PRESENTATION

Good evening, my name is Dina Vasquez, this time I came to expose about the
purpose of INCOTERMS 2010, after finished my presentation will give 10
minutes for questions or inquiries.

INCOTERMS 2010

PURPOSE OF INCOTERMS
Establish a set of international rules that aim to facilitate the conduct of global
trade. So the uncertainties of different interpretations in different countries can
be avoided.
INCOTERMS help identify the respective obligations of the parties
(C / V) and reduces the risk of legal complications.
The INCOTERMS determine the exact point of the transfer of risk of injury and
responsibility of delivering the goods between seller and buyer.

DO NOT INCOTERMS
They are not laws, are recognized as Recommended Practice International
Standard.
The INCOTERMS do not determine the ownership of a commodity. (This point
should be provided in another clause in the sales contract).
There are all-inclusive service, often details that go beyond the Incoterms
should be covered elsewhere in the contract.

HOW TO USE THE RULES INCOTERMS 2010

The Incoterms rules provide NO contract C / V full; Yes indicate:


Who is obliged to arrange transportation and insurance (risk).
When the seller delivers goods to the buyer.
Who is responsible for which costs.

The Incoterms Rules NO refer to:


Price to pay, or payment.
Transfer of ownership of the goods.
Consequences for breach of contract Local law can override the Incoterms
rules

The role of customs documents is based on how Incoterms are located


before the Customs formalities:

EXW: the buyer is responsible for both Customs Exp / Imp.


FCA, CFR, CIF, CIP, DAP and DAT: the seller is responsible for export
customs and buyer custom import.
DDP: the seller is responsible for both Customs Exp / Imp.

MAIN DIFFERENCES BETWEEN INCOTERMS 2000 RULES AND 2010


The number of rules are reduced from 13 to 11.

DAF, DES, DEQ, DDU and rules are replaced by two new rules such as DAT
(delivery terminal) - DAP (delivery location), which can be used irrespective of
the mode of transport agreed

SHIPS):

EXW in manufactures (... named place)


FCA Free Carrier (... named place)
CPT Carriage Paid To (... named place of destination)
CIP Carriage and Insurance Paid To (... named place of destination agreed)

DAP Delivered at Place (... named place of destination)
DDP Delivered Duty Paid (... named place of destination)

FOR SHIPPING AND INLAND WATERWAYS (BOTH PORTS)

FAS Free Alongside Ship (... named port of shipment)
