A 1 0 y ear old boy , who was cleaning dishes until their arriv al, brings both of them two glasses of tea on his m asters order. Anil
who is on a phone call, unaware of boy standing behind him , accidentally touches the plate carry ing tea glasses. Hot tea spills all
ov er his shirt and glasses are broken into pieces on the ground. The owner of the shop, seeing this, beats the boy to a pulp.

It is v ery m uch im portant to acknowledge own m istakes com m itted either by default or design ,especially in cases when it hurts
som eone.
Firstly ,i would hav e accepted m y m istake and help the boy rid free of the blam e lev eled by his m aster.Here,as a hum an being,i
would hav e stopped the shop owner from inflicting v iolence on the sm all child and paid the entire com pensation of the loss
incurred by him .As a responsible would-be IAS officer, i would hav e m ade efforts to free that child from stranglehold of the shop
owner by handing ov er the boy to a responsible NGO working for the welfare of children so that he does not get entangled in the
v icious circle of pov erty in future due to lack of education.
Moreov er,i would hav e appealed to the shopkeeper to desist from resorting to child labour as it is a cognizable offence and
punishable under law.
Initiating any legal action is out of question as it is better to resort to cajoling rather than forceful abiding of norm s.

As this is clear cut v iolations of rule of law.
Though constitution has abolished child labour in hazardous activ ities. SC has giv en a v erdict that any child below the age of 1 4
y ears cant be em ploy ed in any kind of em ploy em ent activ ities. Moreov er whoev er engages in it is liable to be punished under
Child labour prohibition Act, 1 9 86 .
Steps :1 ) Warning to the shopkeeper to stop beating him as he has alway s v iolated CLP act and has com m itted one crim e already .
2 ) Threaten him and m ake him aware of the consequences if he didnt oblige the law and free the child with proper
com pensation he has to pay .
3 ) Console the boy s and m ay be talk to him about his studies ov er som e food.
4 ) If boy hav e a fam ily , then we m ay go to them and m ake them aware of RTE which giv es prov ision for free education under 1 4
y ears.
5) Hav e conv ersation with local im plem entaing agency of RTE Act and get the child adm itted to neighbourhood school.

A: The tea stall owner is responsible for two crim es, first is practicing child labor and second the inhum an treatm ent he subjects
the child to. As a hum an being I should im m ediately stop the owner from beating the child and rush the child to a nearest
hospital for treatm ent.
I should then contact his parents and request and adv ise them to send the child to school. If they are really poor and cannot
afford to send him to school, as an officer it is m y duty to inform them about the low cost schooling prov ided by gov ernm ent to
all children. If they are not em ploy ed, they should be assisted in enrolling in to gov ernm ent funded skill dev elopm ent
program m es or self em ploy m ent low interest credit facility av ailable for poor. They can be reffered to local NGO for further
guidance.
On the other hand if they are not ready to cooperate and are willfully sending the child to work, they should be inform ed sternly
that it is illegal and they action would be taken against them .
The police should then be inform ed about the incident and a com plaint should be registered. They should be asked to act
im m ediately against the tea stall owner. As a would be officer I should then interact with the police regarding the problem and
how it went unnoticed in their area and what steps they would take in future to curb the practice.

I will thoroughly enquire about the the situation like is he only child em ploy ed there or there are m ore child.where is his
residence ?how he cam e to that shop?is this first incident of v iolence against the boy or its a regular affair.If that boy is not
v ictim of any organize racket best thing to com m unicate with his parent and explain about the right of child eg free and
com pulsory education. i will explain his parent that em ploy ing child below 1 4 is crim e.
will explain clearly to shop owner about nature of crim e as these people are not alway s aware about law.
in case child is orphan will consult NGO to take care him further. IF tea shop owner not allowing him to leav e will inform police
and register a FIR for this.
In case of organize racket of child trafficking FIR should be registered and further enquiry should be done.

As a hum an being I first stop the shop owner and then ask him to calm down, and then quickly see whether the boy is hurt form
spilling of tea and breaking of glasses. If the boy is hurt then quickly ask for a first aid help or get help from nearby doctor. When
I satisfy that boy is fine now then giv es him som e water and allows him to settle. Then I told the shop owner that it was not the
m istake of boy it was m y fault, I was not aware of the boy standing behind m e and accidentally touch the plates carry ing the
tea. I hav e apology for that. Then I inquired about the boy s age, and ask the owner about awareness of the laws that a child
below 1 4 y ear age cant be force to work according to SC orders.
Ev ery one has a social responsibility to aware people about the laws and m isconduct done by them m istakenly or knowingly . Its
m y duty to aware them about the consequences of hiring a child as it is illegal. A tea shopkeeper is also from a v ulnerable group,
it would be good if we can aware them about their social responsibilities and to help children by not hiring them and conv ince
their parents and relativ es to allow then to study and which m ake his future.
It would be good to just warn them and strictly order him to nev er com m it this ty pe of m istakes. Approach to the parents of the
child or approach to NGO who could help the children to take care of its studies.

