June 17, 2013 Middletown, PA 17057 The June 17, 2013 meeting of the Middletown Borough Council was called to order at 7 p.m. by Council President Christopher R. McNamara. Following the Pledge of Allegiance, the following Council members answered roll call: Barbara Arnold, Donald Brooks, Robert Louer, Christopher R. McNamara, Judy Putric, David Rhen, Scott Sites, and Suzanne Sullivan. Councilor John Brubaker was absent. Also in attendance were Mayor Robert G. Reid, Borough Manager Tim Konek, Borough Secretary Chris A. Courogen, and Adam Santucci, of McNees, Wallace and Nurick, the Boroughs solicitors. PUBLIC COMMENT No public comment was offered. At 7:02 p.m., Council recessed for a joint meeting with the Borough Authority to hear a presentation on the boroughs infrastructure. Authority members present were Chairman John Patten, Robert Louer Jr., and Christopher R. McNamara. Josh Fox, of HRG, the Boroughs engineers, delivered a report on HRGs evaluation of the sanitary sewer lines in the downtown area. Fox reported there are significant problems with the old, brick, pipe carrying the sanitary sewer under Union Street in the downtown area. Those problems are believed to contribute significantly to the Boroughs inflow and infiltration issues. Fox offered a preliminary estimate of $1.2 million to replace the storm water and sanitary sewer lines in the area. He estimated it will cost another $125,000 to $150,000 to repave the streets. HRG also plans to do further testing before beginning any design work for the project, Fox said. After discussion of Foxs report, no action was taken and at 7:28 p.m. the joint meeting was adjourned and Council reconvened to continue its meeting. APPROVAL OF MINUTES Councilor Louer made a motion to approve the minutes of Councils meetings from March, April and May. The motion was seconded by Councilor Sullivan and approved by a unanimous 80 vote. MAYORS REPORT Mayor Reid asked who owns land along Grant Street at the end of the airport and expressed concern about high weeds growing there. Manager Konek reported on a request by Wesley United Methodist Church to close Witherspoon on June 29 between South Catherine and South Union Streets for an event they are holding in their parking lot. He also reported on a proposal by HRG to administer the demolition contract for the HMGP buyout properties. SECRETARYS REPORT Secretary Courogen reported on the Boroughs Flag Day ceremony, the Pa. Game Commissions plans to band geese near the boat launch on South Union Street, and updated Council on the start of the Web site redesign project. Councilor Louer made a motion to waive the preliminary plan approval process requirements of the Boroughs Subdivision and Land Development Ordinance (the "SALDO") to allow consideration of Dauphin Street Associates subdivision plan as a final plan. The motion was seconded by Councilor Arnold. Councilor Rhen asked how many building lots the plan would entail. Timothy Przybylowski, of Century Engineering, representing the developer, said the plan submitted did not include any development plan, just a subdivision of the parcel owned by the Middletown Cemetery. The area is zoned R-2. The motion was approved by a 4-2 vote, with 2 abstentions. Councilors Rhen and Sites cast the no votes. Councilors Sullivan and Putric abstained. Councilor Louer then moved to approve the final subdivision plan of Dauphin Street Associates. The motion was seconded by Councilor Brooks and approved by a 6-2 vote, with Councilors Rhen and Sites voting no. Councilor Sullivan moved to approve the proposal to retain HRG to administer the HMGP demolition project. The motion was seconded by Councilor Louer. Mr. Santucci explained HRG has expertise in administering such projects. Steve Fleming, of HRG, added they are providing similar services to other municipalities and have a team which has developed expertise in the area. The motion was approved by a unanimous 8-0 vote. COMMITTEE REPORTS PUBLIC SAFETY Councilor Rhen reported on the status of the police station project and commended Officer Gary Rux for taking time to do community policing by visiting the swimming pool during his shift. COMMUNITY DEVELOPMENT Councilor Arnold thanked everyone who helped decorate the square for Flag Week and said the decorations would remain in place through July 4.

Councilor Arnold also commented on an article in the Hummelstown Sun which she said made a reference which cast a negative light on the Borough. OLMSTED RECREATION LIAISON -- Councilor Rhen reported the Rec Board failed to have a quorum at its last meeting. He also questioned the finances of the swimming pool and Main Street Gym and asked Borough Manager Konek to look into how much revenue the Borough has been receiving from the Rec Board for use of those facilities. At 7:59, Council went into Executive Session. Council reconvened publicly at 8:39 p.m. with Councilor Louer reporting items pertaining to personnel matters and possible litigation had been discussed. No action was taken. Councilor Brooks made a motion to adjourn. The motion was seconded by Councilor Sullivan and approved by unanimous consent. Council adjourned at 8:40 p.m.
