COMMUNITY REINVESTMENT
The Community Reinvestment Act is intended to encourage depository institutions to help meet the credit needs of the communities in which they operate, including low and moderate-income neighborhoods, consistent with safe and sound operations. It was enacted by the Congress in 1977 (12 U.S.C. 2901) and is implemented by Regulation BB (12 CFR 228). The regulation was substantially revised in May 1995 and updated again in August 2005. Banks are examined under three specific tests: Lending, Investments and Service. First Niagara received a Satisfactory rating for its most recent 2007 CRA Exam as performed by the Office of Thrift Supervision (OTS). These investments supported affordable housing, small business and community development projects that support low and moderate-income communities. We participate in a variety of community development activities such as small business loan funds, non-profit community loan pools, Low Income Housing Tax Credits, SBA programs including SBICs, municipal bonds and direct support of non-profit housing and economic development partners. First Niagara Community Development Corporation (CDC), a subsidiary of the Bank, provides dedicated financial resources for community development activities in lowto-moderate income areas that need more flexible and innovative financing. First Niagara has committed more than $25 million to the CDC to date. First Niagara Foundation has a special focus on community development and youth services and supports these programs in underserved areas.