Child labour is a punishable offence and has been banned. Phy sical abuse is also an offence.
Firstly , I will stop the owner from beating the kid and tell him that he cannot and shouldnot beat the kid. Then, I will enquire
about the child, his parents and his whereabouts. Then I will tell him that child labour is against the law and he should not
em ploy a m inor. Then I will leav e as creating a scene would not m atter m uch.
Then I will lodge FIR against the shop and contact child care serv ices to rescue the child. I will also giv e the police and child care
serv ices the whereabouts of his parents and ask them to prov ide foster care if need be.

casual & norm al one.
In present the issue are a boy i working in tea hop, by accident tea is spilled on y ou causing lo to y ou & hop owner and hop
owner beating boy for this.
The situation tests law abidingness, courage & com passion from IAS officers side.

Anil could not notice the boy standing just behind him as he was on call. Whole incidents occured due to the negligence on part of
Anil & sm all boy . If I am at Anils place, being a m atured person, I will adm it m y negligence to the owner of shop. I will offer him
the am ount for broken glasses and prev ent him from beating the kid. I will also warn the owner to inv olv e in such abusiv e
behav ior in future.
Being an IAS officer, it is m y duty to m onitor the child labor cases.
I will enquire the kid about the owner behav ior. In case, he m entions frequent v erbal/phy sical abuse, I will lodge com plain
against him in local police station.
Though current laws allow for children em ploy m ent in nonhazardous occupation but India is already m ov ing towards com plete
prohibition of child labor. Under RTE m andate, children between 6 -1 4 y ears old should get free education.
I will get the details of child parents /guardians and request them to send their child for education. I will inform them that their
child has basic right to get free education and they are duty bound to adm it their kid in schools. I will ask them to contact local
authority /m e in case local school refuses to adm it their ward.

In light of the Right of Children to Free and Com pulsory Education Act, 2 009 , the Bill seeks to prohibit em ploy m ent of
children below 1 4 y ears in all occupations except where the child helps his fam ily after school hours.

a would-be IAS officer law dem ands action and explanation to any body trespassing the laws.
First of all tea spilling is not the fault of the boy so its dem anded to respond as the boy sav iour accepting m y own fault and m ake
the shopowner know it.Further I would ask him to add the fine to the bill so that ill m ake his losses.I will also m ake the boy feel
confident and not hum iliated and em barrassed by talking som e frank topic to him .His sensitiv e m ind m ust not get ev en the hint
of em barrassm ent as it will suppress his personality .
Now being an IAS officer its m ust for m e to m ake the shopowner aware of the legal consequences of em ploy ing a child
labour,treating him carelessly and detail him of Child Labour laws,RTE,MDM and other gov ernm ental schem e regarding the
children welfare so that he can him self act upon it and will further spread the m essage to his other peers.Further if I Will contact

There are three issues here
1 . Gross v iolation of Child Labour Act
2 . Inhum an treatm ent of child
3 . socioeconom ic circum stances of childs fam ily (which seem s to be m ajor cause for child labour)
After stopping shopkeeper from scolding child, Arun should im m ediately inform police and ask them to carry out inv estigations
and act accordingly .
To hav e real im pact, Parents of child should be contacted and the real reason for child labour should be found out. They should
be councelled regarding facility of free education and new constistutional prov isions regarding child labour.
Meanwhile contact should be m aintained with SHO of concerned Police station and stress for fair inv estiogation and justice.
Regular follow up with parents and SHO should be m aintained and possible help and guidanace needs to be offered. The tim e and
efforts are worth as it would help im prov e lot of a fam ily and decrease the child labour to som e extent.

You hav e not considered the cognizable offence being perpetrated by the owner right in front of y our ey es, phy sical abuse of
any one is a cognizable offence, first, stop the m an from beating the boy , assess the condition of the boy , see if the boy needs
first aid, call for an am bulance if required, call the police and file an official com plaint, as per the sections on phy sical abuse,
and child labor, pay the shop owner for tea and the broken glasses. Once these are done, y ou m ust rehabilitate the child by
inv olv ing the social and child welfare organizations, gov ernm ent or otherwise. There no necessity for apologizing or cajoling
or pleading with a an indiv idual who has v iolated the law to such degree. You need to be strong and strict and enforce the law
when it m atters, and abuse of children is one such case where y ou can not negotiate.

