SC to hear Sangma’s petition tomorrow

A five-judge Constitution Bench of the Supreme Court will hear on P.A. Sangma’s petition, challenging the election of
Pranab Mukherjee as President.
P A Sangma had filed a petition against President Pranab Mukherjee claiming that he was holding the office of
Chairman of Indian statistical Institute when he took oath as President.
In his reply filed through P.H. Parekh and Co., the President clarified certain issues raised in the petition relating to his
resignation as an honorary member of the Indian Statistical Institute (ISI), Kolkata, and claims of privileges as leader of the Lok
Sabha.
President Mukherjee said he had resigned from the office before he took over as President.

Eligibility Criteria to become President

Article 58 of the Constitution sets the principle qualifications one must meet to be eligible to the office of the
President. A President must be
A citizen of India
Of 35 years of age or above
Qualified to become a member of the Lok Sabha
A person shall not be eligible for election as President if he holds any office of profit under the Government of
India or the Government of any State or under any local or other authority subject to the control of any of the said
Governments.
Certain office-holders, however, are permitted to stand as Presidential candidates. These are
The current Vice President.
The Governor of any State.
A Minister of the Union or of any State (Including Prime Minister and Chief Ministers).

CMC asked to make recommendation on water sharing

The Supreme Court directed the Cauvery Monitoring Committee to examine all the issues concerning the
water sharing dispute between states of Tamil Nadu and Karnataka at the panel’s scheduled meeting fixed for 31st
October and make appropriate recommendations.
A bench of Justice DK Jain and Justice JS Khehar today further directed both the states to comply with the
recommendations made by the Committee in ‘letter and spirit’.
Earlier the court had clarified that its September 28 order, directing the Karnataka government to comply with
the Cauvery River Authority (CRA’s) order to release 9,000 cusecs of water per day to Tamil Nadu till October
15, will not come in the way of any decision by the Prime Minister headed committee on the Karnataka’s application
seeking review of the water release order.
The bench has posted the matter for hearing on 26 November.

INTERNATIONAL ISSUES

Nepali Parties resume negotiations

Nepali parties have formally resumed their negotiations to determine the political roadmap after a long break
While they have been swinging between two options, of either holding fresh elections for a new Constituent Assembly (CA)
or reviving the old CA to promulgate a constitution, the momentum has shifted clearly in favor of fresh polls.
In the past week, Maoist chairman Pushpa Kamal Dahal ‘Prachanda’ put forward a proposal to the Nepali Congress
(NC) and Communist Party of Nepal (Unified Marxist Leninist).
As the best option, Maoists suggested promulgating a constitution incorporating all issues agreed upon before May 27,
when the CA expired, and leaving contentious issues for the next elected Legislature-Parliament.
The proposal added also provided to go for fresh elections if no consensus evolves on the current solution.
Nepali Congress has however rejected the CA revival option.
Major differences, however, persist to hold polls.

Sandy wreaks havoc on east coast

Up to 17 people were reported dead and millions left without electricity on Tuesday morning, as residents of the U.S.
East Coast due to Hurricane sandy.
The hurricane made landfall in New Jersey on Monday 29 Oct night with sustained, 130-kmph gusts, leading to six million
homes losing power.
Mr. Obama also declared a state of “major disaster” in New York City, New Jersey and Long Island, which, along with
the emergency declaration, allows for federal assistance to supplement cities’ efforts to provide temporary housing
and repairs, low-cost loans to cover uninsured property losses, and other disaster recovery measures.

ECONOMY

RBI reduces Cash Reserve Ratio; keeps Repo and Re-Repo rates unchanged

RBI has reduced Cash Reserve Ratio (CRR) by 25 basis points from 4.5% to 4.25% in its monetary policy review on
30th October 2012.
This will infuse `17,500 crore into the banking system.
This reduction will be with effect from November 3 as the banks would need some time to implement this change.
RBI also lowered the projection of GDP growth from 6.5% to 5.8%.
RBI Governor expressed his concerns over the surging Non Performing Assets of Banks.
RBI hiked banks’ provisioning requirement to 2.75% from the existing 2% on restructured standard loan accounts.
The Liquidity deficit had been high due to factors like:-
Gap between deposit and credit growth
The build-up of Government’s cash balances from mid-September
The drainage of liquidity on account of festival-related step-up in currency demand
RBI did not ease the Repo and Re-Repo rate as inflation is not likely to ease in the near future.
Projection of Headline WPI inflation for March 2013 was raised to 7.5% from 75 indicated in July this year.
Easing of CRR will not lead to an immediate reduction in Loan rates though the rates might fall over a period of time.

