stopped and arrested, and La Verne
Police Officer told him that there were two warrants for his arrest, one by Beverly Hills Court,
with bail of $30,000, and one by Burbank Court, with bail of $5.000. During his booking
Joseph Zernik requested to inspect the warrants that were the foundation for his arrest. Two
pages were printed out, but displayed from a distance, so that Joseph Zernik was unable to
inspect them. His request for copies were denied.
6) On February 6, 2010, La Verne Police issued Notice to Appear (Exhibit A), with
date of appearance of February 19, 2010. The form is by the Pomona Court, but the
addresses of the courts were crossed out, and Burbank Court was listed instead.

7) On February 6, 2010, La Verne Police issued a Booking Record (Exhibit B), where bail was
listed of $35,000, pertaining to the purported sum of the two warrants bails. When Joseph
Zernik requested a copy of the Booking Record, his request was denied. He eventually
managed to get a partial copy from the Sheriff’s Department upon his release on February 7,
2010.
8) On February 7, 2010, Joseph Zernik received from the Sheriff’s Department paper titled
“Surety Bond Request for Release of Prisoner” (Exhibit C). Only appearance in the Beverl
Hills Court on March 2, 2010 was listed. Bond agent also informed Joseph Zernik that the bail
amount was changed, and reduced to only $30,000.
9) On February 7, 2010 even before his release, Joseph Zernik asked the Bond Agent to
ensure that Joseph Zernik received upon release records to document the nature of the
Bond/Bail Transaction. The Bond Agent later had no records provided to Joseph Zernik even
a week later.
10) From February 7, 2010 and to this date, the Sheriff’s Department online Inmate Information
Center showed records under the name of Joseph Zernik (Exhibit D), which referred to both
the warrant in Beverly Hills Court and the warrant in Burbank Court. However, the Burbank
case was listed under the false name of the Burbank Municipal Court, which no longer
existed for almost a decade. In other, unrelated cases, Joseph Zernik demonstrated that the
Sheriff’s Department listed cases where arrests were conducted with no records under the
false authority of the non-existent Municipal Courts of various cities. The Total Bail Amount
was listed as $0.00 in the Sheriff’s Department record.
11) Starting February 8, 2010, Joseph Zernik repeatedly requested the La Verne Police
Department to access the California Public Records, which were the warrants
claimed to have been executed on February 6, 2010 for his arrest. Records
Supervisor of the La Verne Police Department repeatedly denied access to such
records. She claimed that they did not exist as “separate entities”.
12) On February 16, 2010 Joseph Zernik attempted to retrieve his case file records, in particular
the warrant from the Beverly Hills Court. He was unsuccessful.
13) On February 16, 2010, Joseph Zernik attempted to retrieve his case file records, in particular
the warrant from the Burbank Court. He provide the clerk with the request for access to
records (Exhibit E).
14) On February 16, 2010 Joseph Zernik retrieve from Burbank Courthouse the following
records:
b. Pages from paper court file (Exhibit G) On some records the court was identified as
Burbank Municipal Court. The papers included a paper dated March 11, 2009,
which was titled “Bench Warrant Hearing”. The clerk of the court claimed that it was
a pending warrant, which was never executed, and that Joseph Zernik was subject
to arrest pursuant to such warrant at any time. Such warrant listed bail at 5k, but
showed no signature of either a judge or a clerk. Existence of such warrant as an