Firstly , i will stop the shop owner from thrashing the boy and m ake him know that i m y self is responsible for the spill-ov er and
breakage. Then i will look at boy s condition to see whether he receiv ed any injuries and accordingly giv e him som e first aid.
Later i will tell him that his em ploy ing a child itself a crim e and phy sically abusing him ,for whatev er reason it is, a bigger
crim e indeed.And i will warn him not to repeat this, else face serious consequences.I will then settle him the m oney for
breakage.Then i will find the whereabouts and details of that boy . I will talk to his parents and inform them that its a crim e

In the giv en situation, if I were Anil, firstly , I stop the owner of the shop from beating the serv ant boy and adm it that the it was
an accident and It was actually not the boy s fault and pay the m oney for the broken glass.
Secondly , I enquire about the boy who is working and got beaten; from how long hav e y ou been working in the shop, about his
education, parents and his whereabouts. Then, I com e to the shop owner and m ake him aware of the Child Labour (prohibition
and regulation) Act, 1 9 86 and consequences for v iolation of the aforem entioned law like penalizing and liable for further
prosecution. As it is cognizable offence and blatant v iolation of law, the shop owner can be charge-sheeted.
Howev er, for ev ery person who is not aware of laws and consequences for v iolation of the law can be giv en an opportunity to
m end their way s and to tread upon right path. The shop-owner should be sternly warned and also cautioned that if this gets
repeated again, y ou will be in the soup.

The child labour law explicitly bars children from working at dhabas, restaurants and tea stalls. But poor enforcem ent in m ost
of the cities m eans that chhotu rem ains alm ost ubiquitous at roadside eateries. As a hum an being and as a citizen of India one
should work towards curbing it. More so when I am a civ il serv ent. In this case the v ery first reaction should be to im m ediatly
stop the shop owner from beating him and exam ine the child if he is hurt ( burns) and arrange first aid(burnol, ice, cold water)
based upon sev erity and av ailability .
Thereafter, I shall tell the shop owner that it was m y fault and pay for the dam age. Then dial 1 00 and report the incident (of
child labour) to local police. Meanwhile, I will councel the child that he should not fear and ev en rev el m y professional identity
in case I feel it will im bibe faith and confidence in him . I shall discuss with the child and try to fetch the nam es of other children
who are working sim ilarly in the locality . Further, I shall prov ide the inform ation so collected to the police and request them to
take it further.
Child labour is not by choice, its deep rooted to the v icious circle im bibed by pov erty . I will try to m eet his parents and m ake
them understand that its not only illegal to do so, but also leads to lack of education which curtails any future prospect of
econom ic stablity to com e. I will educate them which the ongoing gov ernm ent schem es of RTE, Child Labour rehabilitation
fund, National Child Labour Project and about local NGOs who prov ide v oluntary support. I will also encourage them to
m otiv ate others againt child labour in their locality and educate other with the legalality and punishm ent inv olv ed. Finally I
shall prov ide them toll free num bers of gov ernm ent and v oluntary organizations who can help them with transition.

the situation checks officers em otional intelligence and his courage , knowledge and presence of m ind.
first of all, i will tell the tea staller im m ediately to stop the child beating ,and then i will inquire him from where he got the
child. if he is hesitating to giv e response properly then i would ask the child about where he belongs.
if the child tells that he was com pelled and forced by som eone to work on this tea stall , then definitely it would be a crim inal
case as probably any child racket is inv olv ed in selling the child or forcing him to work to work at this tea stall or at any other
place. In this situation i will call the police and inform them about the situation.
In case child tells he is sent here at this tea stall by his parents for som e earning as they are v ery poor or hav ing som e other
serious fam ily problem , then i will call a Child Care Agency working in that area and ask them to take care of the child, his
rehabilitation and education.
Mean while i will sternly warn that tea staller also about hiring any child below 1 4 y ears for work is a crim inal offence which
will result in closing down his tea stall and a jail punishm ent for sev eral y ears.Being threatened with this warning he will nev er
dare to hire a child again. As we know a tea staller hire a child for work only to cut and reduce the labour cost.

A: Child labour rem ains a m ajor issue for india despite of the exisiting laws like Child Labour (Prohibition and Regulation)
Act,1 9 86 . Its poor im plem entation has led to alienating children from regular schooling and also frequent subjection to
inhum an treatm ent at workplaces.In this case,the stall owner is responsible for not only v iolating child labour laws but also
subjecting a child to phy sical torture.
In the first place,it is m y m oral duty to sav e the child from the phy sical abuse of shopowner and ensure that he is okay .If not,ill
arrange for the m edical aid according to the sev erity of the situation.
Thereafter,ill warn the shopkeeper not to repeat such behav iour with any child and pay him the dues adm itting m y m istake.
As a would be IAS officer,ill enquire about the condition of the child and his fam ily and to the reasons why is he inv olv ed in such
work instead of attending school and learning .Ill talk to his fam ily ,tell them about RTE and other serv ices prov ided to them by
gov ernm ent to ensure holistic dev elopm ent of their child.Ill persuade them to send their children to school
and that failing to do this m ay bring them legal proceedings.
Also,ill logde a com plaint against the shopkeeper and discuss the case with
the local officer as to why such practice is still prev ailing in their area.

