***** ORDER: In the Government Order 1st read above, orders were issued constituting Ninth Pay Revision Commission and Government appointed Sri C.S.Rao, IAS, (Retd.) as Pay Revision Commissioner. In the Government Order 2nd read above, the terms of reference of the Pay Revision Commissioner were laid down. 2. According to rule 31 of the Andhra Pradesh Revised Pension Rules 1980, the expression emoluments means Pay as defined in Rule 9(21)(a) (i) of the Fundamental Rules which a Government servant was receiving immediately before his retirement or on the date of his death. Thus only basic pay is being reckoned as emoluments. However, orders were issued in G.O.Ms.No.87, Finance & Planning (FW.Pen.I) Department, dated 25-05-1998 permitting to treat personal pay granted to protect the emoluments to be absorbed in future increments also as emoluments. But, the above orders are silent, in cases where the entire personal pay or a part of personal pay could not be absorbed, due to non-availability of the future increments in the scale of pay or the individual retires/dies prior to the absorption of the personal pay either in full or in part.

The Ninth Pay Revision Commission, after due consideration of the Pension Rules and Government of India orders and the requests of various Associations, inter alia, recommended to the effect that in all cases, where the pay is fixed beyond the maximum of the scale of pay, by treating the amount over and above the maximum of the scale, as personal pay either due to revision of scale of pay or due to fixation of pay on promotion/appointment to another post or due to allowing higher scales under Automatic Advancement Scheme should be treated as emoluments. 4. Government, after careful consideration of the matter, decided to accept the recommendations of the Pay Revision Commission and accordingly hereby order that in all cases, the Personal pay granted to protect the loss in emoluments either due to revision of scale of pay or due to fixation of pay on promotion / appointment to another post or due to allowing higher scales under Automatic Advancement Scheme including the unabsorbed portion of Personal pay in future increments, if any, in cases where there is no scope for the absorption of the Personal pay either in full or in part due to non availability of future increments in the scale of pay or the individual retires/dies prior to the absorption of the personal pay, shall be treated as emoluments for the purpose of pensionary benefits. 5. These orders are applicable to all the Government employees governed by the A.P. Revised Pension Rules, 1980 and retired from service or died while in service on or after 01-07-2008. 6. These orders shall come into force with effect from 01-07-2008 notionally and the monetary benefit will be given with effect from 01-02-2010 only. 7. Necessary amendments to the Andhra Pradesh Revised Pension Rules, 1980 will be issued in due course. 8.