c. Joseph Zernik was never provided any notice of the Minutes that were entered in the
file. In response to questions, the Clerk’s Office Manager explained that the Superior
Court of California, County of Los Angeles did not practice giving notice.
d. At request, the Calendar of the Court for February 19, 2010 was printed, but failed to
include a hearing for the case at hand.
e. Additional pages were printed out from the computer, which listed again an active
warrant for arrest with a bond of $5,000. However, the clerk of the court stated that
she would not certify any of the computer printouts as court records. Only the papers
in the court file. Neither the paper court file or the computer records included any
warrant signed by a judge or a clerk. However, the clerk informed Joseph Zernik that
the warrant, unsigned as it was, was considered valid, and that Joseph Zernik was
subject to arrest at any time.
15) On February 17, 2010 Joseph Zernik sent to Chief Scott Pickwith a request to affirm issues
pertaining to integrity of records and operations of the La Verne Police Department (Exhibit
H). The questions pertained specifically to conduct relative to the Burbank Warrant, which La
Verne Police claimed to have executed, and bail of which was included in the Booking record,
but which in fact was obviously never executed, but left pending. Records Supervisor Ruth
Mahlow, confirmed receipt of the request. However, Chief Pickwith did not confirm receipt and
did not respond at all.
16) On February 17, 2010 Joseph Zernik tried to access both City Attorney of Burbank and
District Attorney in Glendale office, which he was told were the ones who were possibly
handling the case. Neither office had any record of the case.
17) On February 17, 2010 Joseph Zernik faxed both offices, and also mailed the offices and the
court a request to continue, pending his finding of counsel to handle the case and possibly
consolidate with the Beverly Hills case on the same matter. (Exhibit I)

RE: Arrest Warrant under #8BR0429801: Request for affirmation of integrity of related records
and operations of the La Verne Police Department
I again write to request that you affirm integrity of records and operations of the La Verne Police
Department:
1) Warrant for Arrest of Joseph Zernik under #8BR0429801, requiring bail of $5,000
On February 6, 2010, Joseph Zernik was stopped by Officer McKindley, ID #720, of the La Verne
Police Department, who arrested him stating that a warrant for such arrest existed by the Burbank
Court. When Officer McKindley was asked to allow inspection of such warrant, he printed a paper from
the La Verne Police Department computer system, but displayed it only from a distance. When Officer
McKindley was asked to provide a copy of the warrant - the request was denied. Officer McKindley
also informed Dr Zernik that a bail of $5,000 was required for release from arrest pursuant to such
warrant by the La Verne Police Department.
4) Responses of Record Supervisor Ruth Mahlow upon request to access public record, which
was the warrant for the arrest of Joseph Zernik under #8BR0429801, which was claimed to have

The warrant print outs are included as part of the officers report and are not separate entities. You will
not be getting copies of the warrants.
Implied in such response by Records Supervisor was: (a) That a "separate entity" which was an honest
valid and effectual warrant for arrest of Joseph Zernik, under #8BR0429801, indeed existed prior to the
arrest of February 6, 2010, and (b) That a "separate entity" which was an honest valid and effectual
warrant for arrest of Joseph Zernik, under #8BR0429801, was indeed executed by Officer McKindley
on or about February 6, 2010, and (c) That warrant for arrest of Joseph Zernik, under #8BR0429801,
was later incorporated into the report of Officer McKindley, and therefore, no longer existed as a
"separate entity", which was an honest, valid, and effectual warrant for arrest of Joseph Zernik.
I therefore write to request your affirmation of the following, pertaining to integrity of records and
operations of the La Verne Police Department. In the following requests, the term "honest" is used in
the sense of "devoid of fraud and deception":
1) An honest valid and effectual Warrant for Arrest of Joseph Zernik under #8BR0429801, requiring
bail of $5,000, existed as a separate entity at the time of the arrest of Joseph Zernik on February 6,
2010.
2) Notice to Appear, issued by Officer McKindley on a form of the East District Pomona Court,
L254423, where the court names printed on the form were crossed out, and the non-existent Burbank
Municipal Court was instead inscribed by hand as the place of required appearance, was an honest,
valid and effectual record of the La Verne Police Department.
3) An honest, valid, and effectual Warrant for Arrest of Joseph Zernik under #8BR0429801, requiring
bail of $5,000, was executed on about February 6, 2010 by Officer McKindley of the La Verne Police
Department, as stated by him at the time of the arrest and booking.
4) Warrant for Arrest of Joseph Zernik under #8BR0429801, requiring bail of $5,000, no longer existed
as an honest, valid, and effectual "separate entity" by the time Records Supervisor of La Verne Police
Department Ruth Mahlow provided her email response of Tue, 9 Feb 2010 14:01:06, stating: The
warrant print outs are included as part of the officers report and are not separate entities.
Time is of the essence, given that one of the records listed above, whose integrity your are requested
to affirm, is a Notice to Appear pertaining to appearance on February 19, 2010. Your timely response is
therefore kindly requested today, February 17, 2010.