Misconstruing order, Chhattisgarh tribals denied sterilization for three decades


Three decades-old official order, issued for restricting targeted sterilization of the primitive tribal groups (PTGs) in
Chhattisgarh to check their dwindling numbers, is all set for a re-look.
The order was given by Planning Commission to the state governments to issue clarifications to ensure that desirous PTGs
will not be denied sterilization.
The order was issued on December 13, 1979 by the undivided Madhya Pradesh government during the time when targets
were set to achieve population control.
An exemption to the order was made for 26 blocks, which had a high population of PTGs as the infant mortality rate was
very high in the tribal areas and their numbers were fast decreasing.
The Tribal groups are Behor, Pahari Korvas, Abhujmadias, Kamar and Baiga.
The order said an exception should be made for tribal communities whose population was either stagnant or was
decreasing and that they should have access to other contraceptives if they required but a total ban was imposed on these tribes.
It was also mentioned in the order that if anyone insisted on undergoing sterilization, he/she should be provided the
services upon permission from the Block Development Officer.
This order was construed as Rights of Violation by Sulakshana Nandi of the Public Health Resource Network, which took
up the issue as a violation of women’s reproductive rights.
She said that instead of trying to decrease the number of deaths in these communities, the government chose to make
them have more children as their fertility rate was higher than other communities and the mortality rate was also several times
more than others.

BILATERAL ISSUES

All parties to Sistema dispute free to take legal recourse: India

A day after Russia warned that it will go for international arbitration if the issue of cancellation of 2G license to Sistema was
not resolved in courts here; India on Oct 30 said all parties to the dispute were “free to take legal recourse”.
As, it is a commercial matter and all parties to the dispute are free to take legal recourse that they deem appropriate
to meet their commercial goal,” official spokesperson in the Ministry of External Affairs said.

About International arbitration

International arbitration is a leading method for resolving disputes arising from international commercial
agreements and other international relationships.
As with arbitration generally, international arbitration is a creature of contract, i.e., the parties’ decision to submit disputes
to binding resolution by one or more arbitrators selected by or on behalf of the parties and applying adjudicatory
procedures, usually by including a provision for the arbitration of future disputes in their contract.
The practice of international arbitration has developed so as to allow parties from different legal and cultural
backgrounds to resolve their disputes, generally without the formalities of their respective legal systems.

India, U.K. amend convention on avoidance of double taxation

India and the United Kingdom on 30 Oct signed a protocol amending the 1993 bilateral convention on avoidance of
double taxation and prevention of fiscal evasion related to taxes on income and capital gains.
The amended protocol would provide tax stability to the residents of the two countries, and facilitate mutual economic
cooperation besides stimulating flow of investment, technology and services between the two countries.
The protocol incorporates in the convention, provisions for effective exchange of information between the tax authorities
of the two countries in line with latest international standards, including exchange of banking information and
supplying of information irrespective of domestic interest.

India, U.S, Japan trilateral meeting

Senior officials from India, U.S. and Japan discussed trilateral cooperation in maritime security and a route through
middle or north of Myanmar leading up to Hanoi on Monday 29 Oct.
Discussions on Myanmar were of great interest to India. While India has taken up a trilateral connectivity initiative
with Myanmar and Thailand, this meeting touched on a route through upper Myanmar that would lead into Vietnam.
The US’ ‘pivot-to-Asia’ policy, Iran, China-Japan maritime dispute and South China Sea are the issues that were
discussed during the 3rd round of India-US-Japan Trilateral dialogue in New Delhi.
The meet also focused on finding areas of cooperation between the three countries.
The third trilateral also exchanged proposals on doing projects together in Africa as well as cooperating on the economic
side in Afghanistan.
In the area of maritime security, they touched upon some specific areas of cooperation which will fructify in the next cycle of
talks.
Officials also deliberated on the East Asia summit and the Association of South East Asian Nations.

India-U.S.-Japan meet rankles China

Chinese state media outlets and strategic analysts have expressed wariness at the India, Japan and the U.S. trilateral
meet.
China described the meet was aimed at exerting pressure on China over its regional ambitions.
Foreign ministry spokesperson Hong Lei said that China has always maintained that all countries should cooperate, promote
common development and realize common security on the basis of equality, mutual trust and collaboration. “It is in the interests of
all countries in the region,”
Beijing is currently locked in an ongoing dispute with Tokyo for the Diayou (Senkaku in Japanese) islands in the East
China Sea.
Beijing has also said that the US is trying to control China’s growth and influence by meddling in regional affairs.
The Communist Party-run Global Times, said in an editorial on Tuesday 30 Oct that Japan — embroiled in a dispute
with China over East China Sea islands — was seen as driving the trilateral initiative, being the “most anxious” of
the three countries about China’s rise.
“Japan is causing problems for China, but it is not the country’s foremost worry,” said the editorial.
