This is an application by the appellant for recall of order dated.


05.02.2015.
Having heard learned counsel for the parties and perused the record,
I am satisfied that non appearance of the learned counsel for the appellant
on 5.2.2015 was not deliberate. Consequently, the application is allowed
and order dated 05.02.2015 dismissing the appeal is recalled.
The appeal may now be listed on 25th February, 2015 for final
hearing.

ORDER

Shri Sulekh Chand Jain to whom notice of contempt was issued is


present in person. Learned counsel for the respondent says that one of
the two Directors Shri Vikas Jain to whom notice of contempt was issued
has not been able to come because he is down with H-1 N-1 fever.
Shri Nityanand Singh further stated that his client has complied with
order dated 7.11.2014 and possession of the house has been delivered to
the appellant.
Shri A.K. Jain admits that he has received possession of the house.
Let the matter be listed on 14th April, 2015.
On the next date of hearing Shri Sulekh Chand Jain and Shri Vikas
Jain, Directors of Respondent No. 1 should remain present.