This case shows the appaling condition of child labor prev alent in our country . Since, Mosr of the child laborers are taken from
the poor rural areas where parents are in dire need of source of incom e, thus this practice is going on unabated.
If i would be at Anils place, i will first try to stop the shop-owner from phy sically punishing the y oung boy . I will also rem ind
him that, em ploy ing a 1 0 y ear old boy is against the legal prov isions.Since there m ay be econom ic dependencies attached to the
boy , i will not try to disrupt his em ploy m ent, but will ask the owner to m ake sure that he is enrolled in a nearby gov ernm ent
school, so that he can also pursue education in between his daily work. I will also ask the owner to refrain from using phy sical
force for punishm ent and will check whether the proprtionate wages has been giv en to him or not. I will also enquire boy about
the foodind and lodging prov ided by the owner.
I will giv e m y num ber to the y oung boy and ask him to inform m e in case of any assistance or adv erse situation, so that i m ay
help him in the possible way .

The situation here reflects a grav e sense of apathy , loss of com passion and non com pliance of laws such as Prohibition of Child
Labour, RTE prov isions which are still not being im plem ented fully in India.
Anil firstly has to stop the shop owner from beating the child, take the child for m edical attention and at the sam e tim e take
action against the shop keeper for illegal em ploy m ent of child below the age of 1 4 .

Anil should also ask the child, not only sy m pathetically but with em pathy about his fam ily , his schooling and nutrition needs
and should full all his needs by contacting the local im plem enting authority of v arious schem es such as ICDS, RTE etc. Anil
should m onitor childs progress personally from thereon as it creates a sense of security for that child.
As an IAS officer, Anil needs to reflect upon the practical problem s and lacunae of the im plem entation of the acts and think of
innov ativ e solutions exam ple being he could ask his local group of fellow aspirants to take start a program m e like Each one,
Teach one, which doesnt require m uch efforts and infrastructure.
The other issue here reflects loss of societal ethics and m orality as seen in the behav ior of the shop owner. Anil should try and
form a com m unity based m onitoring sy stem inv olv ing gov ernm ent agencies, local civ il society organisations and citizens for
effectiv e im plem entation, awareness generation and sy m bolic transform ation of the society at large.
As a precedence for strict com pliance of legal prov isions, he should press for strong and reform ist punishm ent for the shopkeeper.

As a hum an being first of all I would im m ediately stop the shopkeeper and scold him why he is beating the y oung boy for no fault
of his. I should clearly warn him that he should stop putting child as em ploy ee on his stall. I should im m ediately console child.
Since now I hav e lot of confidence as I am , IAS officer. My whole life aspiration is to dedicate to people and rem ov e the sufferings
of them . Child is so innocent, he needs proper env ironm ent and care to becom e good citizen. For this child I will find out how he
can go to school and conv ince his parents not to m ake him work for little m oney . I will ensure that he is properly rehabilitated. If
required I will becom e m entor of him .

as a hum an being it is m y m oral duty to sav e the hapless child from the lashing.the child is being beaten because he has caused
loss for the stall owner.i would offer to pay for the dam ages as i too was inv olv ed in the accident and this would protect the boy
from further beating.
as an officer trainee and a responsible citizen it is m y duty to explain the tea
stall owner that em ploy ing children below 1 4 and beating them is in contrav ention of law.at the sam e tim e i would also
com palin about the sam e to the relev ant authorities so that the boy can be rescued from child labour.
i would interact with the boy to know whether he is enrolled in a school or not .if he is out of school i would m eet his parents and
enlighten them about the right to education and persuade them to send him to school.

First as a Com m on citizen who broke glasses he has to pay for the Shopkeeper and Now as an adm inistrator he has to inform to
the respectiv e authorities regarding Child Labour in that area and take legal action on the shopkeeper after Making Necessary
arrangem ents for the boy to get his Right to Education.It is his Moral duty to prov ide som e sort of incom e to boy s fam ily so that
they will not send their child to work.

After a y ear of intense training at LBSNAA , Anil has com e to Mukherjee Nagar to m eet his close friend Parul who is preparing

This is a serious issue because of the boy is a m inor.According to Right to Education act all students under 1 4 y s age giv e free and
com pulsory education.
Here first ai protect the boy from his m asters beat.Then i told about this offence.If the m aster is try to understand m e i will also
giv e awareness about child about education otherwise i will put the boy behind the teashop.and will take action against the
m aster
