Dollar Community Council (CLDP077h) welcome the explanation of the
considerations which may constrain development in paragraph 1.10, but seek
clarification on issues relating to enhancement and promotion of village
centres; and requests that re-use of brownfield and vacant sites identified in
the Dollar Community Council Masterplan for Dollar be considered.

sportscotland (CLDP083i) request a modification to the Context section of
the Plan to emphasise that the general considerations of the Plan include
supporting, protecting and enhancing opportunities for sport and recreation.

Scottish Natural Heritage (CLDP144a) request a change to the terminology
used in relation to significant areas of landscape importance in bullet point 3
of paragraph 1.10.

Philip Lord (CLDP170a) requests clarification of how the word "sustainable"
should be interpreted in the context of its use in the Plan Introduction.

Modifications sought by those submitting representations:

sportscotland (CLDP083i) recommends the replacement of bullet four in
paragraph 1.10 with the following text:
Potential to strengthen green infrastructure, the quantity and quality of open
space, improve habitat networks, contribute to CSGN aims and objectives,
and support, protect, and enhance, opportunities for sport and recreation.
Reason: In order to ensure that the list of General Considerations better
reflects the requirements of Scottish Planning Policy (February 2010)
(Paragraph 149) (CD001) with regard to sport and recreation, and the
important contributions they make to a healthier Scotland.

Scottish Natural Heritage (CLDP144a) request a modification to the Context
section of the Plan to replace the term "significant areas of landscape
importance" in bullet point 3 of paragraph 1.10 with the alternative term "high
quality landscapes", to avoid confusion with terminology used to identify
designated landscape areas.

Summary of responses (including reasons) by Planning Authority:

Bullet-point 14 in paragraph 1.10 to which Dollar Community Council
(CLDP077h) refers, states that general considerations include "the
requirement to enhance and promote the environment and vitality of our town
and village centres". This consideration applies to all town and village centres
in Clackmannanshire. No changes are therefore sought to the LDP.

The purpose of the proposed modification by sportscotland (CLDP083i) to
the Plan Context is accepted. However, if the Reporter is so minded, to
maintain clarity, a new bullet point could be introduced to cover the point
raised. There would therefore be no change to bullet point 4 in paragraph
1.10; but a new bullet point 5 could be introduced to address the issue raised
by sportscotland, such as:
"The need to support, protect, and enhance, opportunities for sport and
recreation".

The representation made by Scottish Natural Heritage (CLDP144a)
regarding the terminology used to describe important landscape areas is
accepted. If the Reporter is so minded, bullet point 3 in paragraph 1.10 could
be modified to address the point raised by Scottish Natural Heritage, and also
make further minor amendment to improve clarity, such as:
"The need to protect high quality landscapes, including the Ochil Hills, from
inappropriate development"

In relation to the query raised by Philip Lord (CLDP170a) regarding the use
of the word "sustainable" in the Plan Introduction: The term "sustainable
development" has been used in accordance with the widely-accepted
definition used by the Report of the World Commission on Environment and
Development: Our Common Future (1987) (Chapter 2: Towards Sustainable
Development, Paragraph 1) ("Brundtland Definition") (CD085), which states:
"Development that meets the needs of the present without compromising the
ability of future generations to meet their own needs".

The term "sustainable" applies this principle to economic and population
growth (in paragraph 1.4) and our vision for Clackmannanshire (in paragraph
2.5).

Section 3E of the Planning etc. (Scotland) Act 2006 (CD021) requires that
development plans must contribute to sustainable development. Scottish
Planning Policy (February 2010) paragraphs 34-40 (CD001) sets out Scottish
Government guidance on the factors to be addressed by development plans
in complying with this requirement. All policies and proposals in the
Clackmannanshire Local Development Plan have been prepared within the
context of Scottish Government guidance, including guidance on sustainable
development. No changes are therefore sought to the LDP.
