Release Deed
This Deed of Release made, executed and entered into at Thane at this 15 th day of December,
2014 between
AND WHEREAS for the consideration of love and affection, the Releasers were desirous of
releasing all their rights, titles, share and interest along with the benefits and privileges
appurtenant to their undivided share in the said Property post the demise of their father
Late Shri Sharadchandra Kesarinath Gandre on 24th January 2008, into and in favour of the
Releasee, absolutely and forever,
AND WHEREAS the Releasee, also showed her readiness and willingness to get released
the shares of the Releasers in the said Property by virtue of this Deed, in their favour for the
aforesaid consideration;
AND WHEREAS in the circumstances, the parties hereto have consented for the execution
of the present Release Deed on the terms and conditions more particularly setout herein
below,
NOW THEREFORE THESE PRESENTS WITNESSETH and is agreed by and between the
Releasers and Releasee, as under:
1. The Releasers doth hereby release, relinquish and surrender all their rights, share, titles
and interest, including the benefits and privileges appurtenant to their undivided share
in the said Property post the demise of their father Late Shri Sharadchandra Kesarinath
Gandre on 24th January 2008, more particularly described hereinabove and every part
thereof unto and to and in favour of the Releasee, absolutely and forever, for the
consideration of love and affection.
2. Releasee henceforth shall be entitled to hold, use, occupy, enjoy and maintain the right,
title, interest and undivided share of the Releasers in the said Property.
3. Henceforth Releasee shall be entitled to receive, realize, appropriate and consume the
entire privileges and benefits that shall be available from the undivided share in the said
Property and shall further be entitled to deal with the same in the manner she deems fit
and proper.
4. Releasee shall be entitled to use, occupy, enjoy and deal with the undivided share of
Releasers in the said Property and receive the privileges and benefits therefrom, from
time to time and the Releasers shall not be liable in any manner whatsoever in respect of
the undivided share of Releasers in the said Property and the Releasee hereby agrees to
indemnify and keep indemnified the Releasers in this regard, forever.
5. The Releasers doth hereby agree and undertake to sign, execute, file and submit all the
requisite documents, papers, deeds, instruments, etc. for more perfectly transferring
their right, title, interest and undivided share in the said Property and benefits thereof in
favour of the the Releasee and to give proper effect to the intentions of this Deed. The
Releasers doth hereby state, declare and confirm, for themselves and for the persons
claiming under them, that they have not in the past sold, transferred and/ or assigned
their share, right, title, benefits etc. in favour of any person/s, and shall not henceforth, in
future, raise any claim, dispute and/ or demand over the said undivided share in the
said Property or any part thereof or the benefits and privileges arising therefrom.
6. Execution of this Deed shall in no manner affect the contentions of the Parties in their
pending dispute No. ___________ in the Civil Court, Thane, regarding the Will of Late
Shri Sharadchandra Kesarinath Gandre.
