Foster care maintenance and difficulty of care (DOC) rate charts by age
category for calendar year 2009 effective January 1, 2009.

PURPOSE
Provide county and tribal human service agencies and private agencies
the 2009 foster care rates to be paid for out-of-home placements.

BACKGROUND
Minnesota Rules, part 9560.0650, subpart 1 and part 9560.0655, subpart 3, require that the
Department of Human Services review and revise the foster care maintenance standards and
difficulty of care rates annually. Minnesota Rules require using the United States Department of
Agriculture (USDA) estimates of the cost of raising a child in determining the annual child foster
care rates.

ACTION REQUIRED

• Daily Basic Maintenance Foster Care Rates

The daily basic maintenance rates to be paid to child foster care providers for service dates
beginning January 1 through December 31, 2009 are as follows:

Ages 0 through 11 $ 20.57

Ages 12 through 14 $ 23.75
Ages 15 through 18 $ 24.48

• Initial Clothing Allowance Rates

Below are the initial clothing allowance rates effective January 1, 2009. To be eligible for Title
IV-E reimbursement, this allowance must be used within 60 days of the child’s initial placement
in foster care.

Ages 0 through 11 $ 415

Ages 12 through 14 $ 701
Ages 15 through 18 $ 793

• Difficulty of Care (DOC)

Minnesota Rules, part 9560.0656, provides criteria for assessing the DOC and payment rates for
children in foster care. The DOC assessment tool required in Minnesota Rule, part 9560.0654 is
to be used to calculate the rate. Each DOC point is to be calculated at the daily rate of 22 cents.
The tables in Attachment A show combined foster care maintenance and the difficulty of care
daily rate schedules for each age category.

The department recommends the social worker complete an assessment to determine the initial
DOC daily rate within 30 days of the child’s placement in foster care. Thereafter, the DOC daily
rate must be reassessed:

1) at the end of 12 months in the same placement;

2) at the request of a foster parent;
3) when a child is placed in a different facility; or
4) if a child’s level of need changes.

Minnesota Rules, parts 9560.0665, subparts 4 and 5 require the county to give a child’s foster
care provider a written notice of the initial DOC assessment and reassessment. This notice
includes:

1) statement of DOC rating and dollar value

2) method of assessment
3) statement of legal authority for the rating
4) statement of the circumstances under which the agency must reassess the child
5) procedure to seek reassessment
6) notice that the foster provider has the right to a fair hearing review of the
assessment by the department
7) In addition, reassessments need to include the prior DOC rating, new DOC rating,
effective date of rating and a notice that a foster parent who requests a review of
the DOC rating within 10 days, may continue at the current rate pending the
hearing, but the agency may recover any overpayment.

DOC costs cannot be claimed retroactively earlier than the first day of the month in which the
assessment was completed. This statement pertains to the county agency’s ability to claim
federal reimbursement for these costs; however, foster parents may still receive the adjusted
payment retroactively.

DOC assessments must be completed for all children placed in foster family settings, foster
residence settings and treatment foster care settings licensed under Minnesota Rules, parts
2960.3000 to 2960.3340. The DOC rate is considered part of the maintenance rate and is
Title IV-E reimbursable for eligible children.
