For the information of those who were not able to attend the briefing/orientation on the
implementation of Republic Act No. 10361, otherwise known as "Domestic Workers
Act" or "Batas Kasambahay" on August 6, 2013 at Subic Bay Exhibition and Convention
Center (SBECC), coordinated by the Human Resource Management Department and
conducted by the Department of Labor and Employment (DOLE), Social Security System
(SSS), PAG-IBIG and Philhealth the following were discussed:

After one (1) year from the effectivity of the Batas Kasarnbahay and
periodically thereafter, the Regional Tripartite Wages and Productivity
Board (RTWPBs) shall review and if proper, determine and adjust the
monthly minimum wage rates of the Kasarnbahay in accordance with
their rules and regulations taking into account the peculiarities of the
Kasambahay employment arrangement.
b. Other mandatory benefits, such as the daily and weekly rest periods,
service incentive leave, and is" month pay;
c. Freedome the employers' interference in the disposal of wages
d. Coverage under the SSS, Philhealth and PAG-IBIG laws;
A Kasambahay who has rendered at least one (1) month of service shall be
covered by the Social Security System (SSS), Employees Compensation
Commission
(ECC),
Philippine
Health
Insurance
Corporation
(PHILHEALTH) and PAG-IBIG and shall be entitled to all the benefits in
accordance with their respective policies, laws, rules and regulations.
Benefits under the SSS include sickness, maternity, disability, retirement,
death and funeral. A unified benefit package under Philhealth includes Inpatient Hospital Care and Outpatient Care.
Mandatory premium payments or contributions shall be shouldered by the
employer, however, if the Kasambahay is receiving a monthly wage rate of
Five Thousand Pesos (Php 5,000.00) and above, the Kasarnbahay shall pay the
proportionate share in the premium payments or contributions, as provided by
law.
In the event the Kasambahay avails of certain loan privileges from PAG-IBIG
Fund which require the payment of additional or upgraded contributions, the
said additional or upgraded contributions shall be shouldered solely by the
Kasambahay.

All household employers are required to register as Employers and each shall
be issued a unique and permanent Philhealth Employer Number (PEN).

Kung rnangyari na may pagtalunan ang magkabilang panig, ito ay maaariag pagkasunduan
muna sa barangay at kung walang mangyayari ay iaaityat ito sa DOLERegionaUProvinciallField Office na nakasasakop sa lugar ng trabaho.
18. Ano mang pagbabago sa kasunduan ay may bisa lamang kung ita ay napagkasunduan at may
katumbas na kasulatan na nilagdaan ng dalawang panig.
Ang Pinaglilingkuran ay nangangakong magbibigay sa Kasambahay ng lahat ng mga benepisyong
itinakda sa ilalim ng batas.
Ang Pinaglilinglauan at Kasambahay ay kusang sumasang-ayon sa mga kondisyong nabanggit sa
kontratang ito.

PhilHealth Circular No. 0057, s.2012 was issued to partially defer the full implementation of the increase in the PhilHealth

For employers enrolled and actively using the Electronic Premium reporting System (EPRS), please be advised that the
System will have additional feature to provide options for the Employers to prepare their PhilHealth remittance for any
applicable month based on the appropriate rates as prescribed in PC 01, 2005 and with the new rates under PC 57, s.2012.
Thus, Employers wishing to remit their PhilHealth contributions for any applicable months in CY 2012 may prepare the
same with the premium rates and salary bracket based on PC 01, 2005. On the other hand, employers shall prepare their
2013 premium contributions in accordance with the salary bracket and premium rates prescribed in PC 057, s.2012.
